{"id":251364,"date":"2021-07-16T17:30:49","date_gmt":"2021-07-16T12:00:49","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=251364"},"modified":"2021-07-16T16:45:08","modified_gmt":"2021-07-16T11:15:08","slug":"pension-fund-regulatory-and-development-authority-pension-fund-sixth-amendment-regulations-2021","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/07\/16\/pension-fund-regulatory-and-development-authority-pension-fund-sixth-amendment-regulations-2021\/","title":{"rendered":"Pension Fund Regulatory and Development Authority (Pension Fund) (Sixth Amendment) Regulations, 2021"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page1R_mcid189\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">The Pension Fund Regulatory and Development Authority makes the Pension Fund Regulatory and Development Authority (Pension Fund) (Sixth Amendment) Regulations, 2021<\/span><\/span><span id=\"page1R_mcid190\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"> to amend the Pension Fund Regulatory and Development Authority (Pension Fund) Regulations, 2015 <\/span><\/span><span id=\"page1R_mcid191\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">namely, <\/span><\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page10R_mcid3\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">In <\/span><\/span><span id=\"page10R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">regulation 8 relating to Eligibility Criteria, in clause (g)<\/span><\/span><span id=\"page10R_mcid6\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">, the words \u201cforty nine per cent.\u201d shall be substituted <\/span><\/span><span id=\"page10R_mcid7\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">with \u201cseventy four per cent.\u201d<\/span><\/span><span id=\"page10R_mcid8\" class=\"markedContent\"> <\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008080;\"><i>(g<\/i>)] the aggregate holding of equity shares by a foreign company either by itself or through its subsidiary companies or its nominees or by an individual or by an association of persons whether registered or not under any law of a country outside India taken in aggregate in the pension fund shall not exceed <span style=\"color: #800000;\"><strong>seventy four percent<\/strong><\/span>. of the paid-up capital of such fund or such percentage as may be approved for an Indian Insurance Company under the provisions of the Insurance Act, 1938 (4 of 1938), whichever is higher. The calculation of foreign investment shall be in accordance with the relevant rules notified by the Central Government or the regulations or guidelines issued by the Authority for the said
