{"id":262917,"date":"2022-03-02T10:30:33","date_gmt":"2022-03-02T05:00:33","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=262917"},"modified":"2022-03-02T10:31:48","modified_gmt":"2022-03-02T05:01:48","slug":"mca-modifies-nfra-rules-relating-to-salary-and-various-allowances-for-chairperson-and-members-of-authority","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/03\/02\/mca-modifies-nfra-rules-relating-to-salary-and-various-allowances-for-chairperson-and-members-of-authority\/","title":{"rendered":"MCA modifies NFRA Rules relating to salary and various allowances for Chairperson and members of authority"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page5R_mcid87\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Central Government notifies <span id=\"page5R_mcid96\" class=\"markedContent\">National Financial Reporting Authority (Manner of Appointment and other Terms and Conditions of Service of Chairperson and Members) Amendment Rules, 2022 <\/span>to <\/span><\/span><span id=\"page5R_mcid88\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">amend the National<\/span> <span dir=\"ltr\" role=\"presentation\">Financial<\/span> <span dir=\"ltr\" role=\"presentation\">Reporting Authority (Manner<\/span><\/span><span id=\"page5R_mcid89\" class=\"markedContent\"><\/span><span id=\"page5R_mcid90\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">Appointment<\/span> <span dir=\"ltr\" role=\"presentation\">and other Terms and <\/span><\/span><span id=\"page5R_mcid91\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Conditions of Service of Chairperson and Members) Rules, 2018. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"page5R_mcid94\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page5R_mcid109\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/p87D4Eri\">National Financial Reporting Authority (Manner of Appointment and other Terms and <\/a><\/span><\/span><span id=\"page5R_mcid110\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Conditions of Service of Chairperson and Members) Rules, 2018:<\/span><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page5R_mcid114\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Rule 11 is modified to increase the consolidated monthly salary of Chairperson from two lakhs fifty thousand rupees to <span id=\"page5R_mcid123\" class=\"markedContent\">four lakh fifty thousand rupees. The Rule <\/span>shall be substituted with the following:<\/span><\/span><span id=\"page5R_mcid115\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page5R_mcid116\" class=\"markedContent\"><\/span><span id=\"page5R_mcid117\" class=\"markedContent\"><\/span><span id=\"page5R_mcid118\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">\u201c<\/span><\/span><span id=\"page5R_mcid119\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>11. Salary and allowances<\/strong>.<\/span><\/span><span id=\"page5R_mcid120\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page5R_mcid121\" class=\"markedContent\"><\/span><span id=\"page5R_mcid122\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">(1) The Chairperson shall have the option to draw either a <\/span><\/span><span id=\"page5R_mcid123\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">consolidated monthly salary of four lakh fifty thousand rupees without house and car or the pay and <\/span><\/span><span id=\"page5R_mcid124\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">allowances as are admissible to a Secretary to the Government of India and every full time member <\/span><\/span><span id=\"page5R_mcid125\" class=\"markedContent\"><\/span><span id=\"page5R_mcid126\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">shall have the option to draw either a consolidated monthly salary of four lakh rupees without <\/span><\/span><span id=\"page5R_mcid127\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">house and car or the pay and allowances as are admissible to an Additional Secretary to the <\/span><\/span><span id=\"page5R_mcid128\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Government of India:<\/span><\/span><span id=\"page5R_mcid129\" class=\"markedContent\"><\/span><span id=\"page5R_mcid130\" class=\"markedContent\"><\/span><span id=\"page5R_mcid131\" class=\"markedContent\"><\/span><span id=\"page5R_mcid132\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided that where the Chairperson exercises<\/span><\/span><span id=\"page5R_mcid133\" class=\"markedContent\"><\/span><span id=\"page5R_mcid134\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">the option to receive pay as admissible to a <\/span><\/span><span id=\"page5R_mcid135\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Secretary to the Government of India or a full time member exercises the option to receive pay as <\/span><\/span><span id=\"page5R_mcid136\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">admissible to an Additional Secretary to the Government of India and is in receipt of monthly <\/span><\/span><span id=\"page5R_mcid137\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">pension from eithe<\/span><\/span><span id=\"page5R_mcid138\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">r the Central Government or a State Government, the pay of such Chairperson or <\/span><\/span><span id=\"page5R_mcid139\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Member, as the case may be, shall be reduced by the gross amount of pension drawn by him:<\/span><\/span><span id=\"page5R_mcid140\" class=\"markedContent\"><\/span><span id=\"page5R_mcid141\" class=\"markedContent\"><\/span><span