Kantikar (Presiding Member) and Binoy Kumar (Member) while allowing an application for transfer expressed that,<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #008080;\">\u201c\u2026it is true that the doctors are busy and conscious about their duties towards the patient, but they are not exempted from the legal proceedings and duty bound to attend the court proceedings (physical or virtual mode) either through their Counsel or on their own.\u201d<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Instant petition was a transfer application to transfer the complaint from the State Commission, Chhattisgarh to the State Commission, Odisha.<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Analysis and Decision<\/span><\/h4>\n<p style=\"text-align: justify;\">The OPs were running a Medical Centre for more than 2 decades. They have digitalization and communication facilities like WIFI\/internet which may be used for e-filing\/virtual proceedings.<\/p>\n<p style=\"text-align: justify;\">Coram expressed that, it is true that the doctors are busy and conscious about their duties towards the patient, but they are not exempted from the legal proceedings and duty-bound to attend the court proceedings (physical or virtual mode) either through their Counsel or on their own.<\/p>\n<p style=\"text-align: justify;\">The Statement of Objects and Reasons of the Act 1986 speaks of \u201cspeedy and simple redressal to consumer disputes\u201d. This is the case of alleged medical negligence which needs a holistic approach after giving fair opportunities to the parties on both sides, instead of taking a technical approach, Commission added.<\/p>\n<p style=\"text-align: justify;\">Hence, in view of the above discussion, as per the provisions contained under Section 62 of the Consumer Protection Act, 2019 the transfer application was allowed.<\/p>\n<p style=\"text-align: justify;\">The Commission directed the parties to appear before the State Commission, Odisha on 7-3-2022.[Manasi Mishra v.
