{"id":261413,"date":"2022-02-10T11:30:38","date_gmt":"2022-02-10T06:00:38","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=261413"},"modified":"2022-02-11T16:22:28","modified_gmt":"2022-02-11T10:52:28","slug":"delhi-judicial-service-amendment-rules-2022","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/02\/10\/delhi-judicial-service-amendment-rules-2022\/","title":{"rendered":"Delhi Judicial Service (Amendment) Rules, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page33R_mcid22\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Lieutenant <\/span><span dir=\"ltr\" role=\"presentation\">Governor of NCT of Delhi in consultation with the High Court of Delhi notified Delhi Judicial Service (Amendment) Rules, 2022<\/span><span dir=\"ltr\" role=\"presentation\"> to amend the Delhi Judicial Service Rules, 1970:<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<p>Key Amendment:<\/p>\n<ul>\n<li>Rule 7 has been modified to include a proviso providing that <span id=\"page38R_mcid17\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">the quorum for any<\/span> <span dir=\"ltr\" role=\"presentation\">meeting of the <\/span><span dir=\"ltr\" role=\"presentation\">Selection Committee.<\/span><\/span><span id=\"page38R_mcid18\" class=\"markedContent\"><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"color: #008000;\">Amendment:<\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><span id=\"page38R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">For purposes of recruitment to the service there shall <\/span><span dir=\"ltr\" role=\"presentation\">be<\/span> <span dir=\"ltr\" role=\"presentation\">a<\/span> <span dir=\"ltr\" role=\"presentation\">Selection<\/span> <span dir=\"ltr\" role=\"presentation\">Committee<\/span> <span dir=\"ltr\" role=\"presentation\">consisting<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">fo<\/span><span dir=\"ltr\" role=\"presentation\">llowing:<\/span> <span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page38R_mcid13\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(1) Chief Justice or a Judge of the<\/span> <span dir=\"ltr\" role=\"presentation\">High Court <\/span><span dir=\"ltr\" role=\"presentation\">deputed by him.<\/span><\/span><span id=\"page38R_mcid14\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(2) Two Judges of the High Court nominated by the <\/span><span dir=\"ltr\" role=\"presentation\">Chief Justice.<\/span><\/span><span id=\"page38R_mcid15\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(3) Chief Secretary, Government of<\/span> <span dir=\"ltr\" role=\"presentation\">National Capital <\/span><span dir=\"ltr\" role=\"presentation\">Territory of Delhi.<\/span><\/span><span id=\"page38R_mcid16\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">4)<\/span> <span dir=\"ltr\" role=\"presentation\">A<\/span> <span dir=\"ltr\" role=\"presentation\">Secretary<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">Government<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">National <\/span><span dir=\"ltr\" role=\"presentation\">Capital<\/span> <span dir=\"ltr\" role=\"presentation\">Territory<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">Delhi<\/span> <span dir=\"ltr\" role=\"presentation\">nominated<\/span> <span dir=\"ltr\" role=\"presentation\">by<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">Administrator.<\/span><\/span><span id=\"page38R_mcid17\" class=\"markedContent\"><br role=\"presentation\" \/><strong><span dir=\"ltr\" role=\"presentation\">Provided that the quorum for any<\/span> <span dir=\"ltr\" role=\"presentation\">meeting of the <\/span><span dir=\"ltr\" role=\"presentation\">Selection Committee.<\/span><\/strong><\/span><span id=\"page38R_mcid18\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">The Registrar<\/span> <span dir=\"ltr\" role=\"presentation\">General<\/span> <span dir=\"ltr\" role=\"presentation\">of the High<\/span> <span dir=\"ltr\" role=\"presentation\">Court shall be <\/span><span dir=\"ltr\" role=\"presentation\">the ex<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">officio Secretary<\/span> <span dir=\"ltr\" role=\"presentation\">of the Committee.<\/span><\/span><\/p>\n<ul>\n<li>Rule 13 has been modified to provide the recruitment process.