{"id":265756,"date":"2022-04-22T15:00:00","date_gmt":"2022-04-22T09:30:00","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=265756"},"modified":"2022-04-28T16:45:40","modified_gmt":"2022-04-28T11:15:40","slug":"hindu-family-property-gift-deed-pious-purpose-love-affection-supreme-court-judgment-legal-law-research-news-updates","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/04\/22\/hindu-family-property-gift-deed-pious-purpose-love-affection-supreme-court-judgment-legal-law-research-news-updates\/","title":{"rendered":"Explained| Does alienating ancestral property \u2018out of love and affection\u2019 come within the scope of the term \u2018pious purpose\u2019?\u00a0"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: In a case where a portion of a joint Hindu Family was alienated \u2018out of love and affection\u2019 by way of a gift deed, the bench of <strong>SA Nazeer<\/strong>* and Krishna Murari, JJ has explained the scope of powers of members of Joint Hindu Family and has held that a Hindu father or any other managing member of a HUF has power to make a gift of ancestral property only for a \u2018pious purpose\u2019.<\/p>\n<p style=\"text-align: justify;\">In the case at hand, a gift deed was executed by the Karta of a Joint Hindi Family in favour of the appellant, who was raised by the Karta, \u2018out of love and affection\u2019 and by virtue of which the appellant was given a portion of the joint family property.<\/p>\n<p style=\"text-align: justify;\">The Court, however, held that a Hindu father or any other managing member of a HUF has power to make a gift of ancestral property only for a \u2018pious purpose\u2019 and what is understood by the term \u2018pious purpose\u2019 is a gift for charitable and\/or religious purpose. Therefore, a deed of gift in regard to the ancestral property executed \u2018out of love and affection\u2019 does not come within the scope of the term \u2018pious purpose\u2019.<\/p>\n<p style=\"text-align: justify;\">Observing that it is irrelevant if such gift or settlement was made by a donor in favour of a donee who was raised by the donor without any relationship, the Court held that the gift deed in the instant case was not for any charitable or religious purpose.<\/p>\n<p style=\"text-align: justify;\">[KC Laxmana v.
