{"id":250026,"date":"2021-06-19T11:37:56","date_gmt":"2021-06-19T06:07:56","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=250026"},"modified":"2021-07-02T10:51:25","modified_gmt":"2021-07-02T05:21:25","slug":"live-in-relationship-3","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/06\/19\/live-in-relationship-3\/","title":{"rendered":"All HC | \u2018We are not against live-in relationship\u2019; HC grants protection to couple of marriageable age"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Allahabad High Court: <\/strong>The Division Bench of Dr Kaushal Jayendra Thaker and Dinesh Pathak, JJ., held that it is not against the live-in relationship.<\/p>\n<p style=\"text-align: justify;\">Petitioners preferred the present petition stating that they wanted to have a live-in relationship.<\/p>\n<p style=\"text-align: justify;\">During the pendency of the present petition, the above-stated couple converted their live-in relationship to marriage.<\/p>\n<p style=\"text-align: justify;\">Petitioners apprehended that they would be harassed and would not be permitted to live in peace by private respondents.<\/p>\n<p style=\"text-align: justify;\">High Court held that:<\/p>\n<blockquote>\n<p style=\"text-align: center;\"><span style=\"color: #0000ff;\"><em>We are not against live in relationship.<\/em><\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Bench stated that the petitioners were of marriageable age and wanted to live in relation, subsequently, they married each other. Court referred to the following Supreme Court decisions:<\/p>\n<ul style=\"text-align: justify;\">\n<li><em>Gian Devi v. Superintendent, Nari Niketan<\/em>; <a href=\"http:\/\/www.scconline.com\/DocumentLink\/RdUCxEPb\">(1976) 3 SCC 234<\/a><\/li>\n<li><em>Lata Singh v. State of U.P.,<\/em> <a href=\"http:\/\/www.scconline.com\/DocumentLink\/xgj4ZTce\">(2006) 5 SCC 475<\/a><\/li>\n<li><em>Bhagwan Dass v. State (NCT of Delhi<\/em>), <a href=\"http:\/\/www.scconline.com\/DocumentLink\/6L545dq4\">(2011) 6 SCC 396<\/a><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Hence, in view of the above observations petition was partly allowed.
