Can she claim compassionate appointment? SC explains"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Supreme Court<\/strong>: In a case where a woman had sought compassionate appointment after her mother\u2019s death in the year 2012, the bench of <strong>MR Shah*<\/strong> and Anirudhha Bose, JJ has held that the norms prevailing on the date of consideration of the application should be the basis of consideration of claim for compassionate appointment and since the word \u2018divorced daughter\u2019 has been added to Rule\u00a03 of\u00a0Karnataka\u00a0Civil Services (Appointment on Compassionate Grounds) Rules 1996\u00a0subsequently by Amendment, 2021, the respondent was not entitled to compassionate appointment.<\/p>\n<p style=\"text-align: justify;\"><strong><em>[<\/em><span style=\"color: #ff0000;\"><em>Note: <\/em><\/span><\/strong><em>Rule 2<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> and Rule 3<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> of the Rules 1996 do not include \u2018divorced daughter\u2019 as eligible for appointment on compassionate ground and even as \u2018dependent\u2019. The same was added to Rule 3 recently by Amendment, 2021.<\/em><strong><em>]<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">However, as straightforward as the case might look, the facts had a very interesting story to tell.<\/p>\n<ul style=\"text-align: justify;\">\n<li>The mother of the original writ petitioner, who was employed with the Government of Karnataka as Second Division Assistant at Mandya District Treasury, died on 25.03.2012. <em><strong>The respondent, at that time, was a married daughter.<\/strong><\/em><\/li>\n<li>Immediately on the death of the deceased employee, the respondent initiated the divorced proceedings under Section 13B of the Hindu Marriage Act, 1955 on 12.09.2012 for decree of divorce by mutual consent.<\/li>\n<li>By Judgment dated 20.03.2013, the Learned Principal Civil Judge, Mandya granted the decree of divorce by mutual consent.<\/li>\n<li>Immediately on the very next day i.e. on 21.03.2013, the respondent, on the basis of the decree of divorce by mutual consent applied for appointment on compassionate ground.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Taking note of the aforementioned chronology of dates and events, the Court opined that <em><strong>o<\/strong><strong><em>nl<\/em>y for the purpose of getting appointment on compassionate ground the decree of divorce by mutual consent has been obtained.<\/strong><\/em> Otherwise, as a married daughter she was not entitled to the appointment on compassionate ground.<\/p>\n<p style=\"text-align: justify;\">Interestingly, the High Court had directed the appointing authority to grant compassionate\u00a0\u00a0 appointment to the respondent after interpreting Rule 3 of the Rules, 1996 by putting \u201cdivorced daughter\u201d in the same class of an unmarried or widowed daughter.<\/p>\n<p style=\"text-align: justify;\">The said judgment was, however, erroneous as per the ruling in <strong>N.C. Santhosh v. State of Karnataka,\u00a0<a href=\"http:\/\/www.scconline.com\/DocumentLink\/q4eze216\">(2020) 7 SCC 617<\/a>, <\/strong>wherein it was held that<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(i) the compassionate appointment is an exception to the general rule;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(ii) no aspirant has a right to compassionate appointment;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(iii) the appointment to any public post in the service of the State has to be made on the basis of the principle in accordance with Articles 14 and 16 of the Constitution of India;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(iv) appointment on compassionate ground can be made only on fulfilling the norms laid down by the State\u2019s policy and\/or satisfaction of the eligibility criteria as per the policy;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\"><strong>(v) the norms prevailing on the date of the consideration of the application should be the basis for consideration of claim for compassionate appointment.<\/strong><\/p>\n<p style=\"text-align: justify;\">Taking note of point number (v), the Court said that,<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><em>\u201c\u2026 only \u2018unmarried daughter\u2019 and \u2018widowed daughter\u2019 who were dependent upon the deceased female Government servant at the time of her death and living with her can be said to be \u2018dependent\u2019 of a deceased Government servant and that \u2018an unmarried daughter\u2019 and \u2018widowed daughter\u2019 only can be said to be eligible for appointment on compassionate ground in the case of death of the female Government servant.