This handbook is an attempt at facilitating access to information regarding the steps taken so far to remove the obstacles faced by persons with disabilities, information regarding benefits available to them and suggestions on what more needs to be done to remove the obstacles to leading a life of dignity.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">This handbook is our endeavour to bridge the gap between disability and accessibility. Over the several chapters of this handbook, we have endeavoured to highlight the many legislative and policy- level attempts to promote the empowerment of persons with disabilities \u2013 through education, employment, health and safety to name a few. Each of these chapters has been crafted to make this handbook a ready reference for practical purposes.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">\n<h2 style=\"text-align: center;\">Legal Framework<\/h2>\n<h3 style=\"text-align: center;\"><a name=\"_Toc89247843\"><\/a><a name=\"_Toc89474511\"><\/a>(A)MENTAL HEALTHCARE ACT, 2017<\/h3>\n<p style=\"text-align: justify;\">The MH Act is the primary legislation dealing with rights of persons with mental illnesses. Mental illness is defined as a substantial disorder of thinking, mood, perception, orientation, or memory that grossly impairs judgment or the ability to meet the ordinary demands of life, mental conditions associated with the abuse of alcohol and drugs. The MH Act aims to provide mental healthcare and services for persons with mental illness and to promote and fulfil the rights of such persons during delivery of mental healthcare and services.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">The MH Act distinguishes \u2018mental retardation\u2019 and mental illness, as described in greater detail in Chapter 3, and does not regard \u2018mental retardation\u2019 as a \u2018mental illness\u2019. Various Indian laws bar persons with unsound minds to enter into contracts or undertake certain acts in general, such marrying, voting or holding public office and making wills \u2013 the MH Act, however, takes a contrary view on this issue. This is a welcome step in the right direction because, simply put, a person with mental illness cannot be said to have an unsound mind unless a court declares so. There is a certain stigma to the notion of being categorised as a person with an unsound mind, thereby thwarting mental healthcare as persons with mental illness would prefer to go untreated over being tagged as a\u00a0person with an unsound mind.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><strong>Authorities under<\/strong><strong> the MH Act<\/strong><\/h3>\n<p style=\"text-align: justify;\">The MH Act is patient-centric legislation, i.e., it recognises the need for healthcare for persons with mental illness as the primary object. To this extent, the MH Act has established the Central Mental Health Authority and State Mental Health Authority to oversee the implementation of the MH Act in tandem with the spirit of the law. These authorities typically regulate mental health establishments to ensure the quality of these establishments&#8217; services. A mental health establishment, clinical psychologists, mental health nurses and psychiatric social workers register with these authorities. The MH Act has also set up a Mental Health Board, which shall serve as an adjudicating authority.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><strong>Other Protections: Duties of the Government<\/strong><\/h3>\n<p style=\"text-align: justify;\">The governments have specific duties to undertake under the MH Act. These include promotion of mental health and preventive programmes, creating awareness about mental health and illness and reducing the stigma associated with mental illness, human resource development and training, and co-ordinating amongst the various arms of the government such as ministries and departments including those dealing with health, law, home affairs, human resources, social justice, employment, education, women and child development, medical education to address issues of mental health care.<\/p>\n<p>&nbsp;<\/p>\n<h3 style=\"text-align: center;\"><strong>Offences under the MH Act: Penalties &amp; Punishments<\/strong><\/h3>\n<p style=\"text-align: justify;\">To ensure enforcement of the MH Act, the MH Act provides for penalty and punitive actions:<\/p>\n<ul style=\"text-align: justify;\">\n<li>In case of contravention of provisions of the MH Act by a mental health establishment, the penalty varies from the bracket of INR 5,000 to INR 50,000 for a first time contravention to INR 50,000 to INR 2,00,000 for second time contravention to INR 2,00,000 to INR 5,00,000 for subsequent contravention(s).<\/li>\n<li>For non-registration with the authority, the penalty may extend up to INR 25,000.<\/li>\n<li>In case of contravention of provisions of the PWD Act or rules or regulations made thereunder, a person would be punishable with imprisonment up to 6 months, or fine up to INR 10,000, or both, for imprisonment up to 2 years, or a fine of INR 50,000 or INR 5,00,000, or both.<\/li>\n<li>In case the offence under the MH Act is committed by a company, every person in-charge and responsible for the conduct of the business of such company, shall be proceed against under the MH Act.<\/li>\n<\/ul>\n<h2 style=\"text-align: center;\">MENTAL HEALTH<\/h2>\n<table style=\"height: 2952px;\" width=\"841\">\n<thead>\n<tr>\n<td colspan=\"2\" width=\"183\"><strong>Question<\/strong><\/td>\n<td width=\"418\"><strong>Answer<\/strong><\/td>\n<\/tr>\n<\/thead>\n<tbody>\n<tr>\n<td width=\"43\">1.<\/td>\n<td width=\"140\">What are the rights of persons with mental illness under the MH Act?