Italian Legislative Decree No. 116 of 3 September 2020<\/a> (“D.Lgs. 116\/2020<\/strong>“), implementing (EU) Directive 2018\/851<\/a> on waste and EU Directive 2018\/852 on packaging and packaging waste, amended inter alia Article 219, para 5, of the Italian Legislative Decree No. 152 of 3 April 2006 (the “Italian Environmental Code”), which provides for certain environmental labelling requirements and obligations for packaging to come to into force with effect from July 01, 2022.<\/p>\n

 <\/p>\n

The entry into force of the same was earlier extended to 01 January 2022 through DL n.183 of 31\/12\/2020.\u00a0<\/a> It has further been extended till July 01, 2022 vide Italian Decree Law No. 228 of 30 December 2021<\/a> (“DL 228\/2021<\/strong>“) with the possibility for companies to sell products without the new environmental labelling requirements where stocks last, provided they have already been put on the market or labelled as of 1 July 2022.<\/p>\n

Key Requirements:<\/p>\n

    \n
  1. All packaging must be appropriately labelled;<\/li>\n
  2. Information on the Destination of packaging;<\/li>\n
  3. Information on the nature of packaging material used;<\/li>\n
  4. Use of Digital Channels;<\/li>\n
  5. P<\/span>utting<\/span> packaging<\/span> lacking<\/span> the<\/span> mandatory<\/span> labelling<\/span> requirements<\/span> on<\/span> the<\/span> Italian<\/span> market<\/span> is<\/span> subject<\/span> to <\/span>administrative fines between Euro 5,200 and 40,000.