id=\"page5R_mcid142\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided also that in respect of appointments made on the basis of advertisement issue<\/span><\/span><span id=\"page5R_mcid143\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">d on <\/span><\/span><span id=\"page5R_mcid144\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">12<\/span><\/span><span id=\"page5R_mcid145\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">th<\/span><\/span><span id=\"page5R_mcid146\" class=\"markedContent\"><\/span><span id=\"page5R_mcid147\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">July, 2021, where a full time member exercises the option to receive pay as admissible to an <\/span><\/span><span id=\"page5R_mcid148\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Additional Secretary to the Government of India and was in receipt of pay and allowances as are <\/span><\/span><span id=\"page5R_mcid149\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">admissible to a Secretary to<\/span><\/span><span id=\"page5R_mcid150\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">the<\/span><\/span><span id=\"page5R_mcid151\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Government of India prio<\/span><\/span><span id=\"page5R_mcid152\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">r to his or her superannuation on joining <\/span><\/span><span id=\"page5R_mcid153\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">as full time member, National Financial Reporting Authority, then the same shall be fixed at the <\/span><\/span><span id=\"page5R_mcid154\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">level of pay which he or she was drawing at the time of demitting his or her previous employment, <\/span><\/span><span id=\"page5R_mcid155\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">subject to a limit<\/span><\/span><span id=\"page5R_mcid156\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">of Rs. 2,25,000\/<\/span><\/span><span id=\"page5R_mcid157\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page5R_mcid158\" class=\"markedContent\"><\/span><span id=\"page5R_mcid159\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">per month.\u201d;<\/span><\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page5R_mcid160\" class=\"markedContent\">R<\/span><span id=\"page5R_mcid161\" class=\"markedContent\"><\/span><span id=\"page5R_mcid162\" class=\"markedContent\"><\/span><span id=\"page5R_mcid164\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">ule 15 shall be substituted be substituted with the following:<\/span><\/span><span id=\"page5R_mcid165\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page5R_mcid166\" class=\"markedContent\"><\/span><span id=\"page5R_mcid167\" class=\"markedContent\"><\/span><span id=\"page5R_mcid168\" class=\"markedContent\"><\/span><span id=\"page5R_mcid169\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">\u201c<\/span><\/span><strong><span id=\"page5R_mcid170\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">15. House rent allowance<\/span><\/span><\/strong><span id=\"page5R_mcid171\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">.<\/span><\/span><span id=\"page5R_mcid172\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page5R_mcid173\" class=\"markedContent\"><\/span><span id=\"page5R_mcid174\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">(1) The Chairperson or a full time member, who has opted for pay <\/span><\/span><span id=\"page5R_mcid175\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">and allowances<\/span><\/span><span id=\"page5R_mcid176\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">as are admissible to a Secretary or an Additional Secretary to the Government of <\/span><\/span><span id=\"page5R_mcid177\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">India, as the case may be, shall be entitled to house rent allowance at the same rate as is admissible <\/span><\/span><span id=\"page5R_mcid178\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">to a Central Government officer holding a Group \u2018A\u2019 post carrying the s<\/span><\/span><span id=\"page5R_mcid179\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">ame pay:<\/span><\/span><span id=\"page5R_mcid180\" class=\"markedContent\"><\/span><span id=\"page5R_mcid181\" class=\"markedContent\"><\/span><span id=\"page5R_mcid182\" class=\"markedContent\"><\/span><span id=\"page5R_mcid183\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided that the Chairperson or a full<\/span><\/span><span id=\"page5R_mcid184\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page5R_mcid185\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">time member shall not be eligible for house rent <\/span><\/span><span id=\"page5R_mcid186\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">allowance in case he is in occupation of, or occupies, a General Pool Residential Accommodation <\/span><\/span><span id=\"page5R_mcid187\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">which has been allotted to him:<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page12R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(2)<\/span><\/span><span id=\"page12R_mcid2\" class=\"markedContent\"><\/span><span id=\"page12R_mcid3\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Nothing in this rule s<\/span><\/span><span id=\"page12R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">hall apply to the Chairperson or a full<\/span><\/span><span id=\"page12R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page12R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">time member who has opted for <\/span><\/span><span id=\"page12R_mcid7\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">a consolidated salary of four lakh fifty thousand rupees per month or four lakh rupees per month, as <\/span><\/span><span id=\"page12R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">the case may be.