href=\"https:\/\/lawfilesext.leg.wa.gov\/biennium\/2021-22\/Pdf\/Bills\/Session%20Laws\/House\/1732-S.SL.pdf?q=20220128131553\" target=\"_blank\" rel=\"noopener\">1732<\/a> and <a href=\"https:\/\/lawfilesext.leg.wa.gov\/biennium\/2021-22\/Pdf\/Bills\/Session%20Laws\/House\/1733-S.SL.pdf?q=20220128150136\" target=\"_blank\" rel=\"noopener\">1733<\/a>, delaying and amending the Washington Cares Act (WA Cares).\u00a0 The bills delay the obligation to withhold WA Cares employee premiums, now set to begin on July 1, 2023, and require employers to refund employees for any WA Cares premiums that have already been collected within 120 days of withholding.\u00a0 The delay, and the refund mandate, are effective immediately.<\/p>\n<p>Key points:<\/p>\n<p style=\"text-align: center;\"><strong><span class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">HOUSE BILL 1733<\/span><\/span><\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page69R_mcid10\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">E<\/span><span dir=\"ltr\" role=\"presentation\">mployer<\/span> <span dir=\"ltr\" role=\"presentation\">must<\/span> <span dir=\"ltr\" role=\"presentation\">collect<\/span> <span dir=\"ltr\" role=\"presentation\">from<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">employees<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">premiums<\/span>  <span dir=\"ltr\" role=\"presentation\">through<\/span> <span dir=\"ltr\" role=\"presentation\">payroll<\/span> <span dir=\"ltr\" role=\"presentation\">deductions<\/span> <span dir=\"ltr\" role=\"presentation\">and<\/span> <span dir=\"ltr\" role=\"presentation\">remit<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">amounts collected to the employment security department.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page106R_mcid10\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Beginning<\/span> <span dir=\"ltr\" role=\"presentation\">January<\/span> <span dir=\"ltr\" role=\"presentation\">1,<\/span> <span dir=\"ltr\" role=\"presentation\">2023,<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">employment<\/span> <span dir=\"ltr\" role=\"presentation\">security<\/span> <span dir=\"ltr\" role=\"presentation\">department<\/span> <span dir=\"ltr\" role=\"presentation\">shall<\/span> <span dir=\"ltr\" role=\"presentation\">accept<\/span> <span dir=\"ltr\" role=\"presentation\">and<\/span> <span dir=\"ltr\" role=\"presentation\">approve<\/span> <span dir=\"ltr\" role=\"presentation\">applications<\/span> <span dir=\"ltr\" role=\"presentation\">for<\/span> <span dir=\"ltr\" role=\"presentation\">voluntary<\/span> <span dir=\"ltr\" role=\"presentation\">exemptions<\/span> <span dir=\"ltr\" <span dir=\"ltr\" role=\"presentation\">any<\/span> <span dir=\"ltr\" role=\"presentation\">employee<\/span> <span dir=\"ltr\" role=\"presentation\">who<\/span> <span dir=\"ltr\" role=\"presentation\">meets<\/span> <span dir=\"ltr\" role=\"presentation\">criteria<\/span> <span dir=\"ltr\" role=\"presentation\">established<\/span> <span dir=\"ltr\" role=\"presentation\">by<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">employment<\/span> <span dir=\"ltr\" role=\"presentation\">security<\/span> <span dir=\"ltr\" role=\"presentation\">department<\/span> <span dir=\"ltr\" role=\"presentation\">for<\/span> <span dir=\"ltr\" role=\"presentation\">an<\/span> <span dir=\"ltr\" role=\"presentation\">A<\/span> <span dir=\"ltr\" role=\"presentation\">veteran<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">United<\/span> <span dir=\"ltr\" role=\"presentation\">States<\/span> <span dir=\"ltr\" role=\"presentation\">military<\/span> <span dir=\"ltr\" role=\"presentation\">who<\/span> <span dir=\"ltr\" role=\"presentation\">has<\/span> <span dir=\"ltr\" role=\"presentation\">been<\/span> <span dir=\"ltr\" role=\"presentation\">rated<\/span> <span role=\"presentation\">temporary<\/span> <span dir=\"ltr\" role=\"presentation\">workers,<\/span> <span dir=\"ltr\" role=\"presentation\">as<\/span> <span dir=\"ltr\" role=\"presentation\">recognized<\/span> <span dir=\"ltr\" role=\"presentation\">by<\/span> <span dir=\"ltr\" role=\"presentation\">federal<\/span> <span dir=\"ltr\" role=\"presentation\">law,<\/span> role=\"presentation\">An<\/span> <span dir=\"ltr\" role=\"presentation\">employee<\/span> <span dir=\"ltr\" role=\"presentation\">who<\/span> <span dir=\"ltr\" role=\"presentation\">is<\/span> <span dir=\"ltr\" role=\"presentation\">employed<\/span> <span dir=\"ltr\" role=\"presentation\">by<\/span> <span dir=\"ltr\" role=\"presentation\">an<\/span> <span dir=\"ltr\" role=\"presentation\">employer<\/span> <span dir=\"ltr\" role=\"presentation\">in<\/span> <span dir=\"ltr\" role=\"presentation\">Washington,<\/span> <span dir=\"ltr\" role=\"presentation\">but<\/span> <span dir=\"ltr\" role=\"presentation\">maintains<\/span> <span dir=\"ltr\" role=\"presentation\">a<\/span> <span dir=\"ltr\" role=\"presentation\">permanent<\/span> <span dir=\"ltr\" role=\"presentation\">address<\/span> <span dir=\"ltr\" role=\"presentation\">outside<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">Washington<\/span> <span dir=\"ltr\" role=\"presentation\">as<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">employee&#8217;s<\/span> <span dir=\"ltr\" role=\"presentation\">primary<\/span> <span dir=\"ltr\" role=\"presentation\">location<\/span> <span dir=\"ltr\" role=\"presentation\">of residence.<\/span><\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong><span class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">HOUSE BILL 1732<\/span><\/span><\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\">Starting July 1, 2026, persons born before January 1, 1968 (those currently at least 54 years old) who have paid WA Cares employee premiums for at least one year may receive $3,650 in WA Cares benefits for each year of premium payments;<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Qualified employees who have vested into the Fund and need long-term care can begin receiving WA Cares benefits starting July 1, 2026 (as opposed to January 1, 2025 in the original Act); and<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify;\">Other dates related to the WA Cares Act, such as the state\u2019s assessment of the premium rate and the state\u2019s reporting on the program, are also respectively
