State of Maharashtra<\/i>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000065082\">(2019) 7 SCC 1<\/a><\/b><\/p>\n<hr \/>\n<p style=\"text-align: justify;\">Born on\u00a05th May, 1958, Justice Shantanagoudar enrolled as an Advocate on 05.09.1980 and practiced mainly in Civil, Criminal and Constitutional matters.<\/p>\n<p style=\"text-align: justify;\">He also served as Vice-Chairman of Karnataka State Bar Council from 1991 to 1993 and as Chairman of Karnataka State Bar Council during 1995 and 1996 and later served as State Public Prosecutor of Karnataka State from 1999 to 2002.<\/p>\n<p style=\"text-align: justify;\">He was then appointed as Additional Judge of the Karnataka High Court on 12.05.2003 and as Permanent Judge on 24.09.2004. State, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/846ReIpV\">2021 SCC OnLine SC 210<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">The bench of\u00a0<strong>MM Shantanagoudar*<\/strong>\u00a0and Vineet Saran, JJ has held that Section 195(1)(b)(i) CrPC will not bar prosecution by the investigating agency for offence punishable under Section 193 IPC, which is committed during the stage of investigation.\u00a0<em>This is provided that the investigating agency has lodged complaint or registered the case under Section 193, IPC prior to commencement of proceedings and production of such evidence before the trial court. MC Subramaniam,\u00a0<a href=\"http:\/\/www.scconline.com\/DocumentLink\/IV3QpH0G\">2021 SCC OnLine SC 109<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">The bench of\u00a0<strong>MM Shantanagoudar*<\/strong>\u00a0and Vineet Saran, JJ has held that Section 89 of CPC and Section 69-A of Tamil Nadu Court Fees and Suit Valuation Act, 1955 contemplate the refund of court fees in all methods of out-of-court dispute settlement between parties that the Court subsequently finds to have been legally arrived at and not just to those cases where the Court itself refers the parties to any of the alternative dispute settlement mechanisms listed in Section 89 of the CPC.<\/p>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/02\/22\/parties-agreeing-to-out-of-court-settlement-without-judicial-intervention-under-section-89-cpc-cant-be-denied-benefit-of-refund-of-court-fees-they-are-even-more-deserving\/\">Read more<\/a><\/strong><\/p>\n<hr \/>\n<h3 class=\"entry-title\"><strong>Amitabha Dasgupta v. United Bank of India, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/ShrikJog\">2021 SCC OnLine SC 124<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">In a case where United Bank of India inadvertently broke the Appellant\u2019s locker, without any just or reasonable cause, even though he had already cleared his pending dues, the bench of\u00a0<strong>MM Shantanagoudar*<\/strong>\u00a0and Vineet Sarana, JJ Imposed\u00a0costs\u00a0of\u00a0Rs.\u00a05,00,000\/\u00ad\u00a0on\u00a0the Bank\u00a0to\u00a0be\u00a0paid\u00a0to\u00a0the\u00a0Appellant\u00a0as\u00a0compensation. The\u00a0said is to be\u00a0deducted\u00a0from\u00a0the\u00a0salary of\u00a0the\u00a0erring\u00a0officers,\u00a0if\u00a0they\u00a0are\u00a0still\u00a0in\u00a0service and if they have already retired, the amount of costs should be paid by the Bank. Additionally, the Appellant shall be paid Rs. 1,00,000\/- as litigation expense.<\/p>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/02\/19\/supreme-court-directs-compensation-of-rs-5-lakhs-after-a-bank-breaks-customers-locker-without-just-cause-rbi-to-frame-rules-for-locker-management-read-obligations-of-bank\/\">Read more<\/a><\/strong><\/p>\n<hr \/>\n<h3 class=\"entry-title\">M. Ravindran v. Intelligence Officer, Directorate of Revenue Intelligence,\u00a0<a href=\"http:\/\/www.scconline.com\/DocumentLink\/Tbv9JFGI\"> <strong>(2021) 2 SCC 485<\/strong><\/a><\/h3>\n<p style=\"text-align: justify;\">Interpreting Section 167(2) CrPC, the 3-judge bench of UU Lalit, MM Shantanagoudar and Vineet Sarah, JJ has said that the Courts cannot adopt a rigid or formalistic approach whilst considering any issue that touches upon the rights contained in Article 21. It said,<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><strong style=\"font-style: inherit;\"><span style=\"font-style: inherit; font-weight: inherit;\">\u201cThe history of the enactment of Section 167(2), CrPC and the safeguard of \u2018default bail\u2019 contained in the Proviso thereto is intrinsically linked to Article 21 and is nothing but a legislative exposition of the constitutional safeguard that no person shall be detained except in accordance with rule of law.