National Company Law Appellate Tribunal, New Delhi (NCLAT): <\/strong>The Coram of Justice Ashok Bhushan (Chairperson) and Shreesha Merla (Technical Member), held that the implementation of the Jet Airways Resolution Plan will be subject to the outcome of appeals filed against the order of National Company Law Tribunal which approved the resolution plan for Jet Airways.<\/p>\n

Mr Balbir Singh, ASG appearing for the applicant referred to the order of the Supreme Court dated 15-9-2021 in Civil Appeal No. 3290 of 2017 in the matter of Commissioner of Income Tax v. Jet Airways India Ltd., <\/em>and Order dated 16-11-2021.<\/p>\n

In view of the above-said orders passed by the Supreme Court, Tribunal permitted the applicant to intervene in the present appeal.<\/p>\n

Present appeals were filed against the order dated 22-6-2021 passed by the Adjudicating Authority approving the Resolution Plan.<\/p>\n

The effective date had been fixed as 28-5-2022 and the process of the implementation of the plan has begun.<\/p>\n

Further, the appellant\u2019s counsel expressed their apprehension that in the event their claim was allowed, and the plan was implemented, their claim may not be met by the Successful Resolution Applicant.<\/p>\n

Tribunal fixed the appeals on 05th July, 2022 and made it clear that the implementation resolution plan shall abide by the result of the appeals filed.<\/p>\n

Lastly, the Senior Advocate, Krishnendu Datta submitted that the Successful Resolution Applicant shall withhold the \u2018BKC\u2019 Property, which is a valuable property and till the next date, shall not take any steps for alienation of the said property.<\/p>\n
