{"id":268319,"date":"2022-06-13T14:00:41","date_gmt":"2022-06-13T08:30:41","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=268319"},"modified":"2022-06-17T13:11:06","modified_gmt":"2022-06-17T07:41:06","slug":"tis-hazari-territorial-jurisdiction-contract-only-exclusively-district-court-legal-updates-research-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/06\/13\/tis-hazari-territorial-jurisdiction-contract-only-exclusively-district-court-legal-updates-research-news\/","title":{"rendered":"Tis Hazari Court| Contract between parties determines Territorial jurisdiction; Non-mentioning of words \u201conly\u201d or \u201cexclusively\u201d before name of place of jurisdiction immaterial"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Tis Hazari Court, Delhi<\/strong> : Vinod Kumar Gautam, Additional District Judge, while addressing the matter regarding the question of territorial jurisdiction, has held that the territorial jurisdiction in a matter is determined based on the contract entered between the parties.<\/p>\n<p style=\"text-align: justify;\">In the case at hand where the plaintiff had sought decree of mandatory injunction directing the defendant to restore the service of the plaintiff as Deputy General Manager along with back salary and perquisites, the contract was entered between the parties with regard to the Court in Calcutta having jurisdiction to try the subject matter in dispute.<\/p>\n<p style=\"text-align: justify;\">As per the Appointment letter dated 02-07-2018, the service\/employment of the plaintiff was subject to terms and conditions laid down in the aforesaid Appointment letter and the clause 13 of the said Appointment letter categorically vests the jurisdiction in Calcutta Courts to deals with the disputes relating to the employment of the plaintiff.<\/p>\n<p style=\"text-align: justify;\">Although, the plaintiff has argued that the mentioned suit was not barred by territorial jurisdiction as in the clause 13 of the Appointment letter dated 02-07-2018 the words \u2018Calcutta High Court\u2019 was not prefixed by the words \u2018alone\u2019 \u201conly\u201d or \u201cexclusive\u201d. However, the Defendant, relied upon the Supreme Court ruling in <strong>Swastik Gases (P) Ltd. v.
