href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/2020\/09\/11\/20G00135\/sg\">Legislative Decree No. 116 of 3 September 2020<\/a> (&#8220;<strong>D.Lgs. 116\/2020<\/strong>&#8220;), implementing <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=uriserv:OJ.L_.2018.150.01.0109.01.ENG\">(EU) Directive 2018\/851<\/a> on waste and EU Directive 2018\/852 on packaging and packaging waste, amended inter alia Article 219, para 5, of the Italian Legislative Decree No. 152 of 3 April 2006 (the &#8220;Italian Environmental Code&#8221;), which provides for certain environmental labelling requirements and obligations for packaging to come to into force with effect from July 01, 2022.<\/p>\n<p>&nbsp;<\/p>\n<p class=\"kilo\" style=\"text-align: justify;\">The entry into force of the same was earlier extended to 01 January 2022 through <a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/2020\/12\/31\/20G00206\/sg\">DL n.183 of 31\/12\/2020.\u00a0<\/a> It has further been extended till July 01, 2022 vide Italian <a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/2021\/12\/30\/21G00255\/sg\">Decree Law No. 228 of 30 December 2021<\/a> (&#8220;<strong>DL 228\/2021<\/strong>&#8220;) with the possibility for companies to sell products without the new environmental labelling requirements where stocks last, provided they have already been put on the market or labelled as of 1 July 2022.<\/p>\n<p>&nbsp;<\/p>\n<p>Key Requirements:<\/p>\n<ol>\n<li>All packaging must be appropriately labelled;<\/li>\n<li>Information on the Destination of packaging;<\/li>\n<li>Information on the nature of packaging material used;<\/li>\n<li>Use of Digital Channels;<\/li>\n<li><span id=\"page11R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">P<\/span><span dir=\"ltr\" role=\"presentation\">utting<\/span> <span dir=\"ltr\" role=\"presentation\">packaging<\/span> <span dir=\"ltr\" role=\"presentation\">lacking<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">mandatory<\/span> <span dir=\"ltr\" role=\"presentation\">labelling<\/span> <span dir=\"ltr\" role=\"presentation\">requirements<\/span> <span dir=\"ltr\" role=\"presentation\">on<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">Italian<\/span> <span dir=\"ltr\" role=\"presentation\">market<\/span> <span dir=\"ltr\" role=\"presentation\">is<\/span> <span dir=\"ltr\" role=\"presentation\">subject<\/span> <span dir=\"ltr\" role=\"presentation\">to <\/span><span dir=\"ltr\" role=\"presentation\">administrative fines between Euro 5,200 and 40,000.<br
