{"id":254540,"date":"2021-09-22T10:38:13","date_gmt":"2021-09-22T05:08:13","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=254540"},"modified":"2021-09-22T10:40:23","modified_gmt":"2021-09-22T05:10:23","slug":"patents-amendment-rules-2021","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/09\/22\/patents-amendment-rules-2021\/","title":{"rendered":"Patents (Amendment) Rules, 2021"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page5R_mcid47\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Central Government\u00a0 makes the <\/span><span dir=\"ltr\" role=\"presentation\"><span id=\"page5R_mcid48\" class=\"markedContent\">Patents (Amendment) Rules, 2021<\/span>\u00a0 to amend the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/d79WSFQf\">Patents Rules, 2003<\/a>. <\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #0000ff;\">Key Amendments:<\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page5R_mcid50\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In the Patents Rules, 2003, t<\/span><span dir=\"ltr\" role=\"presentation\">he following definition has been inserted, namely:<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><span id=\"page5R_mcid51\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page5R_mcid51\" class=\"markedContent\" style=\"color: #008080;\"><span dir=\"ltr\" role=\"presentation\">\u201c(ca) \u201ceducational institution\u201d means a university established or incorporated by or under Central <\/span><span dir=\"ltr\" role=\"presentation\">Act, a Provincial Act, or a State Act, an<\/span><span dir=\"ltr\" role=\"presentation\">d includes any other educational institution as recognised <\/span><span dir=\"ltr\" role=\"presentation\">by an authority designated by the Central Government or the State Government or the Union <\/span><span dir=\"ltr\" role=\"presentation\">territories in this regard\u201d.<\/span> <\/span><span id=\"page5R_mcid52\" class=\"markedContent\"><\/span><\/p>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page5R_mcid52\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In the principal rules, in rule 7,<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page5R_mcid53\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(i) in sub<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">rule (1), for the second provi<\/span><span dir=\"ltr\" role=\"presentation\">so, the following proviso shall be substituted, <\/span> <\/span><span id=\"page5R_mcid54\" class=\"markedContent\"><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page5R_mcid54\" class=\"markedContent\"><br role=\"presentation\" \/><span style=\"color: #008080;\"><span dir=\"ltr\" role=\"presentation\">\u201cProvided further that in the case of a small entity, or startup, or educational institution, every <\/span><span dir=\"ltr\" role=\"presentation\">document for which a fee has been specified shall be accompanied by Form<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">28.\u201d;<\/span> <\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page5R_mcid55\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">(ii) for sub<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">rule (3<\/span><span dir=\"ltr\" role=\"presentation\">), the following sub<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">rule shall be substituted, namely:<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><span id=\"page5R_mcid56\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page5R_mcid56\" class=\"markedContent\"><span style=\"color: #008080;\"><span dir=\"ltr\" role=\"presentation\">\u201c(3) In case an application processed by a natural person, startup, small entity or educational <\/span><span dir=\"ltr\" role=\"presentation\">institution is fully or partly transferred to a person other than a natural person, startup, small ent<\/span><span dir=\"ltr\" role=\"presentation\">ity <\/span><span dir=\"ltr\" role=\"presentation\">or educational institution, the difference, if any, in the scale of fees between the fees charged from <\/span><span dir=\"ltr\" role=\"presentation\">the natural person, startup, small entity or educational institution and the fees chargeable from the <\/span><span dir=\"ltr\" role=\"presentation\">person other than a natural person, startup, sm<\/span><span dir=\"ltr\" role=\"presentation\">all entity or educational institution, shall be paid by <\/span><\/span><span dir=\"ltr\" role=\"presentation\"><span style=\"color: #008080;\">the new applicant along with the request for transfer.&#8221;<\/span><br \/>\n<\/span><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li>Schedule 1 and 2 has been modified.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>The Central Government\u00a0 makes the Patents (Amendment) Rules, 2021\u00a0 to amend the Patents Rules, 2003. &nbsp;
