(Rights of Consumers) Amendment Rules, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\">On April 20, 2022, the Ministry of Power has issued the Electricity (Rights of Consumers) Amendment Rules, 2022 to amend Electricity (Rights of Consumers) Rules, 2020.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong>Key amendment:<br \/>\n<\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\">Following new definitions have been inserted:<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\">(fa) \u201ccustomer average interruption duration index\u201d means the average interruption duration of the sustained interruptions for those who experienced interruptions during the reporting period, as specified by the State Commission.\u201d<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page6R_mcid9\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(fb)<\/span> <span dir=\"ltr\" role=\"presentation\">\u201ccustomer<\/span> <span dir=\"ltr\" role=\"presentation\">average<\/span> <span dir=\"ltr\" role=\"presentation\">interruption<\/span> <span dir=\"ltr\" role=\"presentation\">frequency<\/span> <span dir=\"ltr\" role=\"presentation\">index\u201d<\/span><span dir=\"ltr\" role=\"presentation\">means<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">average <\/span><span dir=\"ltr\" role=\"presentation\">interruption frequency of the sustained interruptions for those who experienced interruptions <\/span><span dir=\"ltr\" role=\"presentation\">during the reporting period, as specified by the State Commission.\u201d<\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">(ja) \u201cMomentary average frequency interruption frequency index\u201d means the average number of momentary interruptions per consumer occurring during the reporting period, as specified by the State Commission.\u201d<\/p>\n<p style=\"padding-left: 40px;\"><span id=\"page6R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(ma)<\/span> <span dir=\"ltr\" role=\"presentation\">\u201c<\/span><span dir=\"ltr\" role=\"presentation\">system average interruption duration index<\/span><span dir=\"ltr\" role=\"presentation\">\u201d<\/span><span dir=\"ltr\" role=\"presentation\">means the average duration of the <\/span><span dir=\"ltr\" role=\"presentation\">sustained interruptions per Consumer occurring during the reporting period, as specified by <\/span><span dir=\"ltr\" role=\"presentation\">the State Commission\u201d;<\/span><\/span><\/p>\n<p style=\"padding-left: 40px;\"><span id=\"page6R_mcid14\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(mb)<\/span> <span dir=\"ltr\" role=\"presentation\">\u201csystem average interruption frequency index\u201d<\/span> <span dir=\"ltr\" role=\"presentation\">means the average frequency of the <\/span><span dir=\"ltr\" role=\"presentation\">sustained interruptions per Consumer occurring during the reporting period, as specified by <\/span><span dir=\"ltr\" role=\"presentation\">the State Commission\u201d;<\/span><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\">Rule 10 which specify \u201cCompensation mechanism\u201d has the following sub-rules inserted namely: &#8211;<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page6R_mcid17\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u201c(3) In view of the increasing pollution level particu<\/span><span dir=\"ltr\" role=\"presentation\">larly in the metros and the cities with a <\/span><span dir=\"ltr\" role=\"presentation\">population 100,000 and above, the distribution licensee shall ensure 24&#215;7 uninterrupted power <\/span><span dir=\"ltr\" role=\"presentation\">supply to all the consumers, so that there is no requirement of running the diesel generator sets and <\/span><span dir=\"ltr\" role=\"presentation\">accordingly, the State Commission shall give trajectory of system average interruption frequency <\/span><span dir=\"ltr\" role=\"presentation\">index and system average interruption duration index for such cities.<\/span><\/span><span id=\"page6R_mcid18\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page6R_mcid18\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(4) The State Commission may consider the customer average interruption duration index, <\/span><span dir=\"ltr\" role=\"presentation\">customer average interruption frequency index and momentary average interruption frequency <\/span><span dir=\"ltr\" role=\"presentation\">index as additional indicators of reliability of supply and the minimum interruption time for <\/span><span dir=\"ltr\" role=\"presentation\">calculation of additional reliability indicators shall be as specified by the State Commission and in <\/span><span dir=\"ltr\" role=\"presentation\">case the interruption time is not specified by the State Commission, three minutes shall be <\/span><span dir=\"ltr\" role=\"presentation\">considered as interruption time for calculating the additional reliability indicators.<\/span><\/span><span id=\"page6R_mcid19\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page6R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(5) The State Commission shall have an online mechanism for reviewing and monitoring of <\/span><span dir=\"ltr\" role=\"presentation\">reliability indices of distribution licensees and such Commission may consider a separate reliability <\/span><span dir=\"ltr\" role=\"presentation\">charge for the distribution company, if they require funds for investment in the infrastructure for <\/span><span dir=\"ltr\" role=\"presentation\">ensuring the reliability of supply to the consumers.<\/span><\/span><span id=\"page6R_mcid20\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page6R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(6) The consumers, who are using the diesel generator sets as essential back up power, shall <\/span><span dir=\"ltr\" role=\"presentation\">endeavor to shift to cleaner technology such as renewable energy with battery storage and the like <span id=\"page15R_mcid0\" class=\"markedContent\">in five years from the date of commencement of these rules or as per the timelines given by the State Commission for such replacement based on the reliability of supply in thatcity covered under area of supply of the distribution licensee.<\/span><span id=\"page15R_mcid1\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page6R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page15R_mcid1\" class=\"markedContent\">(7) The process of giving temporary connections to the consumers for construction activities or any temporary usage and the like shall be simplified by the distribution licensee and given on an urgent basis and not later than forty eight hoursand within seven days in case augmentation of the distribution system is required and this shall avoid any use of diesel generator sets for temporary activities in the area of the distribution licensee.<\/span><span id=\"page15R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page6R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page15R_mcid2\" class=\"markedContent\">(8) The temporary connection shall be through a prepayment meter or through consumer meters as defined in the Central Electricity Authority (Installation and Operation of Meters) Regulations as amended from time to time\u201d.<\/span><br \/>\n<\/span><\/span><\/p>\n<p