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\">Amendment:<\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page38R_mcid21\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\"><span id=\"page38R_mcid22\" class=\"markedContent\">Recruitment after the initial recruitment shall be made on the basis of a competitive examination comprising of a Preliminary objective type Examination for selection for the Mains Examination (Written), Mains Examination (Written) and Interview\/ Viva Voce. The Examination will be held by the High Court in Delhi, preferably once a year, subject to vacancy position. The Administrator shall be kept informed about the dates and place of such examination.<\/span><\/span><\/strong><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\">Rule 14 has been modified to include the eligibility criteria where the candidate is <span id=\"page38R_mcid33\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">not more than 32 years of age on the<\/span> <span dir=\"ltr\" role=\"presentation\">1<\/span><span dir=\"ltr\" role=\"presentation\">st<\/span> <span dir=\"ltr\" role=\"presentation\">day <\/span><span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">January<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">year<\/span> <span dir=\"ltr\" role=\"presentation\">in<\/span> <span dir=\"ltr\" role=\"presentation\">which<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">applicatio<\/span><span dir=\"ltr\" role=\"presentation\">ns for appointment are invited.<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span style=\"color: #008000;\">Amendment:<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span id=\"page38R_mcid29\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">A candidate shall be eligible to appear at the <\/span><span dir=\"ltr\" role=\"presentation\">examination, if he is:<\/span> <span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page38R_mcid30\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">a)<\/span> <span dir=\"ltr\" role=\"presentation\">a citizen of India;<\/span><\/span><span id=\"page38R_mcid31\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">b)<\/span> <span dir=\"ltr\" role=\"presentation\">a person<\/span> <span dir=\"ltr\" role=\"presentation\">practising<\/span> <span dir=\"ltr\" role=\"presentation\">as an Advocate in India <\/span><span dir=\"ltr\" role=\"presentation\">or<\/span> <span dir=\"ltr\" role=\"presentation\">a<\/span> <span dir=\"ltr\" role=\"presentation\">person<\/span> <span dir=\"ltr\" role=\"presentation\">qualified<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">be<\/span> <span dir=\"ltr\" role=\"presentation\">admitted<\/span> <span dir=\"ltr\" role=\"presentation\">as<\/span> <span dir=\"ltr\" role=\"presentation\">an <\/span><span dir=\"ltr\" role=\"presentation\">Advocate under the Advocates Act,<\/span> <span dir=\"ltr\" role=\"presentation\">1961; and<\/span><\/span><span id=\"page38R_mcid32\" class=\"markedContent\"><\/span><span id=\"page38R_mcid33\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">c)<\/span> <span dir=\"ltr\" role=\"presentation\">not more than 32 years of age on the<\/span> <span dir=\"ltr\" role=\"presentation\">1<\/span><span dir=\"ltr\" role=\"presentation\">st<\/span> <span dir=\"ltr\" role=\"presentation\">day <\/span><span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">January<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">year<\/span> <span dir=\"ltr\" role=\"presentation\">i<strong>n<\/strong><\/span><strong> <span dir=\"ltr\" role=\"presentation\">which<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">applicatio<\/span><\/strong><span dir=\"ltr\" role=\"presentation\"><strong>ns for appointment are invited<\/strong>.<\/span><\/span><\/p>\n<ul>\n<li>Rule 15 has been modified to provide that t<span id=\"page38R_mcid37\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">he<\/span> <span dir=\"ltr\" role=\"presentation\">Sy<\/span><span dir=\"ltr\" role=\"presentation\">llabus<\/span> <span dir=\"ltr\" role=\"presentation\">for<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">Examination<\/span> <span dir=\"ltr\" role=\"presentation\">and<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">Scheme<\/span> <span dir=\"ltr\" role=\"presentation\">governing<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">conduct<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">Examination<\/span> <span dir=\"ltr\" role=\"presentation\">must<\/span> <span dir=\"ltr\" role=\"presentation\">be<\/span> <span dir=\"ltr\" role=\"presentation\">as<\/span> <span dir=\"ltr\" role=\"presentation\">detailed<\/span> <span dir=\"ltr\" role=\"presentation\">in<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">Appendix to these Rules.