Bill, 2021 introduced in Rajya Sabha"},"content":{"rendered":"<p style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">On December 20, 2021, a Mediation Bill (Bill No. XLIII of 2021) has been introduced in Rajya Sabha with an object to<\/span><span dir=\"ltr\" role=\"presentation\"> promote and facilitate mediation, especially institutional mediation, for <\/span><span dir=\"ltr\" role=\"presentation\">resolution of disputes, commercial or otherwise, enforce mediated settlement agreements, <\/span><span dir=\"ltr\" role=\"presentation\">provide for a body for registration of mediators, to encourage community mediation and <\/span><span dir=\"ltr\" role=\"presentation\">to make online mediation as acceptable and cost effective process. <\/span><\/p>\n<p style=\"text-align: justify;\"><strong>Applicability<\/strong>:\u00a0<span dir=\"ltr\" role=\"presentation\"> shall apply where mediation is conducted in <\/span><span dir=\"ltr\" role=\"presentation\">India, and\u2014<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">i<\/span><span dir=\"ltr\" role=\"presentation\">) all or both parties habitually reside in or are incorporated in or have their place <\/span><span dir=\"ltr\" role=\"presentation\">of business in India; or<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">ii<\/span><span dir=\"ltr\" role=\"presentation\">) the mediation agreement provides that any dispute shall be resolved in <\/span><span dir=\"ltr\" role=\"presentation\">accordance with the provisions of this Act; or<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(<\/span><span dir=\"ltr\" role=\"presentation\">iii<\/span><span dir=\"ltr\" role=\"presentation\">) there is an international mediation<\/span>.<\/p>\n<h4 style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\"><span style=\"color: #000080;\">Key features of the Bill:<\/span> <\/span><\/h4>\n<ul>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">subsuming conciliation under Part III of the<\/span> <span dir=\"ltr\" role=\"presentation\">Arbitration and Conciliation <\/span><span dir=\"ltr\" role=\"presentation\">Act, 1996, in mediation as per international practice of using the terms \u201cconciliation\u201d <\/span><span dir=\"ltr\" role=\"presentation\">and \u201cmediation\u201d interchangeably;<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">compulsory pre-litigation mediation in matters of civil or commercial dispute, <\/span><span dir=\"ltr\" role=\"presentation\">before parties approach a court or a tribunal as provided;<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">conduct of online mediation;<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">an indicative list of matters which are not fit for mediation under the First <\/span><span dir=\"ltr\" role=\"presentation\">Schedule;<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">mediation that will take place within the territorial jurisdiction of the court or <\/span><span dir=\"ltr\" role=\"presentation\">tribunal of competent jurisdiction, unless parties agree otherwise or undertake mediation <\/span><span dir=\"ltr\" role=\"presentation\">in online mode;<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">a period of one hundred and eighty days, for completing the mediation <\/span><span dir=\"ltr\" role=\"presentation\">process which is further extendable to a maximum period of one hundred and eighty <\/span><span dir=\"ltr\" role=\"presentation\">days with the mutual consent of the parties;<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">the mediated settlement agreement resulting from mediation which will be <\/span><span dir=\"ltr\" role=\"presentation\">final and binding and will be enforceable in accordance with the provisions of Code of <\/span><span dir=\"ltr\" role=\"presentation\">Civil Procedure, 1908, in the same manner as if it were a judgment or decree of a Court;<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">establishment of Mediation Council of India, objects of which would be, <\/span><span dir=\"ltr\" role=\"presentation\">inter alia<\/span><span dir=\"ltr\" role=\"presentation\">, to promote mediation and to develop India as a robust centre for domestic <\/span><span dir=\"ltr\" role=\"presentation\">and international mediation, make regulations for registration of mediators, grade <\/span><span dir=\"ltr\" role=\"presentation\">mediation service providers, specify criteria for recognition of mediation institutes and <\/span><span dir=\"ltr\" role=\"presentation\">mediation service providers, to hold training workshops and courses in the area of <\/span><span dir=\"ltr\" role=\"presentation\">mediation, etc.; and<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\" role=\"presentation\">conduct of community mediation with consent of parties for disputes which <\/span><span dir=\"ltr\" role=\"presentation\">are likely to affect peace, harmony and tranquility amongst the residents or families of <\/span><span dir=\"ltr\"
