{"id":248806,"date":"2021-05-27T17:59:28","date_gmt":"2021-05-27T12:29:28","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=248806"},"modified":"2021-05-27T17:59:28","modified_gmt":"2021-05-27T12:29:28","slug":"usa-oregon-health-authority-issues-interim-guidance-for-fully-vaccinated-individuals","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/05\/27\/usa-oregon-health-authority-issues-interim-guidance-for-fully-vaccinated-individuals\/","title":{"rendered":"USA | Oregon Health Authority issues Interim Guidance for Fully Vaccinated Individuals"},"content":{"rendered":"<p style=\"text-align: justify;\">On May 18, 2021, the Oregon Health Authority (OHA) issued a new guidance titled, &#8220;Interim Guidance for Fully Vaccinated Individuals,&#8221; adjusting the applicability and enforcement of current state guidance for fully vaccinated individuals.<\/p>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">Applicability: <\/span><span dir=\"ltr\">This<\/span><span dir=\"ltr\"> guidance <\/span><span dir=\"ltr\">applies statewide <\/span><span dir=\"ltr\">to : <\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span dir=\"ltr\">Fully<\/span><span dir=\"ltr\"> vaccinated individuals in Oregon <\/span><span dir=\"ltr\">regarding <\/span><span dir=\"ltr\">requirements <\/span><span dir=\"ltr\">to wear masks, face <\/span><span dir=\"ltr\">coverings and face shields and physical<\/span><span dir=\"ltr\">ly distanc<\/span><span dir=\"ltr\">e; and <\/span><\/li>\n<li><span dir=\"ltr\">Places of employment, businesses, faith institutions, and other settings <\/span><span dir=\"ltr\">subject to <\/span><span dir=\"ltr\">current state guidance regarding mask, face covering and face shield requirements <\/span><span dir=\"ltr\">and physical distancing requirements. <\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">This guidance adjust<\/span><span dir=\"ltr\">s the applicability and <\/span><span dir=\"ltr\">enforcement of current state guidance<\/span><span dir=\"ltr\"> for <\/span><span dir=\"ltr\">fully vaccinated <\/span><span dir=\"ltr\">individuals.<\/span><\/p>\n<h4 style=\"text-align: justify;\"><span dir=\"ltr\">Mask, Face Covering, Face Shield and Physical Distancing Requirements<\/span><span dir=\"ltr\">for Fully<\/span><span dir=\"ltr\"> Vaccinated Individuals:<\/span><\/h4>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">Regardless of requirements in other state guidance related to COVID<\/span><span dir=\"ltr\">-19,<\/span><span dir=\"ltr\"> i<\/span><span dir=\"ltr\">ndividuals <\/span><span dir=\"ltr\">who are fully<\/span><span dir=\"ltr\"> vaccinated<\/span><span dir=\"ltr\"> with proof of vaccination status<\/span><span dir=\"ltr\"> are not required to wear a <\/span><span dir=\"ltr\">mask, face covering or face shield, or <\/span><span dir=\"ltr\">maintain<\/span><span dir=\"ltr\"> physical distancing <\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">EXCEPT<\/span><span dir=\"ltr\">: <\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span dir=\"ltr\">In health care settings<\/span><span dir=\"ltr\">. <\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">In adult jails and <\/span><span dir=\"ltr\">correctional <\/span><span dir=\"ltr\">facilities<\/span><span dir=\"ltr\">. <\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">In <\/span><span dir=\"ltr\">youth detention and correctional facilities<\/span><span dir=\"ltr\">. <\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">In shelters and transitional housing.<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">In K<\/span><span dir=\"ltr\">-12 schools<\/span><span dir=\"ltr\">. (Fully vaccinated individuals must comply with <\/span><span dir=\"ltr\">Ready School, Safe <\/span><span dir=\"ltr\">Learners (RSSL)<\/span><span dir=\"ltr\"> guidance face covering requ<\/span><span dir=\"ltr\">irements).<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">On <\/span><span dir=\"ltr\">planes, buses, trains, and other forms of public transportation traveling into, <\/span><span dir=\"ltr\">within, or out of the United States<\/span><span dir=\"ltr\">. <\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">In U.S. transportation hubs such as airports and <\/span><span dir=\"ltr\">bus <\/span><span dir=\"ltr\">stations.