\u201d ;<\/span><\/span><span id=\"page12R_mcid9\" class=\"markedContent\"><\/span><span id=\"page12R_mcid10\" class=\"markedContent\"><\/span><span id=\"page12R_mcid11\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page12R_mcid12\" class=\"markedContent\"><\/span><span id=\"page12R_mcid13\" class=\"markedContent\">R<span dir=\"ltr\" role=\"presentation\">ule 16 shall be substituted with the following<\/span><\/span><span id=\"page12R_mcid14\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">:<\/span><\/span><span id=\"page12R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page12R_mcid16\" class=\"markedContent\"><\/span><span id=\"page12R_mcid17\" class=\"markedContent\"><\/span><span id=\"page12R_mcid18\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">\u201c<\/span><\/span><strong><span id=\"page12R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">16. Transport Allowance.<\/span><\/span><\/strong><span id=\"page12R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page12R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(1) The Chairperson or a full time member, who has opted for pay and <\/span><\/span><span id=\"page12R_mcid22\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">allowances as are admissible to a Secretary or an Additional Secretary to the Government of India, <\/span><\/span><span id=\"page12R_mcid23\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">as the case may be, shall be entitled to the facility of<\/span><\/span><span id=\"page12R_mcid24\" class=\"markedContent\"><\/span><span id=\"page12R_mcid25\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">staff car for journeys for official and private <\/span><\/span><span id=\"page12R_mcid26\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">purposes in accordance with the facilities as are admissible to a Central Government officer <\/span><\/span><span id=\"page12R_mcid27\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">holding a Group \u2018A\u2019 post carrying the same pay as per the provisions of applicable staff car rules.<\/span><\/span><span id=\"page12R_mcid28\" class=\"markedContent\"><\/span><span id=\"page12R_mcid29\" class=\"markedContent\"><\/span><span id=\"page12R_mcid30\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(2) Nothing<\/span><\/span><span id=\"page12R_mcid31\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">in this rule shall apply to the Chairperson or a full<\/span><\/span><span id=\"page12R_mcid32\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page12R_mcid33\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">time member who has opted for a <\/span><\/span><span id=\"page12R_mcid34\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">consolidated salary of four lakh fifty thousand rupees per month or four lakh rupees per month, as <\/span><\/span><span id=\"page12R_mcid35\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">the case may be.\u201d ;<\/span><\/span><span id=\"page12R_mcid36\" class=\"markedContent\"><\/span><span id=\"page12R_mcid37\" class=\"markedContent\"><\/span><span id=\"page12R_mcid38\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page12R_mcid40\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Rule 18 relating to <b>Other conditions of service<\/b>, for sub<\/span><\/span><span id=\"page12R_mcid41\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page12R_mcid42\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">rule (1), the following su<\/span><\/span><span id=\"page12R_mcid43\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">b<\/span><\/span><span id=\"page12R_mcid44\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page12R_mcid45\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">rule shall be substituted, namely:<\/span><\/span><span id=\"page12R_mcid46\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page12R_mcid47\" class=\"markedContent\"><\/span><span id=\"page12R_mcid48\" class=\"markedContent\"><\/span><span id=\"page12R_mcid49\" class=\"markedContent\"><\/span><span id=\"page12R_mcid50\" class=\"markedContent\"><\/span><span id=\"page12R_mcid51\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">\u201c(1) The terms and conditions of service of a chairperson or a full time member who has opted for <\/span><\/span><span id=\"page12R_mcid52\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">pay and allowances as are admissible to a Secretary or an Additional Secretary to the Government <\/span><\/span><span id=\"page12R_mcid53\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">of India, as the cas<\/span><\/span><span id=\"page12R_mcid54\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">e maybe, with respect to which no express provision has been made under these <\/span><\/span><span id=\"page12R_mcid55\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">rules, shall be such as are applicable to a Central Government officer holding a Group \u2018A\u2019 post <\/span><\/span><span id=\"page12R_mcid56\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">carrying the same pay.\u201d<\/span><\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The