<\/span><\/span><\/li>\n<li>Rule 18 has been modified and states:<\/li>\n<\/ul>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li style=\"text-align: justify;\"><span id=\"page38R_mcid42\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Selection Committee shall<\/span> <span dir=\"ltr\" role=\"presentation\">prepare\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">a list of candidates in order of merit on the basis <\/span><span dir=\"ltr\" role=\"presentation\">of competitive examination held in accordance <\/span><span dir=\"ltr\" role=\"presentation\">with the Rules. Such list will be forwarded to <\/span><span dir=\"ltr\" role=\"presentation\">the Administrator.<\/span><\/span><span id=\"page38R_mcid43\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page38R_mcid43\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Administrator m<\/span><span dir=\"ltr\" role=\"presentation\">ay in consultation <\/span><span dir=\"ltr\" role=\"presentation\">with<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">High<\/span> <span dir=\"ltr\" role=\"presentation\">Court,<\/span> <span dir=\"ltr\" role=\"presentation\">make<\/span> <span dir=\"ltr\" role=\"presentation\">appointment<\/span> <span dir=\"ltr\" role=\"presentation\">in <\/span><span dir=\"ltr\" role=\"presentation\">substantive, officiating or temporary vacancies <\/span><span dir=\"ltr\" role=\"presentation\">from amongst those who stand highest in order <\/span><span dir=\"ltr\" role=\"presentation\">of merit.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page40R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">All<\/span> <span dir=\"ltr\" role=\"presentation\">selected<\/span> <span dir=\"ltr\" role=\"presentation\">candidates<\/span> <span dir=\"ltr\" role=\"presentation\">shall<\/span> <span dir=\"ltr\" role=\"presentation\">join<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">service within a period of one month from the <\/span><span dir=\"ltr\" role=\"presentation\">date of issuance of notification of appointment <\/span><span dir=\"ltr\" role=\"presentation\">by the competent authority.<\/span><\/span><span id=\"page40R_mcid1\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><span id=\"page40R_mcid1\" class=\"markedContent\"><\/span><span id=\"page40R_mcid1\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page40R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Upon<\/span> <span dir=\"ltr\" role=\"presentation\">sufficient<\/span> <span dir=\"ltr\" role=\"presentation\">justification,<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">competent<\/span> <span dir=\"ltr\" role=\"presentation\">authority<\/span> <span dir=\"ltr\" role=\"presentation\">i.e.<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">High<\/span> <span dir=\"ltr\" role=\"presentation\">Court<\/span> <span dir=\"ltr\" role=\"presentation\">may <\/span><span dir=\"ltr\" role=\"presentation\">extend the above-mentioned period of one month <\/span><span dir=\"ltr\" role=\"presentation\">for joining service on a written application made <\/span><span dir=\"ltr\" role=\"presentation\">by the candidate concerned. Such extension, if <\/span><span dir=\"ltr\" role=\"presentation\">granted,<\/span> <span dir=\"ltr\" role=\"presentation\">shall be<\/span> <span dir=\"ltr\" role=\"presentation\">for<\/span> <span dir=\"ltr\" role=\"presentation\">a<\/span> <span dir=\"ltr\" role=\"presentation\">period<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">two<\/span> <span dir=\"ltr\" role=\"presentation\">months <\/span><span dir=\"ltr\" role=\"presentation\">only. Extension of period of joining beyond this <\/span><span dir=\"ltr\" role=\"presentation\">period may be granted by the High Court in rare <\/span><span dir=\"ltr\" role=\"presentation\">and<\/span> <span dir=\"ltr\" role=\"presentation\">exceptional<\/span> <span dir=\"ltr\" role=\"presentation\">circumstances<\/span> <span dir=\"ltr\" role=\"presentation\">but<\/span> <span dir=\"ltr\" role=\"presentation\">in<\/span> <span dir=\"ltr\" role=\"presentation\">no<\/span> <span dir=\"ltr\" role=\"presentation\">case <\/span><span dir=\"ltr\" role=\"presentation\">shall<\/span> <span dir=\"ltr\" role=\"presentation\">such<\/span> <span dir=\"ltr\" role=\"presentation\">further<\/span> <span dir=\"ltr\" role=\"presentation\">ex<\/span><span dir=\"ltr\" role=\"presentation\">tension<\/span> <span dir=\"ltr\" role=\"presentation\">be<\/span> <span dir=\"ltr\" role=\"presentation\">granted<\/span> <span dir=\"ltr\" role=\"presentation\">for<\/span> <span dir=\"ltr\" role=\"presentation\">a <\/span><span dir=\"ltr\" role=\"presentation\">period of more than six months from the date of <\/span><span dir=\"ltr\" role=\"presentation\">issuance of notification of appointment.