<\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">In other settings where the owner or operator <\/span><span dir=\"ltr\">continues to apply and enforce the <\/span><span dir=\"ltr\">mask, face covering and face shield guidance<\/span><span dir=\"ltr\">, and physical distancing requirements <\/span><span dir=\"ltr\">in state COVID<\/span><span dir=\"ltr\">-19 guidance. <\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">Applicability and Enforcement of Mask,<\/span><span dir=\"ltr\"> Face Covering, Face Shield <\/span><span dir=\"ltr\">and Physical Distancing Requirements<\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">All <\/span><span dir=\"ltr\">businesses, <\/span><span dir=\"ltr\">employers <\/span><span dir=\"ltr\">and faith institutions <\/span><span dir=\"ltr\">are required to: <\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><span dir=\"ltr\">Continue to apply and enforce the <\/span><span dir=\"ltr\">mask, face covering and face shield guidance<\/span><span dir=\"ltr\">, <\/span><span dir=\"ltr\">and physical distancing requirements in state COVID<\/span><span dir=\"ltr\">-19 guidance to all individuals <\/span><span dir=\"ltr\">unless <\/span><span dir=\"ltr\">a business<\/span><span dir=\"ltr\">, employer<\/span><span dir=\"ltr\"> or faith institution<\/span><span dir=\"ltr\">: <\/span><\/li>\n<\/ul>\n<p style=\"padding-left: 80px; text-align: justify;\"><span dir=\"ltr\">(i) has a policy for checking for proof of vaccination status <\/span><span dir=\"ltr\">of <\/span><span dir=\"ltr\">individuals; and<\/span><\/p>\n<p style=\"padding-left: 80px; text-align: justify;\"><span dir=\"ltr\">(ii) requests proof of vaccination status from each individual<\/span><span dir=\"ltr\">; and <\/span><\/p>\n<p style=\"padding-left: 80px; text-align: justify;\"><span dir=\"ltr\">(iii) review<\/span><span dir=\"ltr\">s each <\/span><span dir=\"ltr\">individual<\/span><span dir=\"ltr\">\u2019s proof of vaccination <\/span><span dir=\"ltr\">prior to entry or admission. <\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">A business<\/span><span dir=\"ltr\">, employer <\/span><span dir=\"ltr\">or faith institution <\/span><span dir=\"ltr\">that has a policy for <\/span><span dir=\"ltr\">requesting and <\/span><span dir=\"ltr\">checking for proof <\/span><span dir=\"ltr\">of vaccination and requests and <\/span><span dir=\"ltr\">reviews <\/span><span dir=\"ltr\">proof of <\/span><span dir=\"ltr\">vaccination <\/span><span dir=\"ltr\">may permit <\/span><span dir=\"ltr\">fully vaccinated <\/span><span dir=\"ltr\">individuals with proof of vaccination <\/span><span dir=\"ltr\">to go without a mask, face covering or face shield, and <\/span><span dir=\"ltr\">does not need to enforce physical distancing requirements for<\/span><span dir=\"ltr\"> such individuals<\/span><span dir=\"ltr\">. <\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">Businesses<\/span><span dir=\"ltr\">, employers<\/span><span dir=\"ltr\"> and faith institutions<\/span><span dir=\"ltr\"> may, at their discretion, c<\/span><span dir=\"ltr\">ontinue to apply and <\/span><span dir=\"ltr\">enforce the <\/span><span dir=\"ltr\">mask, face covering and face shield guidance<\/span><span dir=\"ltr\">, and physical distancing <\/span><span dir=\"ltr\">requirements in state <\/span><span dir=\"ltr\">COVID<\/span><span dir=\"ltr\">-19 guidance<\/span><span dir=\"ltr\"> to all individuals, regardless of vaccination status<\/span><span dir=\"ltr\">, <\/span><span dir=\"ltr\">and must continue to do so if they <\/span><span dir=\"ltr\">do not have a policy for checking proof of vaccination or <\/span><span dir=\"ltr\">have not <\/span><span dir=\"ltr\">reviewed <\/span><span dir=\"ltr\">proof of vaccination for an individual, or if the individual has declined to <\/span><span dir=\"ltr\">provide such <\/span><span dir=\"ltr\">proof<\/span><span dir=\"ltr\">. <\/span><\/p>\n<p style=\"text-align: justify;\"><span dir=\"ltr\">All businesses, employers and faith institutions should, but are not required to: <\/span><\/p>\n<ul>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">Post <\/span><span dir=\"ltr\">signs<\/span><span dir=\"ltr\"> about mask, face <\/span><span dir=\"ltr\">covering, <\/span><span dir=\"ltr\">face <\/span><span dir=\"ltr\">shield <\/span><span dir=\"ltr\">requirements. <\/span><\/li>\n<li style=\"text-align: justify;\"><span dir=\"ltr\">Post <\/span><span dir=\"ltr\">signs<\/span><span dir=\"ltr\"> about mask, face <\/span><span dir=\"ltr\">covering<\/span><span dir=\"ltr\">, face <\/span><span dir=\"ltr\">shield <\/span><span dir=\"ltr\">requirement in languages that are <\/span><span dir=\"ltr\">commonly spoken by customers, <\/span><span dir=\"ltr\">visitors <\/span><span dir=\"ltr\">and
