{"id":248154,"date":"2021-05-13T15:22:25","date_gmt":"2021-05-13T09:52:25","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=248154"},"modified":"2021-05-19T11:09:05","modified_gmt":"2021-05-19T05:39:05","slug":"delhi-court-4-accused-in-khan-market-oxygen-concentrators-hoarding-case-get-bail","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/05\/13\/delhi-court-4-accused-in-khan-market-oxygen-concentrators-hoarding-case-get-bail\/","title":{"rendered":"Delhi District Court | 4 accused in Oxygen Concentrators Hoarding Case get bail"},"content":{"rendered":"<div style=\"text-align: justify;\">\n<p>Delhi District Court (Saket):\u00a0 While hearing the bail application of 4 accused in oxygen concentrators hoarding case, the bench comprising of <span dir=\"ltr\">Arun Kumar Garg<\/span> J, granted bail to 4 accused persons including Matrix Limited CEO Gaurav Khanna, Satish Sethi, Gaurav Suri and Vikrant.<\/p>\n<p>&nbsp;<\/p>\n<\/div>\n<div style=\"text-align: justify;\"><span dir=\"ltr\">The Court ordered the accused to furnish<\/span><span dir=\"ltr\"> Personal Bond and Surety Bond in sum of Rs. 50,000\/- each to the satisfaction of Ld.<\/span><span dir=\"ltr\">Duty MM (SE) with the condition that <\/span><\/div>\n<div><\/div>\n<div style=\"text-align: justify; padding-left: 40px;\"><span style=\"color: #800000;\"><span dir=\"ltr\">&#8220;the accused shall not directly or <\/span><span dir=\"ltr\">indirectly try to influence the witnesses, shall not in any manner <\/span><span dir=\"ltr\">temper with the evidence and shall join the investigation as and when <\/span><span dir=\"ltr\">directed by the IO. Bail Bonds not furnished.&#8221;<\/span><\/span><\/div>\n<div><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The Court also noted that<\/div>\n<div><\/div>\n<div style=\"text-align: justify; padding-left: 40px;\"><span style=\"color: #800000;\">&#8220;d<span dir=\"ltr\">espite repeated directions by High Court of <\/span><span dir=\"ltr\">Delhi, the Government is not coming forward to cap the price of essential <\/span><span dir=\"ltr\">medical devices and nor any regulation has been made by the Government for <\/span><span dir=\"ltr\">sale of the same by the importers to the Government for its equitable <\/span><span dir=\"ltr\">distribution to the needy persons for reasons best known to the Government. <\/span><span dir=\"ltr\">Mere booking of the manufacturers\/importers under the criminal law <\/span><span dir=\"ltr\">without a regulatory regime in place and without any evidence just to <\/span><span dir=\"ltr\">show that the state is concerned about the problems of citizens in <\/span><span dir=\"ltr\">procurement of life saving medical devices, in my considered opinion, <\/span><span dir=\"ltr\">will be counter-productive and shall create a further scarcity of already <\/span><span dir=\"ltr\">scarce medical devices as it will discourage the manufacturers and <\/span><span dir=\"ltr\">importers from pushing their resources so as to make the essential <\/span><\/span><span dir=\"ltr\"><span style=\"color: #800000;\">medical devices available to the needy citizens.&#8221;<\/span> <\/span><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div><\/div>\n<div style=\"text-align: justify;\"><span dir=\"ltr\">However, the Court also mentioned that they do not have <\/span><span dir=\"ltr\">any sympathy with the black marketers and hoarders of the essential <\/span><span dir=\"ltr\">medicines\/medical devices, but the vacuum in the law needs to<\/span> <span dir=\"ltr\">be filled up by the legislature or for that matter by the executive by <\/span><span dir=\"ltr\">issuing appropriate regulations in pursuance to the powers delegated <\/span><span dir=\"ltr\">by the legislation to the executive. <\/span><\/div>\n<div><\/div>\n<div><\/div>\n<div style=\"text-align: justify;\"><span dir=\"ltr\">The Court also felt the need of invoking the provisions of <\/span><span dir=\"ltr\">Prevention of Black <\/span><span dir=\"ltr\">Marketing and Maintenance of Supplies of the Essential Commodities <\/span><span dir=\"ltr\">Act, 1980 by the State if the state wants to stop <\/span><span dir=\"ltr\">the black-marketing.[Vikrant v.