<\/td>\n<td width=\"418\">The MH Act has statutorily recognised following rights for persons with mental illness:<\/p>\n<p>\u00a7\u00a0 Right to access mental health care;<\/p>\n<p>\u00a7\u00a0 Right to community living;<\/p>\n<p>\u00a7\u00a0 Right to protection from cruel, inhuman and degrading treatment;<\/p>\n<p>\u00a7\u00a0 Right to equality and non- discrimination;<\/p>\n<p>\u00a7\u00a0 Right to information;<\/p>\n<p>\u00a7\u00a0 Right to confidentiality;<\/p>\n<p>\u00a7\u00a0 Restriction on release of information in respect of mental illness;<\/p>\n<p>\u00a7\u00a0 Right to access medical records;<\/p>\n<p>\u00a7\u00a0 Right to personal contacts and communication;<\/p>\n<p>\u00a7\u00a0 Right to legal aid;<\/p>\n<p>\u00a7\u00a0 Right to make complaints about deficiencies in provision of services<\/p>\n<p>\u00a7\u00a0 Right to make an advance directive;<\/p>\n<p>\u00a7\u00a0 Right not to be treated under prohibited treatment.<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">2.<\/td>\n<td width=\"140\">What does right to access to healthcare entail?<\/td>\n<td width=\"418\">Right to access healthcare means ability of a person with mental illness to be able to access and avail mental health services affordable cost, of good quality, available in sufficient quantity, accessible geographically, without discrimination on the basis of gender, sex, sexual orientation, religion, culture, caste, social or political beliefs, class, disability or any other basis and provided in a manner that is acceptable to persons with mental illness and their families and care-givers.<\/p>\n<p>Persons with mental illness living below the poverty line or persons with mental illness who are homeless or destitute shall have the right to avail the mental health care services and facilities free of cost and no financial cost, whatsoever, in government-run or government funded establishments.<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">3.<\/td>\n<td width=\"140\">What are prohibited procedures?<\/td>\n<td width=\"418\">The following are prohibited procedures:<\/p>\n<p>\u00a7\u00a0 electroconvulsive therapy is prohibited for children, and even otherwise performance of electroconvulsive therapy is prohibited without administration of precautions such as using muscle relaxants and anesthesia;<\/p>\n<p>\u00a7\u00a0 sterilisation of men or women, when such sterilisation is intended as a treatment for mental illness;<\/p>\n<p>\u00a7\u00a0 chained in any manner or form whatever.<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">4.<\/td>\n<td width=\"140\">Is mental illness the same as mental retardation?<\/td>\n<td width=\"418\">No.<\/p>\n<p>The MH Act draws a distinction between mental illness and mental retardation and does not regard mental retardation as mental illness.<\/p>\n<p>Mental illness is defined as a substantial disorder of thinking, mood, perception, orientation, or memory that grossly impairs judgment or the ability to meet the ordinary demands of life, mental conditions associated with the abuse of alcohol and drugs.<\/p>\n<p>Mental retardation, on the other hand, is defined to be a condition of arrested or incomplete development of mind of a person, specially characterised by sub-normality of intelligence.<\/p>\n<p>The MH Act categorically states that determination of a person\u2019s mental illness shall not imply or be taken to mean that such person is of unsound mind, unless a competent court has declared such person to be of unsound mind. It also recognises their right to make mental healthcare and treatment decisions. The key element enabling persons with mental illness to make such decisions is \u2018mental capacity\u2019. As per the MH Act, this key element is present in persons with mental illness which allows them to take decisions and they are considered as not being incapacitated in any form and manner. Mental capacity is defined as a person\u2019s ability to understand, retain, and weigh up information relevant to a decision to arrive at a choice, and then to communicate that choice.<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">5.<\/td>\n<td width=\"140\">What are the key elements of the MH Act?<\/td>\n<td width=\"418\">The ability to pass advanced directive and nominate representatives is one of the most noble provisions under the MH Act, which recognises the autonomy of the persons with mental illness.<\/p>\n<p>\u00a7\u00a0 Advanced directive empowers a person with mental illnesses to make a written statement on the kind of treatment for the mental illness. It may be both a positive directive stating the way the person wishes to be cared for and treated for a mental illness, as well as negative directive stating the way the person wishes not to be cared for and treated for a mental illness. Such directive shall be vetted by a medical practitioner.<\/p>\n<p>\u00a7\u00a0 Under the MH Act, every person with mental illness can nominate a representative who is tasked with the primary duty of taking decisions which are in the best interests of such person. Such representative has the right to assert rights of the person with mental illness and among others seek information on diagnosis and treatment to provide adequate support to the person with mental illness, give or withhold consent on behalf of the person with mental illness, etc.<\/td>\n<\/tr>\n<tr>\n<td width=\"43\">6.<\/td>\n<td width=\"140\">What are the provisions relating to attempt to suicide by persons with mental illness under the MH Act?<\/td>\n<td width=\"418\">The MH Act has decriminalised the attempt to suicide by person with mental illness, which is a criminal act under the IPC. Further, a duty is imposed on the government to rehabilitate such persons with mental illness who has attempted suicide to ensure that there is no recurrence of attempt to suicide. The MH Act also outlines the procedure and process for admission, treatment, and subsequent discharge of mentally ill persons.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>&nbsp;<\/p>\n<p>Refer to the <a
