{"id":251781,"date":"2021-07-27T12:32:22","date_gmt":"2021-07-27T07:02:22","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=251781"},"modified":"2021-07-27T12:32:22","modified_gmt":"2021-07-27T07:02:22","slug":"amendment-to-the-guidelines-for-technical-standards-for-the-performance-of-core-services-and-other-services-under-ibbi-information-utilities-regulations-2017-notified","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/07\/27\/amendment-to-the-guidelines-for-technical-standards-for-the-performance-of-core-services-and-other-services-under-ibbi-information-utilities-regulations-2017-notified\/","title":{"rendered":"Amendment to the Guidelines for Technical Standards for the Performance of Core Services and other Services under IBBI (Information Utilities) Regulations, 2017, notified"},"content":{"rendered":"<p style=\"text-align: justify;\">On July 26, 2021, the Insolvency and Bankruptcy Board of India (IBBI) on July 26, 2021 has issued a notification to amend the <a href=\"https:\/\/ibbi.gov.in\/\/uploads\/legalframwork\/98c1c43fb165be1c4e8c90244de1dafe.pdf\">Guidelines for technical standards for core services and other services<\/a> issued under the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/sZn650F7\">Insolvency and Bankruptcy Board of India (Information Utilities) Regulations, 2017<\/a>.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Key amendments:<\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li>In the principal guidelines, for clause 1.3, the following clause shall be substituted, namely:-<\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\">\u201c<strong>1.3 Definitions.<\/strong><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\">(i) \u2018Identity Details\u2019 means C-KYC number in the C-KYC database maintained by CERSAI or identification number of any OVD of a person who is resident of India.<\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\">(ii) \u2018OVD\u2019 includes Permanent Account Number (PAN) Card, Passport, Driving License, Voter\u2019s Identity Card issued by Election Commission of India and Aadhaar letter\/card or the e-Aadhaar (an electronically generated letter from the website of UIDAI), as the case may be.\u201d<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\n<ul style=\"text-align: justify;\">\n<li>For sub-clause 5, the following sub-clause shall be substituted:<span id=\"page18R_mcid2\" class=\"markedContent\"><\/span><span id=\"page18R_mcid3\" class=\"markedContent\"><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page18R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><span id=\"page18R_mcid7\" class=\"markedContent\" style=\"color: #008000;\"><span id=\"page3R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u201c5. (i<\/span><span dir=\"ltr\" role=\"presentation\">) Registration process shall be completed with PAN (legal entity) <\/span> <span dir=\"ltr\" role=\"presentation\">and <\/span><span dir=\"ltr\" role=\"presentation\">PAN or CKYC <\/span><span dir=\"ltr\" role=\"presentation\">number (individual), in the absence of PAN or C<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">KYC number any other ID shall <\/span><span dir=\"ltr\" role=\"presentation\">be <\/span><span dir=\"ltr\" role=\"presentation\">used.<\/span> <\/span><span id=\"page3R_mcid22\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(ii) A Unique Identification Number (UIN) by the IU shall be assigned to all the <\/span> <span dir=\"ltr\" role=\"presentation\">registered <\/span><span dir=\"ltr\" role=\"presentation\">users in accordance with these Guidelines.<\/span><\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page18R_mcid8\" class=\"markedContent\"><\/span><span id=\"page18R_mcid0\" class=\"markedContent\" style=\"color: #008000;\"><span dir=\"ltr\" role=\"presentation\">(iii) An ID once used in the registration process, will be taken on record and the same shall be <\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">used for all future access to IU services.\u201d<\/span> <\/span><\/p>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page18R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In the principal guidelines, in clause 2.2,\u00a0<\/span><\/span><span id=\"page18R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">under the<\/span> <span dir=\"ltr\" role=\"presentation\">heading \u201cTechnical Standards on Regulation 13(2) (d)\u201d for sub<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">clause 1, the <\/span><span dir=\"ltr\" role=\"presentation\">following sub<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <span dir=\"ltr\" role=\"presentation\">clause shall be substituted:<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><span id=\"page18R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\"><span id=\"page18R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">\u201c1. Aadhaar number shall not be used as an UIN. The UIN shall be assigned for different <\/span><span dir=\"ltr\" role=\"presentation\">categories of users in the following manner:<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span> <\/span><span id=\"page18R_mcid4\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(a) PAN or CKYC number for an individual and in the absence of PAN or C<\/span><span dir=\"ltr\" role=\"presentation\">&#8211;<\/span><span dir=\"ltr\" role=\"presentation\">KYC <\/span><span dir=\"ltr\" role=\"presentation\">number,<\/span> <span dir=\"ltr\" role=\"presentation\">any other ID number shall be UIN;<\/span> <\/span><span id=\"page18R_mcid5\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(b) PAN number for all legal entities; and <\/span> <\/span><span id=\"page18R_mcid6\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(c) <\/span><span dir=\"ltr\" role=\"presentation\">For a government department or <\/span><span dir=\"ltr\" role=\"presentation\">any other agency that does not <\/span><span dir=\"ltr\" role=\"presentation\">have <\/span> <span dir=\"ltr\" role=\"presentation\">PAN or <\/span><span dir=\"ltr\" role=\"presentation\">an<\/span> <span dir=\"ltr\" role=\"presentation\">individ<\/span><span dir=\"ltr\" role=\"presentation\">ual or a legal entity or a foreign entity that has not been issued an ID, IU may issue <\/span><span dir=\"ltr\" role=\"presentation\">UIN based on an alternative number assigned by any other authority, wherever available. <\/span><span dir=\"ltr\" role=\"presentation\">Where such alternative identifier is not available, UIN shall be issued by the IU<\/span><span dir=\"ltr\" role=\"presentation\">, starting with <\/span><span dir=\"ltr\" role=\"presentation\">IU code (1 character), indicator for type of person (1 character), followed by 8 alphanumeric <\/span><span dir=\"ltr\" role=\"presentation\">characters.\u201d<\/span> <\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>On July 26, 2021, the Insolvency
