The Act amends the state&#8217;s data breach notification laws under Texas Business and Commerce Code \u00a7521.053.<\/p>\n<\/div>\n<h3><span style=\"color: #800000;\">Key Highlights:<\/span><\/h3>\n<div class=\"field-item even\">\n<ul style=\"text-align: justify;\">\n<li>Provision has modified to include new notification requirement i.e. organisations are required\u00a0 to include the number of affected residents that have been sent a disclosure of the breach by mail in their notifications;<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\">Notification must include the following:<\/p>\n<ol style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ol>\n<li><span dir=\"ltr\" role=\"presentation\">a<\/span> <span dir=\"ltr\" role=\"presentation\">detailed<\/span> <span dir=\"ltr\" role=\"presentation\">description<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">nature<\/span> <span dir=\"ltr\" role=\"presentation\">and <\/span><span dir=\"ltr\" role=\"presentation\">circumstances<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">breach<\/span> <span dir=\"ltr\" role=\"presentation\">or<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">use<\/span> <span dir=\"ltr\" role=\"presentation\">of<\/span> <span dir=\"ltr\" role=\"presentation\">sensitive<\/span> <span dir=\"ltr\" role=\"presentation\">personal <\/span><span dir=\"ltr\" role=\"presentation\">information acquired as a result of the breach;<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">number of residents of this state affected by <\/span><span dir=\"ltr\" role=\"presentation\">the breach at the time of notification;<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">number of affected residents that have been <\/span><span dir=\"ltr\" role=\"presentation\">sent a disclosure of the breach by mail or other direct method of <\/span><span dir=\"ltr\" role=\"presentation\">communication at the time of notification;<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">measures<\/span> <span dir=\"ltr\" role=\"presentation\">taken<\/span> <span dir=\"ltr\" role=\"presentation\">by<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">person<\/span> <span dir=\"ltr\" role=\"presentation\">regarding<\/span> <span dir=\"ltr\" role=\"presentation\">the <\/span><span dir=\"ltr\" role=\"presentation\">breach;<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">measures<\/span> <span dir=\"ltr\" role=\"presentation\">the<\/span> <span dir=\"ltr\" role=\"presentation\">person<\/span> <span dir=\"ltr\" role=\"presentation\">intends<\/span> <span dir=\"ltr\" role=\"presentation\">to<\/span> <span dir=\"ltr\" role=\"presentation\">take<\/span> <span dir=\"ltr\" role=\"presentation\">regarding the breach after the notification under this subsection; <\/span><span dir=\"ltr\" role=\"presentation\">and<\/span><\/li>\n<li><span dir=\"ltr\" role=\"presentation\">information<\/span> <span dir=\"ltr\" role=\"presentation\">regarding<\/span> <span dir=\"ltr\" role=\"presentation\">whether<\/span> <span dir=\"ltr\" role=\"presentation\">law <\/span><span dir=\"ltr\" role=\"presentation\">enforcement is engaged in investigating the breach.<\/span><\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li>Provision inserted requiring the Attorney General (&#8216;AG&#8217;) to post on their website a listing of the notifications received by their office, which must be updated no later than 30 days after the AG receives the notification of a new breach of system security; and<\/li>\n<li>Provision inserted to require AG to remove the notification no later than one year after the AG first published if the person who provided the notification has not notified the AG of
