dir=\"ltr\" role=\"presentation\">The Central Government has notified <span id=\"page9R_mcid32\" class=\"markedContent\">Companies (Removal of Names of Companies from the Register of Companies) Amendment Rules, 2022<\/span><\/span><span dir=\"ltr\" role=\"presentation\"> to amend the Companies (Removal of Names of Companies from the Register of Companies) Rules, 2016 and modify the norms relating to the Application for removal of name of company.<br \/>\n<\/span><\/span><\/p>\n<h4 style=\"text-align: justify;\"><span id=\"page9R_mcid30\" class=\"markedContent\"><\/span><span id=\"page9R_mcid35\" class=\"markedContent\"><span style=\"color: #000080;\">Key points:<\/span> <br role=\"presentation\" \/><\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page9R_mcid35\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In <span id=\"page9R_mcid37\" class=\"markedContent\">rule 4\u00a0 of <\/span>the Companies (Removal of Names of Companies from the Register of Companies) Rules, 2016 <span id=\"page9R_mcid37\" class=\"markedContent\">dealing with <b>Application for removal of name of company<\/b><\/span>,\u00a0<span id=\"page9R_mcid37\" class=\"markedContent\"> the following sub-rule shall be inserted:<\/span><\/span><\/span><span id=\"page9R_mcid37\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page9R_mcid38\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">\u201c(4) (a) Where the Registrar, on examining the application made in Form STK<\/span><span dir=\"ltr\" role=\"presentation\">-2, finds that it is necessary to call <\/span><span dir=\"ltr\" role=\"presentation\">for further information or finds such application or any document annexed therewith is defective or incomplete in <\/span><span dir=\"ltr\" role=\"presentation\">any respect, he shall inform to the applicant to remove the defects and re-submit the complete Form within fifteen <\/span><span dir=\"ltr\" role=\"presentation\">days from the date of such information, failing which the Registrar shall treat the Form as invalid in the electronic <\/span><span dir=\"ltr\" role=\"presentation\">record, and shall inform the applicant, accordingly.<\/span><\/span><span id=\"page9R_mcid39\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(b) After the re-submission of the Form or document, if the Registrar finds that the Form or document is <\/span><span dir=\"ltr\" role=\"presentation\">defective or incomplete in any respect, he shall give further time of fifteen days to remove such defects or <\/span><span dir=\"ltr\" role=\"presentation\">complete the Form, failing which the Registrar shall treat the Form as invalid in the electronic record and shall <\/span><span dir=\"ltr\" role=\"presentation\">inform the applicant, accordingly.<\/span><\/span><span id=\"page9R_mcid40\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(c) Any re-submission of the application in Form STK-2 made prior to the commencement of the Companies <\/span><span dir=\"ltr\" role=\"presentation\">(Removal of Names of Companies from the Register of Companies) Amendment Rules, 2022 shall not be <\/span><span dir=\"ltr\" role=\"presentation\">counted for the purposes of reckoning the maximum number of re-<\/span><span dir=\"ltr\" role=\"presentation\">submissions of such Form.\u201d<\/span><\/span><span
