They <span id=\"page3R_mcid79\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">shall come into force on the date of their publication in the Official Gazette.<\/span> <\/span><span id=\"page3R_mcid80\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><\/span><span id=\"page3R_mcid81\" class=\"markedContent\"><\/span><\/p>\n<p style=\"text-align: justify;\"><span id=\"page3R_mcid81\" class=\"markedContent\">Key features: <\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page3R_mcid86\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Inquiry of accidents<\/span><\/strong><span dir=\"ltr\" role=\"presentation\">: <\/span><span dir=\"ltr\" role=\"presentation\">On receipt of a report of an accident to a boiler or boiler component under section <\/span><span dir=\"ltr\" role=\"presentation\">18 of the Act,<\/span> <span dir=\"ltr\" role=\"presentation\">a preliminary inquiry shall be conducted in the concerned State in whose jurisdiction the\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">accident has occurred.<\/span> <\/span><span id=\"page3R_mcid87\" class=\"markedContent\"><\/span><\/li>\n<li><span id=\"page3R_mcid87\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>Accidents resulting in any death<\/strong>:<\/span> <span dir=\"ltr\" role=\"presentation\">The Chief Inspector of the concerned State in whose jurisdiction any <\/span><span dir=\"ltr\" role=\"presentation\">death has resulted due to the accide<\/span><span dir=\"ltr\" role=\"presentation\">nt , based on preliminary inquiry, shall forward a report without delay\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">to the Technical Adviser in Form<\/span>\u00a0<span dir=\"ltr\" role=\"presentation\">A<\/span><\/span><span id=\"page3R_mcid88\" class=\"markedContent\">.<\/span><\/li>\n<li><span id=\"page3R_mcid88\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Inquiry of accidents resulting in any death<\/span><\/strong><span dir=\"ltr\" role=\"presentation\">: <\/span><span dir=\"ltr\" role=\"presentation\">Without prejudice to rules, where any death has <\/span><span dir=\"ltr\" role=\"presentation\">resulted due to any accident, an inquiry shal<\/span><span dir=\"ltr\" role=\"presentation\">l also be conducted by the Central Government.<\/span><\/span><\/li>\n<li><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><strong>Constitution of inquiry committee<\/strong>: <\/span><span dir=\"ltr\" role=\"presentation\">(1)The inquiry shall be conducted by an inquiry committee\u00a0 <\/span><\/span><span id=\"page10R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">consisting of the following, namely:\u00a0<\/span> <\/span><span id=\"page10R_mcid1\" class=\"markedContent\"><\/span><br role=\"presentation\" \/><span id=\"page10R_mcid1\" class=\"markedContent\"><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page10R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(i)<\/span> <span dir=\"ltr\" role=\"presentation\">Technical Adviser <\/span><span dir=\"ltr\" role=\"presentation\">\u2013<\/span><span dir=\"ltr\" role=\"presentation\">Chairman;<\/span> <\/span><span id=\"page10R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(ii)<\/span> <span dir=\"ltr\" role=\"presentation\">a Chief Inspector or Director of Boiler <\/span><span dir=\"ltr\" role=\"presentation\">\u2013<\/span><span dir=\"ltr\" role=\"presentation\">Membe<\/span><span dir=\"ltr\" role=\"presentation\">r;<\/span> <\/span><span id=\"page10R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(iii)<\/span> <span dir=\"ltr\" role=\"presentation\">a representative of Boiler and boiler component manufacturer or user of boilers in the Board <\/span><\/span><span id=\"page10R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Member.<\/span> <\/span><span id=\"page10R_mcid4\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page10R_mcid5\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Note: The inquiry committee shall be constituted within fifteen days of receipt of report of accident <\/span><span dir=\"ltr\" role=\"presentation\">resulting in any death from the Chief Inspector of the concerned state and inquiry <\/span> <span dir=\"ltr\" role=\"presentation\">shall be conducted <\/span><span dir=\"ltr\" role=\"presentation\">within forty<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">five days of receipt of report of accident from the Chief Inspector.<\/span> <\/span><span id=\"page10R_mcid6\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page10R_mcid6\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Procedure during inquiry<\/span><\/strong><span dir=\"ltr\" role=\"presentation\">: <\/span><span dir=\"ltr\" role=\"presentation\">The inquiry committee shall make a careful examination of the damaged <\/span><span dir=\"ltr\" role=\"presentation\">parts and shall take such measurements or sketches <\/span> <span dir=\"ltr\" role=\"presentation\">and may take such photographs for the purpose of <\/span><span dir=\"ltr\" role=\"presentation\">report as they may deem necessary.<\/span> <\/span><span id=\"page10R_mcid7\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page10R_mcid8\" class=\"markedContent\"><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page10R_mcid8\" class=\"markedContent\"><strong><span dir=\"ltr\" role=\"presentation\">Use of Boiler after accident resulting in any death<\/span><\/strong><span dir=\"ltr\" role=\"presentation\">:<\/span>\u00a0<span dir=\"ltr\" role=\"presentation\">The boiler shall not be put to use till the inquiry <\/span><span dir=\"ltr\" role=\"presentation\">is completed.<\/span> <\/span><span id=\"page10R_mcid9\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The Central Government notified Boiler Accident Inquiry Rules, 2021.