\u201d<\/em><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Calling the High Court\u2019s decision erroneous, the Court said that<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201c\u2026<strong><em>even if it is assumed that the \u2018divorced daughter\u2019 may fall in the same class of \u2018unmarried daughter\u2019 and \u2018widowed daughter\u2019 in that case also the date on which the deceased employee died, the respondent herein was not the \u2018divorced daughter\u2019 as she obtained\u00a0 the divorce by mutual consent subsequent to the death of the deceased employee.<\/em><\/strong>\u201d<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Hence, the respondent shall not be eligible for the appointment on compassionate ground on the death of her mother and deceased employee.<\/p>\n<p style=\"text-align: justify;\">[Director of Treasuries in Karnataka v. V. Somyashree, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/7sW6ncP5\"><b>2021 SCC OnLine SC 704<\/b><\/a>, decided on 13.09.2021]<\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> 2. \u00a0 Definitions:\u00ad<\/p>\n<p style=\"text-align: justify;\">(1) \u00a0 In \u00a0 these \u00a0 rules, unless\u00a0the\u00a0context\u00a0otherwise\u00a0requires:\u00ad<\/p>\n<p style=\"text-align: justify;\">(a) \u201cDependent \u00a0 of \u00a0 a \u00a0 deceased \u00a0 Government servant\u201d\u00a0means\u00ad<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(i) in \u00a0 the \u00a0 case \u00a0 of \u00a0 deceased \u00a0 male \u00a0 Government servant,\u00a0his\u00a0widow,\u00a0son,\u00a0(unmarried\u00a0daughter and\u00a0widowed\u00a0daughter)\u00a0who\u00a0were\u00a0dependent upon\u00a0him;\u00a0and\u00a0were\u00a0living\u00a0with\u00a0him;\u00a0and<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(ii) in\u00a0the\u00a0case\u00a0of\u00a0a\u00a0deceased\u00a0female\u00a0Government servant, \u00a0 her \u00a0 widower, \u00a0 son, \u00a0 (unmarried daughter \u00a0 and \u00a0 widowed \u00a0 daughter) \u00a0 who \u00a0 were dependent\u00a0upon\u00a0her\u00a0and\u00a0were\u00a0living\u00a0with\u00a0her;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(iii) \u2018family\u2019\u00a0in\u00a0relation\u00a0to\u00a0a\u00a0deceased\u00a0Government servant\u00a0means\u00a0his\u00a0or\u00a0her\u00a0spouse\u00a0and\u00a0their son, \u00a0 (unmarried \u00a0 daughter \u00a0 and \u00a0 widowed daughter)\u00a0who\u00a0were\u00a0living\u00a0with\u00a0him.<\/p>\n<p style=\"text-align: justify;\">(2) \u00a0 \u00a0 Words \u00a0 and \u00a0 expressions \u00a0 used \u00a0 but \u00a0 not defined\u00a0shall\u00a0have\u00a0the\u00a0same\u00a0meaning\u00a0assigned to \u00a0 them \u00a0 in \u00a0 the \u00a0 Karnataka \u00a0 Civil \u00a0 Services (General\u00a0Recruitment)\u00a0Rules,\u00a01977.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref2\" name=\"_ftn2\">[2]<\/a> Rule\u00a03(2)(ii):\u00ad<\/p>\n<p style=\"text-align: justify;\">(ii) \u00a0 in the case of the deceased female Government\u00a0servant;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(a) a\u00a0son;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(b) an \u00a0 unmarried \u00a0 daughter, \u00a0 if \u00a0 the \u00a0 son \u00a0 is \u00a0 not eligible\u00a0or\u00a0for\u00a0any\u00a0valid\u00a0reason\u00a0he\u00a0is\u00a0not\u00a0willing to\u00a0accept\u00a0the\u00a0appointment;<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(c) the\u00a0widower,\u00a0if\u00a0the\u00a0son\u00a0and\u00a0daughter\u00a0are\u00a0not eligible\u00a0or\u00a0for\u00a0any\u00a0valid\u00a0reason\u00a0they\u00a0are\u00a0not willing\u00a0to\u00a0accept\u00a0the\u00a0appointment.<\/p>\n<p style=\"text-align: justify; padding-left: 40px;\">(d) a\u00a0widowed\u00a0daughter,\u00a0if\u00a0the\u00a0widower,\u00a0son\u00a0and unmarried\u00a0daughter\u00a0are\u00a0not\u00a0eligible\u00a0or\u00a0for\u00a0any valid\u00a0reason\u00a0they\u00a0are\u00a0not\u00a0willing\u00a0to\u00a0accept\u00a0the appointment.<\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><strong>*Judgment by: Justice MR Shah<\/strong><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"NRWdsEFWbb\"><p><a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/05\/16\/know-thy-judge-justice-m-r-shah\/\">Know Thy Judge | Justice M.
