{"id":260702,"date":"2022-01-27T16:10:42","date_gmt":"2022-01-27T10:40:42","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=260702"},"modified":"2022-01-27T16:10:42","modified_gmt":"2022-01-27T10:40:42","slug":"ireland-draft-scheme-of-right-to-request-remote-working-bill-2022","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/01\/27\/ireland-draft-scheme-of-right-to-request-remote-working-bill-2022\/","title":{"rendered":"Ireland | Draft Scheme of Right to Request Remote Working Bill, 2022"},"content":{"rendered":"<p style=\"text-align: justify;\"><span class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">On January 25, 2022, the Government of Ireland has introduced the <\/span><\/span>Right to Request Remote Work Bill 2021<span id=\"page17R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"> to provide employees with a statutory right to make, or to have made on their behalf, a request <\/span><span dir=\"ltr\" role=\"presentation\">for Remote Working. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Key points:<\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page48R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">An employee shall be entitled to<\/span> <span dir=\"ltr\" role=\"presentation\">submit a request for<\/span> <span dir=\"ltr\" role=\"presentation\">r<\/span><span dir=\"ltr\" role=\"presentation\">emote <\/span><span dir=\"ltr\" role=\"presentation\">working<\/span> <span dir=\"ltr\" role=\"presentation\">when the employee concerned has completed<\/span> <span dir=\"ltr\" role=\"presentation\">at least<\/span> <span dir=\"ltr\" role=\"presentation\">26 weeks<\/span> <span dir=\"ltr\" role=\"presentation\">continuous service with the <\/span><span dir=\"ltr\" role=\"presentation\">employer from whose employment the<\/span> <span dir=\"ltr\" role=\"presentation\">employee is seeking the arrangement to work remotely<\/span><span dir=\"ltr\" role=\"presentation\">.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page50R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">An employee will<\/span> <span dir=\"ltr\" role=\"presentation\">not be able to submit constant requests and that where the <\/span><span dir=\"ltr\" role=\"presentation\">employer has diligently completed the assessment process and any appeal <\/span><span dir=\"ltr\" role=\"presentation\">has been heard that the employee will have to wait a period of<\/span> <span dir=\"ltr\" role=\"presentation\">12<\/span> <span dir=\"ltr\" role=\"presentation\">months to submit another <\/span><span dir=\"ltr\" role=\"presentation\">reque<\/span><span dir=\"ltr\" role=\"presentation\">st. It is not the intention that such a request would be prohibited where an employee has moved <\/span><span dir=\"ltr\" role=\"presentation\">to a different role within the same employer.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page52R_mcid18\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Provide a balanced mechanism by which<\/span> <span dir=\"ltr\" role=\"presentation\">eligible <\/span><span dir=\"ltr\" role=\"presentation\">workers can<\/span> <span dir=\"ltr\" role=\"presentation\">request a remote working arrangement<\/span><span dir=\"ltr\" role=\"presentation\">. <\/span><\/span><span id=\"page58R_mcid7\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page60R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">An employer having consulted<\/span> <span dir=\"ltr\" role=\"presentation\">the employee and\/or the trade <\/span><span dir=\"ltr\" role=\"presentation\">union (if<\/span> <span dir=\"ltr\" role=\"presentation\">recognised by the employer<\/span><span dir=\"ltr\" role=\"presentation\">) of which he or she is a member, return a decision indicating <\/span><span dir=\"ltr\" role=\"presentation\">whether the request for remote working is wholly or partially approved or declined.<\/span><\/span><span id=\"page60R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><br \/>\n<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page62R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">An<\/span> e<span dir=\"ltr\" role=\"presentation\">mployer shall,<\/span> <span dir=\"ltr\" role=\"presentation\">having<\/span> <span dir=\"ltr\" role=\"presentation\">concluded their<\/span> <span dir=\"ltr\" role=\"presentation\">consideration of the request<\/span> <span dir=\"ltr\" role=\"presentation\">and having consulted <\/span><span dir=\"ltr\" role=\"presentation\">the employee or the trade union (if<\/span> <span dir=\"ltr\" role=\"presentation\">re<\/span><span dir=\"ltr\" role=\"presentation\">cognised by the employer<\/span><span dir=\"ltr\" role=\"presentation\">) of which he or she is a member<\/span><span dir=\"ltr\" role=\"presentation\">, <\/span><span dir=\"ltr\" role=\"presentation\">confirm<\/span> <span dir=\"ltr\" role=\"presentation\">in writing<\/span> <span dir=\"ltr\" role=\"presentation\">if they are<\/span> <span dir=\"ltr\"
