The order by state government to ensure working conditions was notified <span style=\"font-style: italic;\">vide<\/span> <span style=\"font-weight: bold;\">Notification no. 647\/XXXVI-3-2022-17(sa)\/2022 <\/span>dated 27-05-2022.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\"><span style=\"font-weight: bold; text-decoration: underline; text-underline-style: solid; text-underline-mode: continuous;\">Key Points<\/span>:<\/p>\n<ul style=\"list-style-type: disc; margin-left: 6.35mm;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Uttar Pradesh has taken a step ahead in providing security to \u2018women employee&#8217;<a id=\"_GoBack\" name=\"_GoBack\"><\/a> working at late hours of the day. This notification however only covers those governed by <a href=\"http:\/\/www.scconline.com\/DocumentLink\/38YTLthh\">Factories Act, 1948<\/a> putting further restrictions mentioned in <span style=\"font-style: italic;\">Section 66(1)(b).<\/span><\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Employers are barred to make women work <span style=\"font-weight: bold;\">before 6:00 am and after 7:00 pm<\/span> without their \u2018written consent&#8217; for maximum period of <span style=\"font-weight: bold;\">4 hours<\/span>.<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">If a woman agrees in the late night shift, employers are required to fulfil basic amenities like:<\/p>\n<ol style=\"list-style-type: lower-alpha; margin-left: 12.7mm;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Food<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Transportation<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Clean latrines, urinals and washing places<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Drinking facilities<\/p>\n<\/li>\n<\/ol>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Inspector that factory needs to regularly updated about the whereabouts of the women working during night shifts. In case of any inappropriate incident happens, the employer has to report it with the concerned local Police Station.<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Further, these rules aim in protecting the women against any sexual harassments and penalising the offender under <a href=\"http:\/\/www.scconline.com\/DocumentLink\/han6y263\">Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013<\/a>.<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">These rules are effective from <span style=\"font-weight: bold;\">27-05-2022<\/span>, non-compliance of which will make the permissions stand cancelled.<\/p>\n<\/li>\n<\/ul>\n<hr \/>\n<h4><span style=\"color:
