{"id":259100,"date":"2021-12-27T11:30:06","date_gmt":"2021-12-27T06:00:06","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=259100"},"modified":"2021-12-27T11:59:05","modified_gmt":"2021-12-27T06:29:05","slug":"surrogacy-regulation-act-2021","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/12\/27\/surrogacy-regulation-act-2021\/","title":{"rendered":"Surrogacy (Regulation) Act, 2021"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page121R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">On December 25, 2021, the Surrogacy (Regulation) Act, 2021 received President&#8217;s assent in order to regulate the practice and process of surrogacy, constitute National Assisted Reproductive Technology and Surrogacy Board, <\/span><span dir=\"ltr\" role=\"presentation\">State Assisted Reproductive Technology and Surrogacy Boards.\u00a0 <\/span><\/span><\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Key features of the Act:<\/span><\/h4>\n<p style=\"text-align: justify; padding-left: 40px;\"><span id=\"page7R_mcid0\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">I. Prohibition <\/span><span dir=\"ltr\" role=\"presentation\">and regulation <\/span><span dir=\"ltr\" role=\"presentation\">of surrogacy <\/span><\/strong><span dir=\"ltr\" role=\"presentation\"><strong>clinics:<\/strong><br \/>\n<\/span><\/span><span id=\"page7R_mcid0\" class=\"markedContent\"><\/span><span id=\"page7R_mcid0\" class=\"markedContent\"><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li><span id=\"page7R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">No surrogacy clinic, unless registered under this Act, shall conduct or <\/span><span dir=\"ltr\" role=\"presentation\">associate with, or help in any manner, in conducting activities relating to surrogacy <\/span><span dir=\"ltr\" role=\"presentation\">and surrogacy procedures;<\/span> or <span dir=\"ltr\" role=\"presentation\">employ or cause to be employed or take services <\/span><span dir=\"ltr\" role=\"presentation\">of any person, whether on honorary basis or on payment, who does not possess <\/span><span dir=\"ltr\" role=\"presentation\">such qualifications as may be prescribed<\/span>.<\/span><\/li>\n<li><span id=\"page7R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">No surrogacy clinic, paediatrician, gynaecologist, embryologist, registered <\/span><span dir=\"ltr\" role=\"presentation\">medical practitioner or any person shall conduct, offer, undertake, promote or <\/span><span dir=\"ltr\" role=\"presentation\">associate with or avail of commercial surrogacy in any form; or<\/span><\/span><span id=\"page7R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"> store a human <\/span><span dir=\"ltr\" role=\"presentation\">embryo or gamete for the purpose of surrogacy except storage for other legal purposes like sperm banks, IVF and medical research; or <\/span><span dir=\"ltr\" role=\"presentation\">conduct or cause to be conducted sex selection for surrogacy<\/span>. <\/span><span id=\"page10R_mcid0\" class=\"markedContent\"><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify; padding-left: 40px;\"><strong><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">II. Regulation of <\/span><span dir=\"ltr\" role=\"presentation\">surrogacy and <\/span><span dir=\"ltr\" role=\"presentation\">surrogacy <\/span><span dir=\"ltr\" role=\"presentation\">procedures: <\/span><\/span><\/strong><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">N<\/span><\/span><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">o surrogacy or surrogacy procedures shall be conducted, undertaken, <\/span><\/span><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">performed or availed of, except for the following purpose:<br \/>\n<\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">when an intending couple has a medical indication necessitating <\/span><span dir=\"ltr\" role=\"presentation\">gestational surrogacy p<\/span><span dir=\"ltr\" role=\"presentation\">rovided that a couple of Indian origin or an intending woman who intends <\/span><span dir=\"ltr\" role=\"presentation\">to avail surrogacy, shall obtain a certificate of recommendation from the Board <\/span><span dir=\"ltr\" role=\"presentation\">on an application made by the said persons in such form and manner as may be <\/span><span dir=\"ltr\" role=\"presentation\">prescribed.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Note: \u201cgestational surrogacy\u201d means a practice <\/span><span dir=\"ltr\" role=\"presentation\">whereby a surrogate mother carries a child for the intending couple through <\/span><span dir=\"ltr\" role=\"presentation\">implantation of embryo in her womb and the child is not genetically related to <\/span><span dir=\"ltr\" role=\"presentation\">the surrogate mother;<\/span><\/span><\/li>\n<li><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">when it is only for altruistic surrogacy purposes;<\/span><\/span><\/li>\n<li><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">when it is not for commercial purposes or for commercialisation of <\/span><span dir=\"ltr\" role=\"presentation\">surrogacy or surrogacy procedures;<\/span><\/span><\/li>\n<li><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">when it is not for producing children for sale, prostitution or any <\/span><span dir=\"ltr\" role=\"presentation\">other form of exploitation.<br \/>\n<\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify; padding-left: 40px;\">III.\u00a0<span id=\"page13R_mcid0\" class=\"markedContent\"> <\/span><span id=\"page16R_mcid0\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Written <\/span><span dir=\"ltr\" role=\"presentation\">informed <\/span><span dir=\"ltr\" role=\"presentation\">consent of <\/span><span dir=\"ltr\" role=\"presentation\">surrogate <\/span><\/strong><span dir=\"ltr\" role=\"presentation\"><strong>mother: <\/strong>All known side effects and after effects of such procedures shall be informed to the surrogate mother concerned and also a written informed consent of the surrogate mother to undergo such procedures in the language she understands is required to obtain. <\/span><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">IV. <span id=\"page16R_mcid0\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Registration <\/span><span dir=\"ltr\" role=\"presentation\">of surrogacy <\/span><\/strong><span dir=\"ltr\" role=\"presentation\"><strong>clinics<\/strong>: No person shall establish any surrogacy clinic for undertaking surrogacy or to render surrogacy procedures in any form unless such clinic is duly registered under this Act. Every surrogacy clinic which is conducting surrogacy or surrogacy procedures, partly or exclusively, shall, within a period of sixty days from the date of appointment of appropriate authority, apply for registration.<\/span><\/span><\/p>\n<p style=\"padding-left: 40px;\">V. <span id=\"page19R_mcid0\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Establishment <\/span><span dir=\"ltr\" role=\"presentation\">of National <\/span><span dir=\"ltr\" role=\"presentation\">Assisted <\/span><span dir=\"ltr\" role=\"presentation\">Reproductive <\/span><span dir=\"ltr\" role=\"presentation\">Technology <\/span><span dir=\"ltr\" role=\"presentation\">and Surrogacy <\/span><\/strong><span dir=\"ltr\" role=\"presentation\"><strong>Registry:<\/strong> There shall be established a Registry to be called the National Assisted Reproductive Technology and Surrogacy Registry for the purposes of registration of surrogacy clinics under this
