{"id":268890,"date":"2022-06-23T11:00:44","date_gmt":"2022-06-23T05:30:44","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=268890"},"modified":"2022-06-23T10:54:01","modified_gmt":"2022-06-23T05:24:01","slug":"surrogacy-regulation-rules-2022","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/06\/23\/surrogacy-regulation-rules-2022\/","title":{"rendered":"Surrogacy (Regulation) Rules, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page22R_mcid53\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Central Government has notified Surrogacy (Regulation) Rules, 2022 which provides Form and manner for registration and fee for a surrogacy clinic and the requirement, and qualification for persons employed, at a registered surrogacy clinic.<br \/>\n<\/span><\/span><\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000080;\">Key points:<\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page26R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Surrogacy clinics shall have at least one gynaecologist, one anesthetist, <\/span><span dir=\"ltr\" role=\"presentation\">one embryologist and one counselor. The clinic may employ additional staff by the Assisted <\/span><span dir=\"ltr\" role=\"presentation\">Reproductive Technology Level 2 clinics; normally Director, Andrologist and shall appoint such <\/span><span dir=\"ltr\" role=\"presentation\">staff as may be necessary to assist the clinic into day-to-day work.<br \/>\n<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page22R_mcid65\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Manner of application for obtaining a certificate of recommendation by the Board has been <\/span><span dir=\"ltr\" role=\"presentation\">specified in Form 1.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page22R_mcid66\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The intending woman or couple must purchase a general health insurance <\/span><span dir=\"ltr\" role=\"presentation\">coverage in favour of surrogate mother for a period of thirty six months from an insurance company <\/span><span dir=\"ltr\" role=\"presentation\">or an agent recognized by the Insurance Regulatory and Development Authority established under <\/span><span dir=\"ltr\" role=\"presentation\">the provisions of the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Q43JYv8R\">Insurance Regulatory and Development Authority Act, 1999<\/a> for an <\/span><span dir=\"ltr\" role=\"presentation\">amount which is sufficient enough to cover all expenses for all complications arising out of <\/span><span dir=\"ltr\" role=\"presentation\">pregnancy and also covering post- partum delivery complications.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page24R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Number of attempts of any surrogacy procedure on <\/span><span dir=\"ltr\" role=\"presentation\">the surrogate mother shall not be more than three times.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page24R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Consent of a surrogate mother shall be as specified in Form 2<\/span><\/span>.<\/li>\n<li style=\"text-align: justify;\"><span id=\"page24R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Gynaecologist must <\/span><span dir=\"ltr\" role=\"presentation\">transfer one embryo in the uterus of a surrogate mother during a treatment cycle: <\/span><\/span><span id=\"page24R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Provided that only in special circumstances up to three embryos may be transferred.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page24R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Surrogate mother <\/span><span dir=\"ltr\" role=\"presentation\">may be allowed for abortion during the process of surrogacy in accordance with the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/7f6s20ey\">Medical <\/a><\/span><span dir=\"ltr\" role=\"presentation\">Termination of Pregnancy Act, 1971.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page24R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">An application for registration <\/span><span dir=\"ltr\" role=\"presentation\">for a surrogacy clinic<\/span> <span dir=\"ltr\" role=\"presentation\">shall be made by the surrogacy clinic which is carrying out procedures <\/span><span dir=\"ltr\" role=\"presentation\">related to the Surrogacy.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page24R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The appropriate authority shall, after <\/span><span dir=\"ltr\" role=\"presentation\">making such enquiry and after satisfying itself that the applicant has complied with all the <\/span><span dir=\"ltr\" role=\"presentation\">requirements, shall grant a certificate of registration in Form 4 to the
