to link electoral rolls with Aadhaar introduced vide Election Laws (Amendment) Act, 2021"},"content":{"rendered":"<p style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">On December 29, 2021, the Election Laws (Amendment) Act, 2021 received the assent of the President to amend the Representation of the People Act, 1950 and the Representation of the People Act, 1951. <\/span><\/p>\n<p>&nbsp;<\/p>\n<h4><span style=\"color: #0000ff;\">Key Amendment:<\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">In section 23 of the 1950 Act, <\/span><span dir=\"ltr\" role=\"presentation\">the following sub-sections <\/span><span dir=\"ltr\" role=\"presentation\">shall be inserted, namely:\u2014<\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">4<\/span><span dir=\"ltr\" role=\"presentation\">) The electoral registration officer may for the purpose of establishing the <\/span><span dir=\"ltr\" role=\"presentation\">identity of any person require that such person may furnish the Aadhaar number <\/span><span dir=\"ltr\" role=\"presentation\">given by the Unique Identification Authority of India as per the provisions of the <\/span><span dir=\"ltr\" role=\"presentation\">Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) <\/span><span dir=\"ltr\" role=\"presentation\">Act, 2016:<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided that the electoral registration officer may also require the Aadhaar <\/span><span dir=\"ltr\" role=\"presentation\">number from persons already included in the electoral roll for the purposes of <\/span><span dir=\"ltr\" role=\"presentation\">authentication of entries in electoral roll and to identify registration of name of the <\/span><span dir=\"ltr\" role=\"presentation\">same person in the electoral roll of more than one constituency or more than once in <\/span><span dir=\"ltr\" role=\"presentation\">the same constituency.<\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">5<\/span><span dir=\"ltr\" role=\"presentation\">) Every person whose name is included in the electoral roll may intimate his <\/span><span dir=\"ltr\" role=\"presentation\">Aadhaar number to such authority in such form and manner as may be prescribed, on <\/span><span dir=\"ltr\" role=\"presentation\">or before a date to be notified by the Central Government in the Official Gazette.<\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">6<\/span><span dir=\"ltr\" role=\"presentation\">) No application for inclusion of name in the electoral roll shall be denied and <\/span><span dir=\"ltr\" role=\"presentation\">no entries in the electoral roll shall be deleted for inability of an individual to furnish <\/span><span dir=\"ltr\" role=\"presentation\">or intimate Aadhaar number due to such sufficient cause as may be prescribed:<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Provided that such individual may be allowed to furnish such other alternate <\/span><span dir=\"ltr\" role=\"presentation\">documents as may be prescribed.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Explanation.<\/span><span dir=\"ltr\" role=\"presentation\">\u2014For the purposes of this section, the expression &#8220;Aadhaar <\/span><span dir=\"ltr\" role=\"presentation\">number&#8221; shall have the same meaning as assigned to it in clause (<\/span><span dir=\"ltr\" role=\"presentation\">a<\/span><span dir=\"ltr\" role=\"presentation\">) of section 2 of the <\/span><span dir=\"ltr\" role=\"presentation\">Aadhaar (Targeted Delivery of Financial and Other
