{"id":264656,"date":"2022-03-29T10:30:07","date_gmt":"2022-03-29T05:00:07","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=264656"},"modified":"2022-03-29T09:54:22","modified_gmt":"2022-03-29T04:24:22","slug":"consumer-courts-in-gujarat-adopt-mediation-mechanism-vide-gujarat-consumer-protection-mediation-rules-2022","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/03\/29\/consumer-courts-in-gujarat-adopt-mediation-mechanism-vide-gujarat-consumer-protection-mediation-rules-2022\/","title":{"rendered":"Consumer Courts in Gujarat adopt \u2018Mediation\u2019 mechanism vide Gujarat Consumer Protection (Mediation) Rules, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\">On 21<sup>st<\/sup> March, 2022, Food, Civil Supplies and Consumer Affairs Department of Gujarat notified <strong>Gujarat Consumer Protection (Mediation) Rules, 2022<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Under Chapter 5 of <strong>Consumer Protection Act, 2019 (Act), <\/strong>states Mediation, which is a step to enhance the already existing Redressal system under Consumer Laws.<\/p>\n<p style=\"text-align: justify;\">Mediation laws involve the process wherein third person\/party intends to interfere between contending parties with the aim to \u2018settle\u2019 their disputes. Recommendations made by third party\/person \u2018Mediator\u2019 are suggestive in nature.<\/p>\n<p style=\"text-align: justify;\">In case where no agreement is reached, the reasons stating so must be accordingly sent to the Commission.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong><u>Mediation Cell:<\/u><\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>Gujarat Government has established Mediation cell under <strong>Section 74 <\/strong>of the <strong>Act<\/strong> that will be connecting each District and State Commissions of Gujarat.<\/li>\n<li>\u2018<u>Mediation Cell<\/u>\u2019 will ensure that the <strong>Mediators<\/strong> provide, from time to time, timely and effective means to resolve the disputes of consumers.<\/li>\n<li>By <strong>Rule 3<\/strong>, \u2018<u>Mediation Cell<\/u>\u2019 will have panel of mediators elected by Commission to help parties reach to a mutually acceptable resolution of dispute.<\/li>\n<li>This settlement, <strong>Rule 2 (e)<\/strong>, is concluded by the course of proceedings which resolves the issues involved in any dispute pending before the Consumer Court.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong><u>Empanelment of Mediators:<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">Under <strong>Section 75<\/strong> of <strong>Act<\/strong>, a panel of mediators are formed by Mediation Cell. This panel is created by selection committee headed by President.<\/p>\n<p style=\"text-align: justify;\">The qualifications and eligibility is stated by <strong>Rule 4<\/strong>, includes retired District\/ Sessions judges, Members of Consumer Commission, retired judicial officers, and others.<\/p>\n<p style=\"text-align: justify;\">A member is disqualified as a mediator when-<\/p>\n<ol style=\"text-align: justify;\">\n<li>he is adjudged as insolvent<\/li>\n<li>criminal charges are levied on the person based on moral turpitude<\/li>\n<li>he is convicted by any criminal court<\/li>\n<li>disciplinary proceedings are being carried on against that person<\/li>\n<li>any person in his professional capacity is found to have committed or has been associated with any dispute in respect to consumer disputes<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong><u>Re-empanelment of mediators:<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">When person is found, in any case by the Mediation Cell, has conducted his duties efficiently and is qualified to be re appointed as a member of the panel by the Selection Committee.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong><u>Mediation Proceedings:<\/u><\/strong><\/p>\n<ul style=\"text-align: justify;\">\n<li>After the convening of the Mediation, the mediator under <strong>Rule 12<\/strong>, has to ensure to initiate the Mediation proceedings, in the presence of parties\/legal representatives to the issue in disputed matter.<\/li>\n<li>The mediator shall be guided by the principles of natural justice and<br \/>\nfair play but shall not be bound by the provisions of the Code of Civil<br \/>\nProcedure, 1908 (5 of 1908) or the Indian Evidence Act, 1872 (l of<br \/>\n1872).<\/li>\n<li>The parties shall provide all such information to the mediator as may<br \/>\nbe reasonably required by him for conducting the mediation<\/li>\n<li>Mediator records the proceeding and attaches signature of parties\/legal counsel of the parties under it.<\/li>\n<li>With the forwarding letter the agreement so concluded is submitted with the Consumer Commission.<\/li>\n<li>When in any case the no agreement is concluded between parties, the mediator will communicate with the reasons and conclusion he transpired after the proceedings to the Consumer Commission.<\/li>\n<li>Communication under <strong>Rule 15<\/strong>, shall be made by the mediator to the Commission and the copies are sent to parties as well.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong><u>Matters not covered under mediation:<\/u><\/strong><\/p>\n<p style=\"text-align: justify;\">Those matters which involve proceedings related to criminal matter, offences such as fraud, forgery, non-compoundable offences, etc of like nature are not to be referred to Mediation.
