{"id":254401,"date":"2021-09-18T10:30:15","date_gmt":"2021-09-18T05:00:15","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=254401"},"modified":"2021-09-18T09:57:53","modified_gmt":"2021-09-18T04:27:53","slug":"amendments-to-rajasthan-compulsory-registration-of-marriages-act-2009-passed-by-rajasthan-assembly","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/09\/18\/amendments-to-rajasthan-compulsory-registration-of-marriages-act-2009-passed-by-rajasthan-assembly\/","title":{"rendered":"Amendments to Rajasthan Compulsory Registration of Marriages Act, 2009 passed by Rajasthan Assembly"},"content":{"rendered":"<p class=\"synopsis\" style=\"text-align: justify;\">On September 17, 2021, the Rajasthan Assembly passed the Compulsory Registration of Marriages (Amendment) Bill, 2021 in order to amend the Rajasthan Compulsory Registration of Marriages Act, 2009.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Key Amendments:<\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span id=\"page61R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Section 8 relating the duty to submit memorandum has been modified. It has been substituted with <\/span><\/span><span id=\"page61R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">the following :<\/span>\u00a0<\/span><span id=\"page61R_mcid3\" class=\"markedContent\" style=\"color: #0000ff;\"> <\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page61R_mcid3\" class=\"markedContent\" style=\"color: #0000ff;\"><span dir=\"ltr\" role=\"presentation\">(1) The parties to the marriage, or in case the\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">bridegroom has not completed the age of twenty one years <\/span><span dir=\"ltr\" role=\"presentation\">and\/or bride has not completed the age of eighteen years, <\/span><span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">parents or, as the case may be, guardian of the parties shall <\/span><span dir=\"ltr\" role=\"presentation\">be responsible<\/span> <span dir=\"ltr\" role=\"presentation\">to submit the memorandum, in such manner, <\/span><span dir=\"ltr\" role=\"presentation\">as may be prescribed, within a period of thirty days from the <\/span><span dir=\"ltr\" role=\"presentation\">date of solemnization of the marriage to the Registrar within <\/span><span dir=\"ltr\" role=\"presentation\">whose jurisdiction the marriage is solemnized, or the parties <\/span><span dir=\"ltr\" role=\"presentation\">to the marriage or either o<\/span><span dir=\"ltr\" role=\"presentation\">f them are <\/span> <span dir=\"ltr\" role=\"presentation\">residing for at least <\/span><span dir=\"ltr\" role=\"presentation\">thirty <\/span><span dir=\"ltr\" role=\"presentation\">days <\/span><span dir=\"ltr\" role=\"presentation\">before <\/span><span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">date <\/span><span dir=\"ltr\" role=\"presentation\">of <\/span><span dir=\"ltr\" role=\"presentation\">submission <\/span><span dir=\"ltr\" role=\"presentation\">of <\/span><span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">memorandum.<\/span><\/span><span id=\"page61R_mcid5\" class=\"markedContent\"><br role=\"presentation\" \/><span style=\"color: #0000ff;\"><span dir=\"ltr\" role=\"presentation\">(1<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">A) If, at any time,<\/span> <span dir=\"ltr\" role=\"presentation\">death of either of the parties\u00a0 <\/span><span dir=\"ltr\" role=\"presentation\">to <\/span><span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">marriage <\/span><span dir=\"ltr\" role=\"presentation\">or <\/span><span dir=\"ltr\" role=\"presentation\">of <\/span><span dir=\"ltr\" role=\"presentation\">both <\/span><span dir=\"ltr\" role=\"presentation\">occurs, <\/span><span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">surviving <\/span><span dir=\"ltr\" role=\"presentation\">party, <\/span><span dir=\"ltr\" role=\"presentation\">parents, adult child or, as the case may be, guardian of the <\/span><span dir=\"ltr\" role=\"presentation\">parties may submit the memorandum<\/span><span dir=\"ltr\" role=\"presentation\">, in such manner, as <\/span><span dir=\"ltr\" role=\"presentation\">may be prescribed, <\/span><span dir=\"ltr\" role=\"presentation\">to the Registrar within whose juri<\/span><span dir=\"ltr\" role=\"presentation\">sdiction t<\/span><span dir=\"ltr\" role=\"presentation\">he marriage is solemnized, or the surviving party, parents, <\/span><span dir=\"ltr\" role=\"presentation\">adult child or, as the case may be, guardian of the parties is <\/span><span dir=\"ltr\" role=\"presentation\">residing for at least thirty days before the date of submission <\/span><\/span><span dir=\"ltr\" role=\"presentation\"><span style=\"color: #0000ff;\">of the memorandum.<\/span> <\/span> <\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page52R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Section 2 clause (f) of the<\/span><span dir=\"ltr\" role=\"presentation\"> Rajasthan <\/span><span dir=\"ltr\" role=\"presentation\">C<\/span><span dir=\"ltr\" role=\"presentation\">ompulsory Registration of Marriages Act, <\/span> <span dir=\"ltr\" role=\"presentation\">2009<\/span>\u00a0<span dir=\"ltr\" role=\"presentation\"> substituted with the following:<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><span id=\"page52R_mcid13\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\"><span id=\"page52R_mcid13\" class=\"markedContent\" style=\"color: #0000ff;\"><span dir=\"ltr\" role=\"presentation\">(f) \u201cDistrict Marriage Registration Officer, <\/span><span dir=\"ltr\" role=\"presentation\">Additional <\/span><span dir=\"ltr\" role=\"presentation\">District <\/span><span dir=\"ltr\" role=\"presentation\">Marriage <\/span><span dir=\"ltr\" role=\"presentation\">Registration <\/span><span dir=\"ltr\" role=\"presentation\">Officer <\/span><span dir=\"ltr\" role=\"presentation\">and <\/span><span dir=\"ltr\" role=\"presentation\">Block Marriage Registration Officer\u201d mean the District <\/span><span dir=\"ltr\" role=\"presentation\">Marriage Registration Officer, Additional District Marriage <\/span><span dir=\"ltr\" role=\"presentation\">Registration <\/span><span dir=\"ltr\" role=\"presentation\">Officer <\/span><span dir=\"ltr\" role=\"presentation\">and <\/span><span dir=\"ltr\" role=\"presentation\">Block <\/span><span dir=\"ltr\" role=\"presentation\">Marriage <\/span><span dir=\"ltr\" role=\"presentation\">Registration <\/span><span dir=\"ltr\" role=\"presentation\">Officer respectively appointed under section 5;<\/span><\/span><\/p>\n<div class=\"canvasWrapper\" style=\"text-align:
