Procedure (Identification) Bill, 2022 receives President&#8217;s assent"},"content":{"rendered":"<p style=\"text-align: justify;\">On April 18, 2022, the Criminal Procedure (Identification) Bill, 2022 has received President&#8217;s assent in order <span dir=\"ltr\" role=\"presentation\">to authorise the law enforcement agencies for taking measurements of convicts and other persons for <\/span><span dir=\"ltr\" role=\"presentation\">the purposes of identification and investigation in criminal matters and to <\/span><span dir=\"ltr\" role=\"presentation\">preserve records. <\/span><span dir=\"ltr\" role=\"presentation\">It shall come into force on such date as the Central Government may, by notification <\/span><span dir=\"ltr\" role=\"presentation\">in the Official Gazette, appoint.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h4>Key points:<\/h4>\n<ul>\n<li><span dir=\"ltr\" role=\"presentation\">Any person in the following cases shall allow his measurement to be taken by a police officer or a prison officer in such manner as may be prescribed by the Central Government or the State Government, <\/span><\/li>\n<\/ul>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li><span dir=\"ltr\" role=\"presentation\">convicted of an offence punishable under any law for the time being in force; or<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">ordered to give security for his good behaviour or maintaining peace under <\/span><span dir=\"ltr\" role=\"presentation\">section 117 of the Code of Criminal Procedure, 1973 for a proceeding under section 107 <\/span><span dir=\"ltr\" role=\"presentation\">or section 108 or section 109 or section 110 of the said Code;<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">arrested in connection with an offence punishable under any law for the time <\/span><span dir=\"ltr\" role=\"presentation\">being in force or detained under any preventive detention law,<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"padding-left: 80px; text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">Provided that any person arrested for an offence committed under any law for the time <\/span><span dir=\"ltr\" role=\"presentation\">being in force (except for an offence committed against a woman or a child or for any offence <\/span><span dir=\"ltr\" role=\"presentation\">punishable with imprisonment for a period not less than seven years) may not be obliged to <\/span><span dir=\"ltr\" role=\"presentation\">allow taking of his biological samples under the provisions of this section.<\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">The National Crime Records Bureau shall, in the interest of prevention, detection, <\/span><span dir=\"ltr\" role=\"presentation\">investigation and prosecution of any offence under any law for the time being in <\/span><span dir=\"ltr\" role=\"presentation\">force <\/span><span dir=\"ltr\" role=\"presentation\">collect the record of measurements from State Government or Union territory <\/span><span dir=\"ltr\" role=\"presentation\">Administration or any other law enforcement agencies;<\/span> <span dir=\"ltr\" role=\"presentation\">store, preserve and destroy the record of measurements at national level;<\/span> <span dir=\"ltr\" role=\"presentation\">process such record with relevant crime and criminal records; and<\/span> <span dir=\"ltr\" role=\"presentation\">share and disseminate such records with any law enforcement agency, <\/span><span dir=\"ltr\" role=\"presentation\">in such manner as may be prescribed.<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">The record of measurements shall be retained in digital or electronic form for a <\/span><span dir=\"ltr\" role=\"presentation\">period of seventy-five years from the date of collection of such measurement.<\/span><br role=\"presentation\" \/><span