<\/span><\/span><span id=\"page40R_mcid2\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><span id=\"page40R_mcid2\" class=\"markedContent\"><\/span><span id=\"page40R_mcid2\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page40R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Upon failure of the selected candidate to join <\/span><span dir=\"ltr\" role=\"presentation\">service either within one month of the date of <\/span><span dir=\"ltr\" role=\"presentation\">notification of appointment or upon expiry<\/span> <span dir=\"ltr\" role=\"presentation\">of <\/span><span dir=\"ltr\" role=\"presentation\">such extended period as may be granted by the <\/span><span dir=\"ltr\" role=\"presentation\">High<\/span> <span dir=\"ltr\" role=\"presentation\">Court,<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">appointment<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">selected <\/span><span dir=\"ltr\" role=\"presentation\">candidate shall lapse.<\/span><\/span><span id=\"page40R_mcid3\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><span id=\"page40R_mcid3\" class=\"markedContent\"><\/span><span id=\"page40R_mcid3\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page40R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The<\/span> <span dir=\"ltr\" role=\"presentation\">vacancy<\/span> <span dir=\"ltr\" role=\"presentation\">so<\/span> <span dir=\"ltr\" role=\"presentation\">created<\/span> <span dir=\"ltr\" role=\"presentation\">by<\/span> <span dir=\"ltr\" role=\"presentation\">virtue<\/span> <span dir=\"ltr\" role=\"presentation\">of <\/span><span dir=\"ltr\" role=\"presentation\">clause<\/span> <span dir=\"ltr\" role=\"presentation\">(v)<\/span> <span dir=\"ltr\" role=\"presentation\">above<\/span> <span dir=\"ltr\" role=\"presentation\">may<\/span> <span dir=\"ltr\" role=\"presentation\">be<\/span> <span dir=\"ltr\" role=\"presentation\">offered<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">next <\/span><span dir=\"ltr\" role=\"presentation\">candidate, as per order of merit in the select list <\/span><span dir=\"ltr\" role=\"presentation\">u<\/span><span dir=\"ltr\" role=\"presentation\">nless for reasons to be recorded in writing, it is <\/span><span dir=\"ltr\" role=\"presentation\">not so deemed apposite.<\/span><\/span><span id=\"page40R_mcid4\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><span id=\"page40R_mcid4\" class=\"markedContent\"><\/span><span id=\"page40R_mcid4\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page40R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The<\/span> <span dir=\"ltr\" role=\"presentation\">Select<\/span> <span dir=\"ltr\" role=\"presentation\">List<\/span> <span dir=\"ltr\" role=\"presentation\">prepared<\/span> <span dir=\"ltr\" role=\"presentation\">for<\/span> <span dir=\"ltr\" role=\"presentation\">all <\/span><span dir=\"ltr\" role=\"presentation\">categories<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">officials<\/span> <span dir=\"ltr\" role=\"presentation\">shall<\/span> <span dir=\"ltr\" role=\"presentation\">be<\/span> <span dir=\"ltr\" role=\"presentation\">valid<\/span> <span dir=\"ltr\" role=\"presentation\">till<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">next<\/span> <span dir=\"ltr\" role=\"presentation\">Select List is published.<\/span><\/span><span id=\"page40R_mcid5\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><span id=\"page40R_mcid5\" class=\"markedContent\"><\/span><span id=\"page40R_mcid5\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page40R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Clauses (iii) to (v) of this Rule shall <\/span><span dir=\"ltr\" role=\"presentation\">form<\/span> <span dir=\"ltr\" role=\"presentation\">par<\/span><span dir=\"ltr\" role=\"presentation\">t of the notification of appointm<\/span><span dir=\"ltr\" role=\"presentation\">ent <\/span><span dir=\"ltr\" role=\"presentation\">of the selected
