{"id":255544,"date":"2021-10-13T11:30:48","date_gmt":"2021-10-13T06:00:48","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=255544"},"modified":"2021-10-13T10:52:29","modified_gmt":"2021-10-13T05:22:29","slug":"government-notifies-medical-termination-of-pregnancy-amendment-rules-2021","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/10\/13\/government-notifies-medical-termination-of-pregnancy-amendment-rules-2021\/","title":{"rendered":"Government notifies Medical Termination of Pregnancy (Amendment) Rules, 2021"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page15R_mcid144\" class=\"markedContent\">T<\/span><span id=\"page15R_mcid146\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">he Central Government notified <span id=\"page15R_mcid152\" class=\"markedContent\">Medical Termination of Pregnancy (Amendment) Rules, 2021<\/span> to amend the Med<\/span><\/span><span id=\"page15R_mcid147\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">ical Termination of <\/span><\/span><span id=\"page15R_mcid148\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Pregnancy Rules, 2003.<\/span><\/span><span id=\"page15R_mcid150\" class=\"markedContent\"><\/span><span id=\"page15R_mcid152\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page15R_mcid155\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page15R_mcid156\" class=\"markedContent\"><\/span><span id=\"page15R_mcid160\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Key amendments in the Medical Termination of Pregnancy Rules, 2003 <\/span><\/span><span id=\"page15R_mcid170\" class=\"markedContent\">are as follows: <\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span id=\"page15R_mcid176\" class=\"markedContent\">Rule 3A dealing with powers and functions of Medical Board : <\/span><span id=\"page15R_mcid183\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">For the purposes of section 3,<\/span><\/span><span id=\"page15R_mcid184\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u2014<\/span><\/span><span id=\"page15R_mcid185\" class=\"markedContent\"> <\/span><span id=\"page15R_mcid186\" class=\"markedContent\"> <\/span><span id=\"page15R_mcid187\" class=\"markedContent\"><\/span><span id=\"page15R_mcid188\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span id=\"page15R_mcid188\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(a) the powers of the Medical Board shall be the following,<\/span><\/span><span id=\"page15R_mcid189\" class=\"markedContent\"> <\/span><span id=\"page15R_mcid190\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">namely:<\/span><\/span><span id=\"page15R_mcid191\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page15R_mcid192\" class=\"markedContent\"> <\/span><span id=\"page15R_mcid193\" class=\"markedContent\"> <\/span><span id=\"page15R_mcid194\" class=\"markedContent\"><\/span><span id=\"page15R_mcid195\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"padding-left: 80px; text-align: justify;\"><span id=\"page15R_mcid195\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(i) to allow or deny termination of pregnancy beyond twenty<\/span><\/span><span id=\"page15R_mcid196\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page15R_mcid197\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">four weeks of gestation period under sub<\/span><\/span><span id=\"page15R_mcid198\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page15R_mcid199\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">section <\/span><\/span><span id=\"page15R_mcid200\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(2B) of the said section only after due consideration and ensuring that the procedure would be safe for the <\/span><\/span><span id=\"page15R_mcid201\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">woman at that gestation age <\/span><\/span><span id=\"page15R_mcid202\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">and whether the foetal malformation has substantial risk of it being incompatible <\/span><\/span><span id=\"page15R_mcid203\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">with life or if the child is born it may suffer from such physical or mental abnormalities to be seriously <\/span><\/span><span id=\"page15R_mcid204\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">handicapped; <\/span><\/span><span id=\"page15R_mcid205\" class=\"markedContent\"> <\/span><span id=\"page15R_mcid206\" class=\"markedContent\"><\/span><span id=\"page15R_mcid207\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(ii) co<\/span><\/span><span id=\"page15R_mcid208\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page15R_mcid209\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">opt other specialists in the Board and ask fo<\/span><\/span><span id=\"page15R_mcid210\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">r any additional investigations if required, for deciding on the <\/span><\/span><span id=\"page15R_mcid211\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">termination of pregnancy; <\/span><\/span><span id=\"page15R_mcid212\" class=\"markedContent\"> <\/span><\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><span id=\"page22R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(b) the functions of the Medical Board shall be the following, namely :<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><span id=\"page22R_mcid1\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page22R_mcid2\" class=\"markedContent\"><\/span><\/p>\n<p style=\"text-align: justify; padding-left: 80px;\"><span id=\"page22R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(i) to examine the woman and her reports, who may approach for medical termination of preg<\/span><span dir=\"ltr\" role=\"presentation\">nancy<\/span><span dir=\"ltr\" role=\"presentation\">;<\/span> <\/span><span id=\"page22R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(ii) provide the opinion of Medical Board in Form D with regard to the termination of pregnancy or rejection of\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">request for termination within three days of receiving the request for medical termination of pregnan<\/span><span dir=\"ltr\" role=\"presentation\">cy<\/span><span dir=\"ltr\" role=\"presentation\">;<\/span> <\/span><span id=\"page22R_mcid4\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(iii) to ensure that the termination procedure, when advised by the Medical Board, is carried out with all safety\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">precautions along with appropriate counselling within five days of the receipt of the request for medi<\/span><span dir=\"ltr\" role=\"presentation\">cal <\/span><span dir=\"ltr\" role=\"presentation\">termination of pregnancy<\/span><span dir=\"ltr\" role=\"presentation\">.<\/span> <\/span><span id=\"page22R_mcid5\" class=\"markedContent\"><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page22R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">3B. Women eligible for termination of pregnancy up to twenty<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">four weeks.