 Shipping (Maritime Labour) Amendment Rules, 2021"},"content":{"rendered":"<p style=\"text-align: justify;\"><span id=\"page3R_mcid371\" class=\"markedContent\"><span dir=\"ltr\">The Central Government in exercise of the powers co<\/span><span dir=\"ltr\">nferred by section 218A read with section 457 of the <\/span><span dir=\"ltr\">Merchant Shipping Act, 1958 (44 of 1958)<\/span><span dir=\"ltr\"> makes Merchant Shipping (Maritime Labour) Amendment Rules, 2021 to amend the Merchant <\/span><span dir=\"ltr\">Shipping (Maritime Labour) Rules, 2016. <\/span><\/span><span id=\"page3R_mcid373\" class=\"markedContent\"><span dir=\"ltr\">They shall be deemed to have come into force on the\u00a0 December 26, 2020.<\/span><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page3R_mcid374\" class=\"markedContent\"><span dir=\"ltr\">In the Merchant Shipping (Maritime Labour) Rules, 2016<\/span><span dir=\"ltr\">, rule 8 relating to Seafarers\u2019 employment agreements<\/span><span dir=\"ltr\">, the following <\/span><span dir=\"ltr\">sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule shall be inserted,<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page3R_mcid375\" class=\"markedContent\" style=\"color: #008000;\"><span dir=\"ltr\">(9) A seafarer\u2019s employment agreement shall continue to have effect while a seafarer is held <\/span><span dir=\"ltr\">captive on or off the ship as a result of acts of piracy or armed robbery against ships,regardless of <\/span><span dir=\"ltr\">whether the date fixed <\/span><span dir=\"ltr\">for its expiry has passed or either party has given notice to suspend or <\/span><span dir=\"ltr\">terminate it.<\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\"><span id=\"page3R_mcid376\" class=\"markedContent\"><span dir=\"ltr\">Explanation. <\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">For the purposes of this sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule. <\/span><span dir=\"ltr\">&#8211;<\/span><\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\"><span id=\"page3R_mcid377\" class=\"markedContent\"><span dir=\"ltr\">a.<\/span><span dir=\"ltr\">the term\u201cpiracy\u201dshall have the same meaning as assigned in Article 101 of the United Nations <\/span><span dir=\"ltr\">Convention on the Law <\/span><span dir=\"ltr\">of the Sea, 1982;<\/span><\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\"><span id=\"page3R_mcid378\" class=\"markedContent\"><span dir=\"ltr\">b.<\/span><span dir=\"ltr\">the term \u201carmed robbery against ships\u201d means any illegal act of violence or detention or any <\/span><span dir=\"ltr\">act of depredation, or threat thereof, other than an act of piracy, committed for private ends and <\/span><span dir=\"ltr\">directed against a ship or against persons <\/span><span dir=\"ltr\">or property onboard such a ship, within a country\u2019s <\/span><span dir=\"ltr\">internal waters, archipelagic waters and territorial sea, or any act of inciting or of intentionally <\/span><span dir=\"ltr\">facilitating an act described above\u2019.<\/span><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"text-align: justify;\"><span id=\"page3R_mcid379\" class=\"markedContent\"><span dir=\"ltr\">In the principal rules, in rule 9 relating to Wages<\/span><span dir=\"ltr\">, the fol<\/span><span dir=\"ltr\">lowing sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule shall be <\/span><span dir=\"ltr\">inserted:<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page10R_mcid0\" class=\"markedContent\" style=\"color: #008000;\"><span dir=\"ltr\">\u201c(6) Where a seafarer is held captive on or off the ship as a result of acts of piracy or armed <\/span><span dir=\"ltr\">robbery against ships, wages and other entitlements, including repatriation, under the seafarers\u2019 <\/span><span dir=\"ltr\">employment agreemen<\/span><span dir=\"ltr\">t, relevant collective bargaining agreement or these rules, as applicable <\/span><span dir=\"ltr\">including the remittance of any allotments as provided in sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule (4), shall continue to be paid <\/span><span dir=\"ltr\">and ensured by the ship<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">owner during the entire period of captivity and until the s<\/span><span dir=\"ltr\">eafarer is released <\/span><span dir=\"ltr\">and duly repatriated in accordance with rule 12 or, where the seafarer dies while in captivity, until <\/span><span dir=\"ltr\">the date of death as determined in accordance with rule 9.<\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page10R_mcid1\" class=\"markedContent\" style=\"color: #008000;\"><span dir=\"ltr\">Explanation.<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">For the purposes of this sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule, the terms \u201cpiracy\u201d and \u201car<\/span><span dir=\"ltr\">med robbery against <\/span><span dir=\"ltr\">ships\u201d shall have the same meaning as assigned in sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule (9) of rule 8.\u201d<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page10R_mcid2\" class=\"markedContent\"><span dir=\"ltr\">In the principal rules, in rule 12, relating to Repatriation<\/span><span dir=\"ltr\">, the following sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule shall be <\/span><span dir=\"ltr\">inserted:<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page10R_mcid2\" class=\"markedContent\"><\/span><span style=\"color: #008000;\"><span id=\"page10R_mcid3\" class=\"markedContent\"><span dir=\"ltr\">\u201c(18) The entitlement to repatriation may lapse i<\/span><span dir=\"ltr\">f the seafarers concerned do not claim it within a <\/span><span dir=\"ltr\">period of three (03)years or as provided in the collective agreements, except where they are held <\/span><span dir=\"ltr\">captive on or off the ship as a result of acts of piracy or armed robbery against ships.<\/span><\/span><\/span><\/p>\n<p style=\"padding-left: 40px; text-align: justify;\"><span style=\"color: #008000;\"><span id=\"page10R_mcid4\" class=\"markedContent\"><span dir=\"ltr\">Explanation: <\/span><span dir=\"ltr\">For t<\/span><span dir=\"ltr\">he purposes of this sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule, the terms piracy and armed robbery against ships <\/span><span dir=\"ltr\">shall have the same meaning as assigned in sub<\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">rule (9) of rule 8.\u201d<\/span><\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<ul style=\"text-align: justify;\">\n<li><span id=\"page10R_mcid5\" class=\"markedContent\"><span dir=\"ltr\">In the principal rules, after rule 26 relating to &#8216;On board complaint procedures&#8217;, the following rule shall be inserted,namely: <\/span><span dir=\"ltr\">&#8211;<\/span><\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 40px; text-align: justify;\"><span id=\"page10R_mcid6\" class=\"markedContent\" style=\"color: #008000;\"><span dir=\"ltr\">\u201c26A Marine casua<\/span><span dir=\"ltr\">lties. <\/span><span dir=\"ltr\">&#8211;<\/span><span dir=\"ltr\">The issues related to marine or shipping casualties shall be dealt in <\/span><span dir=\"ltr\">accordance with the provisions for Investigations and Inquiries under the
