{"id":261002,"date":"2022-02-02T12:30:58","date_gmt":"2022-02-02T07:00:58","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=261002"},"modified":"2022-02-02T11:51:02","modified_gmt":"2022-02-02T06:21:02","slug":"uk-changes-to-pre-employment-checks-on-right-to-work","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/02\/02\/uk-changes-to-pre-employment-checks-on-right-to-work\/","title":{"rendered":"UK | Changes to Pre-employment Checks on Right to Work"},"content":{"rendered":"<p style=\"text-align: justify;\">The Home Office\u2019s UK Visas &amp; Immigration (UKVI) department confirmed the ways in which employers will be able to check a prospective employee\u2019s right to work in the UK from April 6, 2022.<\/p>\n<p>&nbsp;<\/p>\n<h4>Key highlights:<\/h4>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page121R_mcid25\" class=\"markedContent\"><span class=\"\" dir=\"ltr\" role=\"presentation\">From 6 <span class=\"highlight appended\">April<\/span> 2022, BRC, BRP and FWP holders will evidence their right to work using the <\/span><span dir=\"ltr\" role=\"presentation\">Home Office<\/span> <span dir=\"ltr\" role=\"presentation\">online service only<\/span><span dir=\"ltr\" role=\"presentation\">. Employers will no longer be able to accept physical <\/span><span dir=\"ltr\" role=\"presentation\">cards for the purposes of a right<\/span> <span dir=\"ltr\" role=\"presentation\">to work check even if it shows a later expiry date. BRCs, <\/span><span dir=\"ltr\" role=\"presentation\">BRPs and FWPs will be removed from the lists of acceptable documents used to conduct a <\/span><span dir=\"ltr\" role=\"presentation\">manual right to work check.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page123R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Retrospective checks will not be required on biometric card holders who, before 6 <span class=\"highlight appended\">April <\/span><\/span><span dir=\"ltr\" role=\"presentation\">2022, used their physical card to demonstrate their right to work. Employers will maintain a <\/span><span dir=\"ltr\" role=\"presentation\">statutory excuse against<\/span> <span dir=\"ltr\" role=\"presentation\">any civil<\/span> <span dir=\"ltr\" role=\"presentation\">penalty if the initial checks were under<\/span><span dir=\"ltr\" role=\"presentation\">taken in line <\/span><span dir=\"ltr\" role=\"presentation\">with<\/span> <span dir=\"ltr\" role=\"presentation\">the guidance<\/span> <span dir=\"ltr\" role=\"presentation\">that applied at the time the check was made.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page123R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">If an employer chooses to undertake a retrospective check and identifies an existing <\/span><span dir=\"ltr\" role=\"presentation\">employee who no longer has a right to work, they are required to take the appropriate <\/span><span dir=\"ltr\" role=\"presentation\">a<\/span><span dir=\"ltr\" role=\"presentation\">ction. If the employee is an EEA citizen or non<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">EEA family member.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page129R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Employers must use the services of a certified IDSP. This ensures that trust in the <\/span><span dir=\"ltr\" role=\"presentation\">IDSP is founded on<\/span> <span dir=\"ltr\" role=\"presentation\">compliance with the rules of the Schemes. If employers choose <\/span><span dir=\"ltr\" role=\"presentation\">to undertake digital identity verification using their own processes, they will be <\/span><span dir=\"ltr\" role=\"presentation\">required to undergo certification as an IDSP.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page129R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Certified IDSPs are approved companies responsible for validating the identity of a <\/span><span dir=\"ltr\" role=\"presentation\">prospective employee on behalf of<\/span> <span dir=\"ltr\" role=\"presentation\">an<\/span> <span dir=\"ltr\" role=\"presentation\">employer (with the employer becoming a <\/span><span dir=\"ltr\" role=\"presentation\">\u2018relying party\u2019 in that transaction). Certification will align to th<\/span><span dir=\"ltr\" role=\"presentation\">e requirements and <\/span><span dir=\"ltr\" role=\"presentation\">standards set out in the
