This shall come into force on October 1, 2022.<\/p>\n<h4 style=\"text-align: justify;\"><\/h4>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000080;\">Key points:<\/span><\/h4>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\">Date of enforcement of <span id=\"page5R_mcid96\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Legal<\/span> <span dir=\"ltr\" role=\"presentation\">Metrology<\/span> <span dir=\"ltr\" role=\"presentation\">(Packaged <\/span><span dir=\"ltr\" role=\"presentation\">Commodities) Amendment Rules, 2021<\/span><\/span> has been substituted from the date &#8216;1st day of April, 2021\u00a0 with\u00a0 &#8216;1st Day of October, 2022&#8217;.<\/li>\n<li style=\"text-align: justify;\">In Rule 6 which specify \u201cDeclarations to be made on every package\u201d sub-rule (11) has been substituted namely: &#8211;<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\">\u201cThe unit sale price in rupees, rounded off to the nearest two decimal place, shall be declared on every pre-packaged commodity\u201d in the following manner:<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page1R_mcid149\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(i)<\/span> <span dir=\"ltr\" role=\"presentation\">per gram where net quantity is less than one kilogram and per kilogram where net quantity is <\/span><span dir=\"ltr\" role=\"presentation\">more than one kilogram;<\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page1R_mcid150\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(ii) per centimeter where net length is less than one metre and per metre where net length is more <\/span><span dir=\"ltr\" role=\"presentation\">than one metre;<\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page5R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(iii) per mililitre where net volume is less than one litre and per litre where net volume is more than <\/span><span dir=\"ltr\" role=\"presentation\">one litre;<\/span><\/span><span id=\"page5R_mcid1\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(iv)<\/span> <span dir=\"ltr\" role=\"presentation\">per number or unit if any item is sold by number or unit:<\/span><\/span><span id=\"page5R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided that for packages containing alcoholic beverages or spirituous liquor, the State Excise <\/span><span dir=\"ltr\" role=\"presentation\">Laws and the rules made thereunder shall be applicable within the State in which it is manufactured.<\/span><\/span><span id=\"page5R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided further that declaration of unit sale price is not required for the pre-packaged <\/span><span dir=\"ltr\" role=\"presentation\">commodities in which retail sale price is equal to the unit sale price.<\/span><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\">Rule 33 which specify \u201cPower to relax\u201d sub-rule (2) has been omitted.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\">Notwithstanding such repeal anything done or any action taken or purported to have been done or taken including approval of letter, exemption granted, fees collected, any adjudication, enquiry or investigation commenced, license and registration of manufacturers, dealers, importers of pre-packaged commodities, or show cause notice, decision, determination, approval, authorisation issued, given or done under the said rules shall if in force at the commencement of the said rules continue to be in force and have effect as if issued, given or done under the corresponding provisions of these rules.<\/p>\n<ul>\n<li style=\"text-align: justify;\">The Second Schedule which specify \u201cCommodities to be packed in specified quantities\u201d has been omitted.<\/li>\n<li style=\"text-align: justify;\"><span id=\"page5R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">No prosecution shall be initiated against the manufacturer or packer or importer of pre packaged <\/span><span dir=\"ltr\" role=\"presentation\">commodities for making declaration with effect from the 1<\/span><span dir=\"ltr\" role=\"presentation\">st<\/span> <span dir=\"ltr\" role=\"presentation\">April, 2022 in accordance with Legal <\/span><span dir=\"ltr\" role=\"presentation\">Metrology<\/span> <span dir=\"ltr\" role=\"presentation\">(Packaged<\/span> <span dir=\"ltr\" role=\"presentation\">Commodities)<\/span> <span dir=\"ltr\" role=\"presentation\">Rules,<\/span> <span dir=\"ltr\" role=\"presentation\">2011,<\/span> <span dir=\"ltr\" role=\"presentation\">as<\/span> <span dir=\"ltr\" role=\"presentation\">amended<\/span> <span dir=\"ltr\" role=\"presentation\">by<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">Legal<\/span> <span dir=\"ltr\" role=\"presentation\">Metrology<\/span> <span dir=\"ltr\" role=\"presentation\">(Packaged <\/span><span dir=\"ltr\" role=\"presentation\">Commodities) Amendment Rules, 2021.\u00a0
