{"id":249089,"date":"2021-06-01T16:00:43","date_gmt":"2021-06-01T10:30:43","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=249089"},"modified":"2021-06-11T11:11:43","modified_gmt":"2021-06-11T05:41:43","slug":"trademark","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/06\/01\/trademark\/","title":{"rendered":"[Trademark Infringement] Del HC | Usage of domain names identical\/deceptively similar to \u2018BAJAJ FINANCE\u2019 or \u2018BAJAJ FINSERV\u2019 would amount to infringement"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Delhi High Court: <\/strong>Jayant Nath, J., addressed a matter wherein the domain names similar to the trade mark \u2018BAJAJ FINANCE\u2019 or \u2018BAJAJ FINSERV\u2019 were being used.<\/p>\n<p style=\"text-align: justify;\">An application was filed under Order 39 Rules 1 and 2 CPC seeking an ex-parte injunction to restrain defendants 1 to 5 and their employees, etc. acting for and on their behalf from using their respective domain names\/websites for any purpose whatsoever.<\/p>\n<p style=\"text-align: justify;\">Injunction was also sought to restrain defendants 1 to 5 and their employees from registering any domain names\/websites which are identical or deceptively similar to the plaintiff\u2019s trademarks and brand names \u2018BAJAJ FINANCE\u2019 or \u2018BAJAJ FINSERV\u2019 or domain names that have \u2018BAJAJ\u2019 as prefix and suffix in combination with any other words.<\/p>\n<p style=\"text-align: justify;\">Plaintiff\u2019s case was that it is the proprietor of \u2018BAJAJ FINANCE\u2019 trademarks and the exclusive licensee of \u2018BAJAJ FINSERV\u2019 trademarks and hence. It was claimed that the plaintiff retains the exclusive right to use the said trademarks and all individuals\/entities\/organizations\/etc. are prohibited and prevented from using the same.<\/p>\n<p style=\"text-align: justify;\">It was submitted that defendants 1 to 5 are were the registrants of the fake and unauthorised domain names and rogue websites which are using the mark identical or deceptively similar to the plaintiff\u2019s trademarks\/brand names \u2018BAJAJ FINANCE\u2019 or \u2018BAJAJ FINSERV\u2019 or domain names which have \u2018BAJAJ\u2019 as prefix or suffix in combination of other words.<\/p>\n<p style=\"text-align: justify;\">Defendant 6 to 26 were the domain registrars who were in the business of selling\/offering for registration of domain names.<\/p>\n<p style=\"text-align: justify;\">Hence, it was manifested that the plaintiff was the registered proprietor of the trademarks \u2018BAJAJ FINANCE\u2019 and had rights in \u2018BAJAJ FINSERV\u2019. Therefore, use of domain names that were identical\/deceptively similar to plaintiffs\u2019 trademarks and brand names tantamounted to infringement of rights of plaintiff.<\/p>\n<p style=\"text-align: justify;\">High Court restrained defendants 1 to 5 from using the above-stated trade marks\/ name deceptively similar to them. Court added that defendants 6, 10, 14 and 21 may suspend the aforenoted domain names till the said websites are registered with the said domain names.<\/p>\n<p style=\"text-align: justify;\">In view of the above discussion, notice was issued.
