Delhi High Court<\/strong>: In the issue relating to supply and availability of <\/span>the drug <\/span>Tocilizumab <\/span>400 MG <\/span>for <\/span>COVID<\/span>–<\/span>19 <\/span>patients <\/span>who are being prescribed <\/span>the same<\/span>, the single judge bench comprising of Pratibha M. Singh asks Union of India, Delhi Government to <\/span>take i<\/span>mmediate steps to ensure that the doses received till May 10, 2021 and by May 15, 2021 <\/span>a<\/span>re <\/span>allocated to <\/span>States\/UTs and are <\/span>distributed <\/span>transpare<\/span>nt<\/span>ly, <\/span>efficiently <\/span>and in a <\/span>timely <\/span>manner, <\/span>so that they c<\/span>an be immed<\/span>i<\/span>ately administered to patien<\/span>ts who are in need<\/span>.<\/span><\/p>\n

 <\/p>\n

T<\/span>he petition was filed by the brot<\/span>h<\/span>er of<\/span> a COVID<\/span>–<\/span>19 <\/span>patient and<\/span> was prescribed a dose of <\/span>Tocilizuma<\/span>b<\/span>400 MG<\/span>, however after <\/span>multiple ef<\/span>f<\/span>orts, he was unable to procure the same.<\/span><\/p>\n

 <\/p>\n

Noticing the shortage of the drug in the country, the Court directed Roche India to take <\/span>in<\/span>structions <\/span>from <\/span>M\/s Chugai Sei<\/span>yaku Kabushiki Kaisha<\/span>or or any other entity <\/span>involved <\/span>in the <\/span>supply chain <\/span>and make s<\/span>u<\/span>bmissio<\/span>ns as to whether any <\/span>fur<\/span>th<\/span>e<\/span>r sup<\/span>ply of more quantities of <\/span>Tocilizumab 400 MG <\/span>doses can be <\/span>made,<\/span>and the<\/span> timeli<\/span>nes<\/span>,<\/span>in order to cater t<\/span>o the <\/span>actual <\/span>demand <\/span>for <\/span>patients in India<\/span>.<\/span><\/p>\n

The Court also directed Union of India to <\/span>place an affidavit on record by May 12, 2021<\/span>, statin<\/span>g <\/span>as to <\/span>whether there are any ot<\/span>he<\/span>r <\/span>applications for manufac<\/span>ture\/import\/sale of <\/span>Tocilizumab 400 MG<\/span>, with the Drug Controller General of India, un<\/span>der the <\/span>Drugs and Cosmetics Ac<\/span>t, 1940.
