{"id":267326,"date":"2022-05-24T11:30:22","date_gmt":"2022-05-24T06:00:22","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=267326"},"modified":"2022-05-24T11:27:16","modified_gmt":"2022-05-24T05:57:16","slug":"moefc-notifies-draft-e-waste-management-rules","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/05\/24\/moefc-notifies-draft-e-waste-management-rules\/","title":{"rendered":"MoEFC notifies Draft E-Waste (Management) Rules"},"content":{"rendered":"<p style=\"text-align: justify;\">On May 19, 2022, the Ministry of Environment, Forest and Climate Change has published the E-Waste (Management) Draft Rules which shall apply to every <span id=\"page44R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Manufacturer, <\/span><\/span><span id=\"page46R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Producer<\/span><\/span><span id=\"page46R_mcid1\" class=\"markedContent\">, <span dir=\"ltr\" role=\"presentation\">Recycler<\/span><\/span><span id=\"page46R_mcid2\" class=\"markedContent\">, <span dir=\"ltr\" role=\"presentation\">Refurbisher.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n<h4 style=\"text-align: justify;\">Key points:<\/h4>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page46R_mcid11\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In case, any registered entity furnishes false information or willfully conceals information <\/span><span dir=\"ltr\" role=\"presentation\">for getting registration or return \/report\/information required to be provided\/furnished <\/span><span dir=\"ltr\" role=\"presentation\">under this regulation or in case of any irregularity, the registration of such entity may be <\/span><span dir=\"ltr\" role=\"presentation\">revoked by CPCB for a period up to three-years after giving an opportunity to be heard. In <\/span><span dir=\"ltr\" role=\"presentation\">addition, environmental compensation charges may also be levied as<\/span> <span dir=\"ltr\" role=\"presentation\">per rule 28<\/span> <span dir=\"ltr\" role=\"presentation\">in such <\/span><span dir=\"ltr\" role=\"presentation\">cases.<\/span><\/span><span id=\"page46R_mcid12\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<li><span id=\"page46R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In case any entity is manufacturer as well producer then the entity shall register under <\/span><span dir=\"ltr\" role=\"presentation\">those categories separately.<\/span><\/span><\/li>\n<li><span id=\"page46R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The<\/span> <span dir=\"ltr\" role=\"presentation\">CPCB<\/span> <span dir=\"ltr\" role=\"presentation\">may<\/span> <span dir=\"ltr\" role=\"presentation\">charge<\/span> <span dir=\"ltr\" role=\"presentation\">registration<\/span> <span dir=\"ltr\" role=\"presentation\">fee<\/span> <span dir=\"ltr\" role=\"presentation\">and<\/span> <span dir=\"ltr\" role=\"presentation\">annual<\/span> <span dir=\"ltr\" role=\"presentation\">maintenance<\/span> <span dir=\"ltr\" role=\"presentation\">charges<\/span> <span dir=\"ltr\" role=\"presentation\">from<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">applicants based on capacity of e-waste generated\/recycled\/handled by them @ decided by <\/span><span dir=\"ltr\" role=\"presentation\">CPCB with the approval of the steering committee.<\/span><\/span><\/li>\n<li><strong><span id=\"page46R_mcid17\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Responsibilities of the manufacturer:<\/span><\/span><\/strong><span id=\"page46R_mcid18\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"text-align: justify;\"><span id=\"page46R_mcid18\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">all manufacturer shall have to register on online portal created for the purpose;<\/span><\/span><span id=\"page46R_mcid19\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page46R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">collect e-waste generated during the manufacture of any electrical and electronic equipment <\/span><span dir=\"ltr\" role=\"presentation\">and ensure its recycling or disposal;<\/span><\/span><span id=\"page46R_mcid20\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page46R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">file annual and quarterly returns in the prescribed Form on the portal of Central Pollution <\/span><span dir=\"ltr\" role=\"presentation\">Control Board on or before end of the month succeeding the quarter\/year to which the <\/span><span dir=\"ltr\" role=\"presentation\">return relates.<\/span><\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page46R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>Responsibilities of the producer<\/strong>: <\/span><span dir=\"ltr\" role=\"presentation\">The producer of electrical and electronic equipment listed <\/span><span dir=\"ltr\" role=\"presentation\">in Schedule I shall be responsible for &#8211;<\/span><\/span><span id=\"page46R_mcid22\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<\/ul>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"text-align: justify;\"><span id=\"page46R_mcid22\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">registration on the online portal created for the purpose;<\/span><\/span><span id=\"page46R_mcid23\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page46R_mcid23\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">shall<\/span> <span dir=\"ltr\" role=\"presentation\">obtain and implement<\/span> <span dir=\"ltr\" role=\"presentation\">Extended<\/span> <span dir=\"ltr\" role=\"presentation\">Producers<\/span> <span dir=\"ltr\" role=\"presentation\">Responsibility (EPR)<\/span> <span dir=\"ltr\" role=\"presentation\">target as<\/span> <span dir=\"ltr\" role=\"presentation\">per <\/span><span dir=\"ltr\" role=\"presentation\">Schedule III<\/span> <span dir=\"ltr\" role=\"presentation\">through online portal of the Central Pollution Control Board (CPCB);<\/span><\/span><span id=\"page46R_mcid24\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided<\/span> <span dir=\"ltr\" role=\"presentation\">that<\/span> <span dir=\"ltr\" role=\"presentation\">producer<\/span> <span dir=\"ltr\" role=\"presentation\">having<\/span> <span dir=\"ltr\" role=\"presentation\">EPR<\/span> <span dir=\"ltr\" role=\"presentation\">Plan<\/span> <span dir=\"ltr\" role=\"presentation\">under<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">provisions<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">E-Waste <\/span><span dir=\"ltr\" role=\"presentation\">(Management) Rules, 2016 prior to the date of coming into force of these rules shall <\/span><span dir=\"ltr\" role=\"presentation\">migrate under these rules as per the procedure laid down by CPCB with approval of <\/span><span dir=\"ltr\" role=\"presentation\">Steering Committee.<\/span><\/span><span id=\"page46R_mcid25\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page46R_mcid25\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Creating awareness through media, publications, advertisements, posters, or by any other <span id=\"page48R_mcid0\" class=\"markedContent\">means of communication.<\/span><\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page46R_mcid25\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page48R_mcid1\" class=\"markedContent\">File annual and quarterly returns in the prescribed Form on the portal on or before end of the month succeeding the quarter\/year to which the return relates. <\/span><br \/>\n<\/span><\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page48R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>Responsibilities of the refurbisher<\/strong>:<\/span><\/span><span id=\"page48R_mcid3\" class=\"markedContent\"><\/span><\/li>\n<\/ul>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"text-align: justify;\"><span id=\"page48R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">All refurbisher shall have to register on online portal created for the purpose;<\/span><\/span><span id=\"page48R_mcid4\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page48R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">collect e-waste generated during the process of refurbishing and hand over the waste to <\/span><span dir=\"ltr\" role=\"presentation\">registered recycler and upload information on the portal;<\/span><\/span><span id=\"page48R_mcid5\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page48R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">ensure that the refurbished equipment shall be as per Compulsory Registration Scheme <\/span><span dir=\"ltr\" role=\"presentation\">(CRS) of MeitY\/BIS, devised for this purpose.<\/span><\/span><span id=\"page48R_mcid6\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page48R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">file annual and quarterly returns in the prescribed Form on the portal on or before end of <\/span><span dir=\"ltr\" role=\"presentation\">the month succeeding the quarter\/year to which the return