<\/span><span dir=\"ltr\" role=\"presentation\">\u2014<\/span> <\/span><span id=\"page22R_mcid6\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">The following categories of women shall be considered eligible for termination of pregnancy<\/span><span dir=\"ltr\" role=\"presentation\"> for a period of up to twenty<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">four weeks, namely:<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><span id=\"page22R_mcid7\" class=\"markedContent\"><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span id=\"page22R_mcid7\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(a)<\/span> <span dir=\"ltr\" role=\"presentation\">survivors of sexual assault or rape or incest;<\/span> <\/span><span id=\"page22R_mcid8\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(b)<\/span> <span dir=\"ltr\" role=\"presentation\">minors;<\/span> <\/span><span id=\"page22R_mcid9\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(c)<\/span> <span dir=\"ltr\" role=\"presentation\">change of marital status during the ongoing pregnancy (widowhood and divorce);<\/span> <\/span><span id=\"page22R_mcid10\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(d)<\/span> <span dir=\"ltr\" role=\"presentation\">women with physical disabilities [maj<\/span><span dir=\"ltr\" role=\"presentation\">or disability as per criteria laid down under the Rights of Persons with <\/span><span dir=\"ltr\" role=\"presentation\">Disabilities Act, 2016 (49 of 2016)]; <\/span> <\/span><span id=\"page22R_mcid11\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(e)<\/span> <span dir=\"ltr\" role=\"presentation\">mentally ill women including mental retardation;<\/span> <\/span><span id=\"page22R_mcid12\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(f)<\/span> <span dir=\"ltr\" role=\"presentation\">the foetal malformation that has substantial risk of being incompatible with life or if the chi<\/span><span dir=\"ltr\" role=\"presentation\">ld is born it may\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">suffer from such physical or mental abnormalities to be seriously handicapped; and <\/span> <\/span><span id=\"page22R_mcid13\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(g)<\/span> <span dir=\"ltr\" role=\"presentation\">women with pregnancy in humanitarian settings or disaster or emergency situations as may be declared by\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">the Government.\u201d\u00a0<\/span> <\/span><span id=\"page22R_mcid14\" class=\"markedContent\"><\/span><span id=\"page22R_mcid15\" class=\"markedContent\"><\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><span id=\"page22R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In rule 4 of the said rules,<\/span><\/span><span id=\"page22R_mcid16\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u2014<\/span><\/span><span id=\"page22R_mcid17\" class=\"markedContent\"> <\/span><span id=\"page22R_mcid18\" class=\"markedContent\"><\/span><span id=\"page22R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">in clause (c) sub<\/span><\/span><span id=\"page22R_mcid20\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page22R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">clause (ii), for the words \u201ctwenty<\/span><\/span><span id=\"page22R_mcid22\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page22R_mcid23\" class=\"markedContent\"> <\/span><span id=\"page22R_mcid24\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">weeks\u201d, the words \u201ctwenty <\/span><\/span><span id=\"page22R_mcid25\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u2013<\/span><\/span><span id=\"page22R_mcid26\" class=\"markedContent\"> <\/span><span id=\"page22R_mcid27\" class=\"markedContent\"> <span dir=\"ltr\" role=\"presentation\">four weeks\u201d shall be <\/span><\/span><span id=\"page22R_mcid28\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">substituted;<\/span><\/span><span id=\"page22R_mcid29\" class=\"markedContent\"> <\/span><\/li>\n<li><span id=\"page22R_mcid30\" class=\"markedContent\">Rule 4 sub clause<\/span><span id=\"page22R_mcid31\" class=\"markedContent\"><\/span><span id=\"page22R_mcid39\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(ca) is inserted. The provision provides the experience of Registered Medical Practioner:<br \/>\n<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page22R_mcid39\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"> A Registered Medical Practitioner shall have the fo<\/span><\/span><span id=\"page22R_mcid40\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">llowing <\/span><span dir=\"ltr\" role=\"presentation\">experience <\/span><span dir=\"ltr\" role=\"presentation\">and <\/span><span dir=\"ltr\" role=\"presentation\">training <\/span><span dir=\"ltr\" role=\"presentation\">for <\/span><span dir=\"ltr\" role=\"presentation\">conducting <\/span><\/span><span id=\"page22R_mcid41\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">termination of pregnancy upto nine weeks of gestation period by medical methods of abortion, namely:<\/span><\/span><span id=\"page22R_mcid42\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><\/span><span id=\"page22R_mcid43\" class=\"markedContent\"> <\/span><span id=\"page22R_mcid44\" class=\"markedContent\"><\/span><span id=\"page22R_mcid45\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(i) experience at any hospital for a period of not less than three months in the practice of obstetrics and<\/span><\/span><span id=\"page22R_mcid46\" class=\"markedContent\"> <\/span><span id=\"page22R_mcid47\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">gynaecology; or <\/span><\/span><span id=\"page22R_mcid48\" class=\"markedContent\"> <\/span><span id=\"page22R_mcid49\" class=\"markedContent\"><\/span><span id=\"page22R_mcid50\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(ii) has independently performed ten cases of pregnancy termination by medical methods of abortion under <\/span><\/span><span id=\"page22R_mcid51\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">the supervision of a Registered Medical Practitioner in a hospital established or maintained, or a training <\/span><\/span><span id=\"page22R_mcid52\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">institute approved for th<\/span><\/span><span id=\"page22R_mcid53\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">is purpose, by the Government.\u201d. <\/span><\/span><span id=\"page22R_mcid54\" class=\"markedContent\"> <\/span><span id=\"page22R_mcid55\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page22R_mcid56\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page22R_mcid75\" class=\"markedContent\"> <\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Central Government notified Medical Termination of Pregnancy (Amendment) Rules, 2021 to
