{"id":263835,"date":"2022-03-17T10:30:07","date_gmt":"2022-03-17T05:00:07","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=263835"},"modified":"2022-03-17T09:43:16","modified_gmt":"2022-03-17T04:13:16","slug":"draft-inter-country-non-transport-vehicle-rules-2022","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/03\/17\/draft-inter-country-non-transport-vehicle-rules-2022\/","title":{"rendered":"Draft Inter-Country Non-Transport Vehicle Rules, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page4R_mcid31\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Ministry of Road Transport and Highways has published the Draft Inter-Country Non-Transport Vehicle Rules, 2022. <\/span><\/span><span id=\"page4R_mcid32\" class=\"markedContent\"><\/span><\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #000080;\">Key points:<\/span><\/h4>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span id=\"page4R_mcid32\" class=\"markedContent\">\u00a0A<\/span><span id=\"page4R_mcid45\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"> non-transport vehicle registered in the other country, when entering India, shall be so <\/span><span dir=\"ltr\" role=\"presentation\">constructed and maintained as to be at all times under the effective control of the person driving it.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page9R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Motor vehicles registered in any country other than India shall not be permitted to transport <\/span><\/span><span id=\"page9R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">local passengers and goods within the territory of India.<\/span><\/span><span id=\"page9R_mcid7\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><span id=\"page9R_mcid7\" class=\"markedContent\"><\/span><span id=\"page9R_mcid7\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page9R_mcid7\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Motor vehicles registered in any country other than India shall be <\/span><\/span><span id=\"page9R_mcid7\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">required to comply with rules and regulations made under Section 118 of Motor Vehicles Act, 1988 of <\/span><\/span><span id=\"page9R_mcid7\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">India.<\/span><\/span><\/li>\n<li><span id=\"page4R_mcid46\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Following documents shall be carried in the vehicle(s) operating under<\/span>:<br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Inter-Country Non-Transport Vehicle Rules during the duration of stay in the host country, namely:<\/span><span dir=\"ltr\" role=\"presentation\">\u2013<\/span><\/span><span id=\"page4R_mcid47\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(i)<\/span> <span dir=\"ltr\" role=\"presentation\">A valid registration certificate;<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page9R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(ii) A valid driving license or international driving permit, whichever is applicable;<\/span><\/span><span id=\"page9R_mcid1\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(iii) A valid insurance policy;<\/span><\/span><span id=\"page9R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(iv) A valid pollution under control certificate (if applicable in the origin country).<\/span><\/span><\/p>\n<p style=\"text-align: justify;\">Note: <span id=\"page4R_mcid40\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8220;International Driving Permit&#8221; means the international driving permit issued under the International <\/span><span dir=\"ltr\" role=\"presentation\">Convention of Road Traffic, 1949 and\/or any subsequent Convention ratifying the same and signed <\/span><span dir=\"ltr\" role=\"presentation\">by India and other countries who are parties to the Convention on Road Traffic signed at Geneva <\/span><span dir=\"ltr\" role=\"presentation\">on 19th day of September, 1949;<\/span><\/span><span id=\"page4R_mcid41\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"page4R_mcid41\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Non<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">transport vehicle\u2016 means a motor vehicle which is not a transport vehicle (a transport vehicle <\/span><span dir=\"ltr\" role=\"presentation\">includes a public service vehicle, a goods carriage, an educational institution bus or a private <\/span><span dir=\"ltr\" role=\"presentation\">service vehicle)<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"page4R_mcid32\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Any Objections and suggestions to these draft rules, if any, may be sent to the Joint Secretary <\/span><span dir=\"ltr\" role=\"presentation\">(MVL, Transport &amp;
