T<\/span>he <\/span>Central <\/span>Government in exercise of the powers conferred by Section 1 (2) of the Companies (Amendment) Act, 2020<\/a>, <\/span>hereby <\/span>appoints <\/span>the <\/span> 1<\/span>st<\/span> September, 2021 as the date on wh<\/span>ich the provisions of section 4 of the said Act shall come into force. <\/span> <\/span><\/p>\n

\n

Section 4 of the Amendment Act provides Amendment of section 16 dealing with Rectification of name of company<\/a><\/span>.<\/b><\/p>\n

In section 16 of the Companies Act, 2013,<\/p>\n

(i<\/i>) in sub-section (1)(b<\/i>), for the words \u201cperiod of six months\u201d, the words \u201cperiod of three months\u201d shall be substituted;<\/p>\n

(ii<\/i>) for sub-section (3), the following sub-section shall be substituted, namely:\u2014<\/p>\n

\u201c(3) If a company is in default in complying with any direction given under sub-section (1), the Central Government shall allot a new name to the company in such manner as may be prescribed and the Registrar shall enter the new name in the register of companies in place of the old name and issue a fresh certificate of incorporation with the new name, which the company shall use thereafter:<\/p>\n

Provided that nothing in this sub-section shall prevent a company from subsequently changing its name in accordance with the provisions of section 13.\u201d.<\/p>\n","protected":false},"excerpt":{"rendered":"
