{"id":258607,"date":"2021-12-16T14:30:48","date_gmt":"2021-12-16T09:00:48","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=258607"},"modified":"2021-12-16T13:33:57","modified_gmt":"2021-12-16T08:03:57","slug":"usa-temporary-waiver-of-60-day-rule-for-report-of-medical-examination-and-vaccination-record-form-i-693","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/12\/16\/usa-temporary-waiver-of-60-day-rule-for-report-of-medical-examination-and-vaccination-record-form-i-693\/","title":{"rendered":"USA | Temporary Waiver of \u201c60-Day Rule\u201d for Report of Medical Examination and Vaccination Record (Form I-693)"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page136R_mcid11\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">On December 10, 2021, the U.S.<\/span><\/span><span id=\"page136R_mcid12\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">Citizenship and Immigration Services (USCIS) has issued a notice stating temporarily waiving of the requirement that the <\/span><span dir=\"ltr\" role=\"presentation\">civil surgeon\u2019s signature on the Report of Medical Examination and Vaccination Record (<\/span><\/span><a href=\"https:\/\/www.uscis.gov\/i-693\"><span id=\"page136R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Form<\/span><\/span><span id=\"page136R_mcid14\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">I<\/span><\/span><span id=\"page136R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211; <\/span><\/span><span id=\"page136R_mcid16\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">693<\/span><\/span><\/a><span id=\"page136R_mcid17\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">)<\/span><\/span><span id=\"page136R_mcid18\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">be dated no more than 60 days before an applicant files the application for the underlying <\/span><span dir=\"ltr\" role=\"presentation\">immigration benefit.<\/span><\/span><span id=\"page136R_mcid19\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"page136R_mcid20\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">In general, those applying for immigration benefits while in the United States must use Form I-693 to <\/span><span dir=\"ltr\" role=\"presentation\">show they are free from any conditions that would render them inadmissible under the health-related <\/span><span dir=\"ltr\" role=\"presentation\">grounds.<\/span><\/span><span id=\"page136R_mcid22\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Currently, USCIS considers a completed Form I-693 to retain its evidentiary value for 2 <\/span><span dir=\"ltr\" role=\"presentation\">years after the date the civil surgeon signed, as long as the date of the civil surgeon\u2019s signature is no <\/span><span dir=\"ltr\" role=\"presentation\">more than 60 days before the applicant filed the application for the underlying immigration benefit. <\/span><span dir=\"ltr\" role=\"presentation\">This is commonly referred to as the \u201c60-day rule.\u201d<\/span><\/span><span id=\"page136R_mcid23\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span id=\"page136R_mcid23\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Due to the COVID-19 pandemic and related processing delays, USCIS has experienced delays in all <\/span><span dir=\"ltr\" role=\"presentation\">aspects of operations. Applicants have also experienced difficulties beyond their control, including <\/span><span dir=\"ltr\" role=\"presentation\">delays with completing the immigration medical examination. To address these issues, USCIS is <\/span><span dir=\"ltr\" role=\"presentation\">temporarily waiving the requirement that the civil surgeon\u2019s signature be dated no more than 60 days <\/span><span dir=\"ltr\" role=\"presentation\">before the applicant files the application for the underlying immigration benefit.<\/span><\/span><span id=\"page136R_mcid24\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"page136R_mcid24\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">This temporary waiver, effective December 9, 2021 until September 30, 2022, applies to all Forms I<\/span><\/span><span id=\"page136R_mcid25\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211; <\/span><\/span><span id=\"page136R_mcid26\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">693 associated with applications for underlying immigration benefits that have not been adjudicated, <\/span><span dir=\"ltr\" role=\"presentation\">regardless of when the application was submitted or when the Form I-693 was signed.
