{"id":264064,"date":"2022-03-22T10:00:13","date_gmt":"2022-03-22T04:30:13","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=264064"},"modified":"2022-03-22T10:18:45","modified_gmt":"2022-03-22T04:48:45","slug":"us-department-of-labor-announces-proposed-rule-for-modifying-procedures-to-identify-remedy-discrimination-in-federal-contracting","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/03\/22\/us-department-of-labor-announces-proposed-rule-for-modifying-procedures-to-identify-remedy-discrimination-in-federal-contracting\/","title":{"rendered":"US Department of Labor announces proposed rule for modifying procedures to identify, remedy discrimination in federal contracting"},"content":{"rendered":"<p style=\"text-align: justify;\">The U.S. Department of Labor has announced <a href=\"https:\/\/gcc02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.federalregister.gov%2Fd%2F2022-05696&amp;data=04%7C01%7CGamble.Bennett%40dol.gov%7C085c9e8d2aeb43a0dde508da0b3adb11%7C75a6305472044e0c9126adab971d4aca%7C0%7C0%7C637834644668607848%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000&amp;sdata=KFDiK2KuUAI4UvOmYToUUqYryDyWCJA6DZAYRW6q%2Bi8%3D&amp;reserved=0\">a proposed modification to a final rule that aims to create a streamlined, efficient and flexible process allowing the department to use its resources strategically to remove barriers to equal employment opportunity<\/a>.<\/p>\n<p style=\"text-align: justify;\">The proposed rule making seeks to revise the final rule, \u201cNondiscrimination Obligations of Federal Contractors and Subcontractors: Procedures to Resolve Potential Employment Discrimination,\u201d in effect since Dec. 10, 2020.<\/p>\n<h4 style=\"text-align: justify;\">Key points<\/h4>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">The proposed <\/span><span dir=\"ltr\" role=\"presentation\">modifications would allow Office of Federal Contract Compliance Programs (&#8216;OFCCP&#8217;) to tailor the pre-enforcement process to the specific facts and <\/span><span dir=\"ltr\" role=\"presentation\">circumstances of each case, consistent with judicial interpretations of the applicable legal <\/span><span dir=\"ltr\" role=\"presentation\">authorities, which will in turn allow OFCCP to more effectively redress unlawful discrimination.<br \/>\n<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">In addition, to promote greater efficiency in resolving cases, OFCCP proposes to modify <\/span><span dir=\"ltr\" role=\"presentation\">the 2020 rule\u2019s provision that required a contractor to provide a response within 30 calendar days <\/span><span dir=\"ltr\" role=\"presentation\">of receiving a Predetermination Notice.<br \/>\n<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">The proposal returns the Predetermination Notice response period to the 15 calendar day period in effect prior to the 2020 rule (which OFCCP may extend for good cause). In the proposal, OFCCP also clarifies this provision to state that any <\/span><span dir=\"ltr\" role=\"presentation\">response must be<\/span> <span dir=\"ltr\" role=\"presentation\">received by<\/span> <span dir=\"ltr\" role=\"presentation\">OFCCP within 15 calendar days.<br \/>\n<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">OFCCP also proposes to retain the regulatory language regarding early resolution, which <\/span><span dir=\"ltr\" role=\"presentation\">provides that contractors may waive these notice procedures if they enter directly into a <\/span><span dir=\"ltr\" role=\"presentation\">conciliation agreement.<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">The proposal would delete the severability clause that applied just to certain sections of OFCCP\u2019s regulations and replace it with severability clauses covering the entirety of each part of OFCCP\u2019s regulatory scheme.<br \/>\n<\/span><\/li>\n<\/ul>\n<p
