complaint against an entity for failure to comply with the Act.<\/p>\n<p><span id=\"page13R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u00a0<\/span><\/span><\/p>\n<p><strong>Key Highlights:<\/strong><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page13R_mcid11\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Manner of appointment, qualification <\/span> <\/strong><span dir=\"ltr\" role=\"presentation\"><strong>and experience of the Adjudicating Officer<\/strong>.<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span>\u00a0<\/span><span id=\"page13R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Adjudicating <\/span><\/span><span id=\"page13R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Officer shall be appointed by the Authority <\/span><\/span><span id=\"page13R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">who shall<\/span><\/span><span id=\"page13R_mcid16\" class=\"markedContent\"> <\/span><span id=\"page13R_mcid17\" class=\"markedContent\"><\/span><span id=\"page13R_mcid18\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">b<\/span><span dir=\"ltr\" role=\"presentation\">e an officer not below the rank of Joint Secretary to the Government of India;<\/span> <\/span><span id=\"page13R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">possess working experience of ten years or more in the Central Government or State Government or <\/span><span dir=\"ltr\" role=\"presentation\">Public Sector Undertaking or Union territory administration or Autonomous or Statutory Organisation on <\/span><span dir=\"ltr\" role=\"presentation\">regular basis; and<\/span> <\/span><span id=\"page13R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">possess administrative or techn<\/span><span dir=\"ltr\" role=\"presentation\">ical knowledge in any of the disciplines of law, management,\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">information technology or commerce with at least three years of experience in this regard.<\/span> <\/span><span id=\"page13R_mcid21\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page13R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>Manner of making complaint to the Adjudicating Officer<\/strong>:<\/span>\u00a0<span dir=\"ltr\" role=\"presentation\">The complaint shall be <\/span><span dir=\"ltr\" role=\"presentation\">made to the <\/span><span dir=\"ltr\" role=\"presentation\">Adjudica<\/span><span dir=\"ltr\" role=\"presentation\">ting Officer by the Authority<\/span><span dir=\"ltr\" role=\"presentation\"> in a manner which clearly <\/span><span dir=\"ltr\" role=\"presentation\">indicates the nature of contravention, relevant provision of the Act or rule or regulation or direction issued by the <\/span><span dir=\"ltr\" role=\"presentation\">Authority and the maximum penalty <\/span> <span dir=\"ltr\" role=\"presentation\">which can be imposed on the person or entity and as far as possible, the timing, <\/span><span dir=\"ltr\" role=\"presentation\">place of contravention along with documents in support of such contravention.<\/span> <\/span><span id=\"page13R_mcid22\" class=\"markedContent\"><\/span><span id=\"page13R_mcid24\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page13R_mcid24\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>Manner of holding inquiry into the complaint<\/strong>: <\/span><span dir=\"ltr\" role=\"presentation\">The Adjudicating Officer, before adjudging penalty, must <\/span><span dir=\"ltr\" role=\"presentation\">issue a notice to the person or entity alleged to have com<\/span><span dir=\"ltr\" role=\"presentation\">mitted the contravention, requiring him or it to show cause, <\/span><span dir=\"ltr\" role=\"presentation\">within such period as the notice may specify (being not less than thirty days from the date of service thereon), as to <\/span><span dir=\"ltr\" role=\"presentation\">why the penalty should not be imposed on him or it.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page15R_mcid11\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Form and manner of appeal against the or<\/span><span dir=\"ltr\" role=\"presentation\">der of the Adjudicating Officer: <\/span><\/strong><span dir=\"ltr\" role=\"presentation\">Every appeal against the order of <\/span><\/span><br role=\"presentation\" \/><span id=\"page15R_mcid11\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u00a0the Adjudicating Officer must be filed in writing before the Telecom Disputes Settlement and Appellate Tribunal as <\/span><\/span><br role=\"presentation\" \/><span id=\"page15R_mcid11\" class=\"markedContent\"><\/span><span id=\"page15R_mcid11\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">per Form \u2018A\u2019. <\/span> <\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page15R_mcid12\" class=\"markedContent\"><\/span><span id=\"page15R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>Fee for filing appeal<\/strong>: <\/span><span dir=\"ltr\" role=\"presentation\">The fee to be accompanied with an a<\/span><span dir=\"ltr\" role=\"presentation\">ppeal filed must <\/span><\/span><span id=\"page15R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">be the same as specified under the Telecom Disputes Settlement and Appellate Tribunal (Form,\u00a0 <\/span><\/span><span id=\"page15R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Verification and the Fee for filing an appeal) Rules, 2003 as amended from time<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\"
