{"id":261087,"date":"2022-02-04T13:30:31","date_gmt":"2022-02-04T08:00:31","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=261087"},"modified":"2022-02-04T09:50:21","modified_gmt":"2022-02-04T04:20:21","slug":"customs-import-of-goods-at-concessional-rate-of-duty-amendment-rules-2022","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/02\/04\/customs-import-of-goods-at-concessional-rate-of-duty-amendment-rules-2022\/","title":{"rendered":"Customs (Import of Goods at Concessional Rate of Duty) Amendment Rules, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\">On February 01, 2022, the Central Board of Indirect Taxes &amp; Customs (CBIC) has issued the Customs (Import of Goods at Concessional Rate of Duty) Amendment Rules, 2022 further amending the Customs (Import of Goods at Concessional Rate of Duty) Rules, 2017.<\/p>\n<h4 style=\"text-align: justify;\">Key Amendments:<\/h4>\n<ul style=\"text-align: justify;\">\n<li>Rule 4 requiring the importer to give prior information to the Deputy Commissioner of Customs has been substituted to provide one time information on the common portal in Form IGCR-1 (Import of Goods at Concessional Rate of Duty).<\/li>\n<\/ul>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;The importer shall provide one-time information on the common portal in Form IGCR-1 (Import of Goods at Concessional Rate of Duty).&#8221;<\/p>\n<\/blockquote>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\">Previously, Rule 5 requires the importer who intends to avail the benefit of an exemption notification to submit a continuity bond with such surety. The Amendment requires the importer who intends to avail the benefit of an exemption notification to mention the IIN and continuity bond number and details while filing the Bill of Entry. Accordingly, the Deputy Commissioner of Customs or the Assistant Commissioner of Customs, as the case may be, at the Customs Station of importation, shall allow the benefit of the exemption notification to the importer. Once a Bill of Entry is cleared for home consumption, the bond submitted by the importer gets debited automatically in the customs automated system and the details shall be made available electronically to the Jurisdictional Custom Officer.<\/li>\n<li>Rule 6 has been modified to provide that<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\">&#8221; <span id=\"page15R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">6. Importer to maintain records<\/span><\/span>: <span id=\"page15R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">1)<\/span> <span dir=\"ltr\" role=\"presentation\">The importer shall maintain an account in such manner to <\/span><span dir=\"ltr\" role=\"presentation\">clearly indicate the quantity-<\/span><\/span><span id=\"page15R_mcid14\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(i)<\/span> <span dir=\"ltr\" role=\"presentation\">and value of goods imported;<\/span><\/span><span id=\"page15R_mcid15\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(ii)<\/span> <span dir=\"ltr\" role=\"presentation\">and date of receipt of the goods imported in the relevant premises;<\/span><\/span><span id=\"page15R_mcid16\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(iii)<\/span> <span dir=\"ltr\" role=\"presentation\">of such goods consumed;<\/span><\/span><span id=\"page15R_mcid17\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(iv)<\/span> <span dir=\"ltr\" role=\"presentation\">of goods sent for job work, nature of job work carried out;<\/span><\/span><span id=\"page15R_mcid18\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(v)<\/span> <span dir=\"ltr\" role=\"presentation\">of goods received after job work;<\/span><\/span><span id=\"page15R_mcid19\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(vi)<\/span> <span dir=\"ltr\" role=\"presentation\">of goods re-exported, if any, under rule 7; and<\/span><\/span><span id=\"page15R_mcid20\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(vii)<\/span> <span dir=\"ltr\" role=\"presentation\">remaining in stock, according to Bills of Entry<\/span><\/span><span id=\"page15R_mcid21\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page15R_mcid21\" class=\"markedContent\"><\/span><span id=\"page15R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">and shall produce the said account as and when required by the Deputy Commissioner of Customs or <\/span><span dir=\"ltr\" role=\"presentation\">the Assistant Commissioner of Customs, as the case may be, having jurisdiction over the premises or <\/span><span dir=\"ltr\" role=\"presentation\">where the goods imported shall be put to use for manufacture of goods or for rendering output service:<\/span><\/span><span id=\"page15R_mcid22\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided that in case of non-receipt or short receipt of goods imported in the relevant premises, <\/span><span dir=\"ltr\" role=\"presentation\">the importer shall intimate such non-receipt or short receipt immediately on the common portal in the <\/span><span dir=\"ltr\" role=\"presentation\">Form IGCR-2 (Import of Goods at Concessional Rate of Duty).<\/span><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li>Rule 6A which specifies with \u2018Procedure for allowing imported goods for job work\u2019 has been substituted:<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\">(i) The importer shall maintain a record of the goods sent for job work during the month and mention the same in the monthly statement.<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">(ii) The importer shall send the goods to the premises of the job worker under an invoice or wherever applicable through an e-way bill, mentioning the description and quantity of the goods.<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">(iii) The maximum period for which the goods can be sent to the job worker shall be 6 months from the date of invoice or an e-way bill.<\/p>\n<ul>\n<li style=\"text-align: justify;\">Form ICGR-1 which deals with \u2018Prior information to be provided by the importer\u2019 has been revised.<\/li>\n<li style=\"text-align: justify;\">Form ICGR-3 which deals with
