{"id":263372,"date":"2022-03-10T10:30:41","date_gmt":"2022-03-10T05:00:41","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=263372"},"modified":"2022-03-10T09:54:54","modified_gmt":"2022-03-10T04:24:54","slug":"requirement-of-holding-a-valid-passport-while-living-in-india-introduced-vide-foreigners-amendment-order-2022","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/03\/10\/requirement-of-holding-a-valid-passport-while-living-in-india-introduced-vide-foreigners-amendment-order-2022\/","title":{"rendered":"Requirement of holding a valid passport while living in India, introduced vide Foreigners (Amendment) Order, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page1R_mcid118\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">On March 08, 2022, the Central Government has made the <\/span><\/span><span id=\"page1R_mcid120\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Foreigners (Amendment) Order, 2022 to amend the<\/span><\/span><a href=\"http:\/\/www.scconline.com\/DocumentLink\/GBw2oDTE\"><span id=\"page1R_mcid121\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Foreigners Order, 1948<\/span><\/span><\/a>.<span id=\"page1R_mcid126\" class=\"markedContent\"><\/span> <span id=\"page1R_mcid145\" class=\"markedContent\"><\/span><span id=\"page1R_mcid146\" class=\"markedContent\"><\/span><\/p>\n<h4>Key points:<\/h4>\n<ul>\n<li><span id=\"page1R_mcid146\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/GBw2oDTE\">Foreigners Order, 1948<\/a>, the following <\/span><span dir=\"ltr\" role=\"presentation\">paragraph shall be inserted:<\/span><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify; padding-left: 40px;\"><span id=\"page1R_mcid147\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">\u201c<\/span><\/span><strong><span id=\"page1R_mcid148\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">3B<\/span><\/span><span id=\"page1R_mcid149\" class=\"markedContent\"><\/span><span id=\"page1R_mcid150\" class=\"markedContent\"><\/span><\/strong><span id=\"page1R_mcid151\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\"><strong>Requirement of holding a valid passport or other valid travel document while living in India<\/strong>.<\/span><\/span><span id=\"page1R_mcid152\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page1R_mcid153\" class=\"markedContent\"><\/span><span id=\"page1R_mcid154\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Save <\/span><\/span><span id=\"page1R_mcid155\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">a<\/span><\/span><span id=\"page1R_mcid156\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">s otherwise provided in terms of this Order or rule 4 of the Passport (Entry into India) Rules, 1950, a <\/span><\/span><span id=\"page1R_mcid157\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">foreigner shall hold a valid passport or other valid travel document relating to passport, as the case may be, <\/span><\/span><span id=\"page1R_mcid158\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">while living in India.<\/span><\/span><span id=\"page1R_mcid159\" class=\"markedContent\"><\/span><span id=\"page1R_mcid160\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Explanation.- For<\/span> <span dir=\"ltr\" role=\"presentation\">the purpose of this paragraph, \u201cother valid travel document\u201d includes emergency certificate <\/span><span dir=\"ltr\" role=\"presentation\">or certificate of identity or such other document which has been issued by or under the authority of the <\/span><span dir=\"ltr\" role=\"presentation\">Government of a foreign country satisfying the conditions specified in the Passport (Entry into India) Rules, <\/span><span dir=\"ltr\" role=\"presentation\">1950 as made under the Passport (Entry into India) Act, 1920\u201d.<\/span><\/span><span id=\"page1R_mcid161\" class=\"markedContent\"><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page1R_mcid161\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In the said Order, the following paragraph shall be inserted<\/span><\/span><span id=\"page1R_mcid162\" class=\"markedContent\">:<br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">\u201c<strong>17. Reports or application or in<\/strong><\/span><span dir=\"ltr\" role=\"presentation\"><strong>formation to be submitted in electronic form<\/strong>.- (1) Any report or application <\/span><span dir=\"ltr\" role=\"presentation\">or information under this order, shall be submitted to the Registration Officer or the civil authority, as the <\/span><span dir=\"ltr\" role=\"presentation\">case may be, through the electronic mode.<\/span><\/span><span id=\"page1R_mcid163\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(2)<\/span> <span dir=\"ltr\" role=\"presentation\">On receipt of report or application or information, as the case may be, the Registration Officer or the <\/span><span dir=\"ltr\" role=\"presentation\">civil authority shall verify genuineness of the report or application or information and, he may, if considered <\/span><span dir=\"ltr\" role=\"presentation\">necessary, call upon the applicant or the informant for personal appearance of the applicant or informant for <\/span><span dir=\"ltr\" role=\"presentation\">the purpose of this paragraph\u201d.<\/span><\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>On March 08, 2022, the Central Government has made the Foreigners (Amendment) Order, 2022 to amend the Foreigners Order, 1948.