\u201d<\/span><\/strong><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.scconline.com\/blog\/post\/2020\/10\/26\/sc-courts-cannot-adopt-a-rigid-or-formalistic-approach-while-interpreting-section-1672-crpc-read-why\/\">Read more<\/a><\/strong><\/p>\n<hr \/>\n<h3 class=\"entry-title\"><strong>Krishna Lal Chawla v. State of U.P., <a href=\"http:\/\/www.scconline.com\/DocumentLink\/FEu9TNGM\">2021 SCC OnLine SC 191<\/a> <\/strong><\/h3>\n<p style=\"text-align: justify;\">The bench of Justice Shantanagoudar and Justice R. Subhash Reddy held that the Trial Judge has a duty under the Constitution and the CrPC, to identify and dispose of frivolous litigation at an early stage by exercising, substantially and to the fullest extent, the powers conferred on him.<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cFrivolous litigation should not become the order of the day in India. From misusing the Public Interest Litigation jurisdiction of the Indian courts to abusing the criminal procedure for harassing their adversaries, the justice delivery system should not be used as a tool to fulfil personal vendetta.\u201c<\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/03\/24\/curtailing-vexatious-litigation-is-a-crucial-step-towards-a-more-effective-justice-system-supreme-court-examines-role-of-lower-judiciary-in-preventing-abuse-of-process\/\">Read more<\/a><\/strong><\/p>\n<hr \/>\n<h3 class=\"entry-title\">Rekha Muraka v. State of West Bengal, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/94vGk7m4\"><strong>(2020) 2 SCC 474<\/strong><\/a><\/h3>\n<p style=\"text-align: justify;\">Dealing with the question relating to the extent to which a victim\u2019s counsel can participate in the prosecution of a case, the bench of MM Shantanagoudar and Deepak Gupta, JJ has held that the victim\u2019s counsel is\u00a0<em>subject<\/em>\u00a0to the directions of the Public Prosecutor and that\u00a0<em style=\"font-weight: inherit;\">the victim\u2019s counsel should ordinarily not be given the right to make oral arguments or examine and cross\u00adexamine witnesses<\/em>.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2019\/11\/21\/victims-counsel-can-make-up-for-deficiencies-in-the-prosecution-case-but-cant-argue-the-case\/\">Read more<\/a><\/p>\n<hr \/>\n<h3 class=\"entry-title\"><strong>\u2018X\u2019 v. State of Maharashtra, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000065082\">(2019) 7 SCC 1<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">The 3-judge bench of NV Ramana, MM Shantanagoudar and Indira Banerjee, JJ held<\/p>\n<blockquote>\n<p style=\"font-style: inherit; font-weight: inherit; text-align: justify;\"><strong>\u201cit needs to be understood that prisoners tend to have increased affinity to mental illness. Moreover, due to legal constraints on the recognition of broad\u00adspectrum mental illness within the Criminal Justice System, prisons inevitably become home for a greater number of mentally\u00adill prisoners of various degrees. There is no overlooking of the fact that the realities within the prison walls may well compound and complicate these problems.\u201d<\/strong><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.scconline.com\/blog\/post\/2019\/04\/17\/post-conviction-mental-health-its-effect-on-sentencing-sc-issues-directions\/\">Read more<\/a><\/strong><\/p>\n<hr \/>\n<h3 style=\"text-align: justify;\"><strong>Rekha Sengar v. State of Madhya Pradesh, <\/strong><strong><a href=\"http:\/\/www.scconline.com\/DocumentLink\/0sL9L5MN\">2021 SCC OnLine SC 173<\/a><\/strong><\/h3>\n<p style=\"text-align: justify;\">In the case where the investigative team has seized the sonography machine and made out a strong\u00a0<em>prima-facie<\/em>\u00a0case against the petitioner, the 3-judge bench of MM Shantanagoudar, Vineet Saran and Ajay Rastogi, JJ held no leniency should be granted at this stage as the same may reinforce the notion that the PC&amp;PNDT Act is only a paper tiger and that clinics and laboratories can carry out sex-determination and feticide with impunity.<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">\u201cA strict approach has to be adopted if we are to eliminate the scourge of female feticide and iniquity towards girl children from our society.\u201d<\/p>\n<\/blockquote>\n<hr \/>\n<h3 class=\"entry-title\">Laltu Ghosh v. State of West Bengal, <a href=\"http:\/\/scconline.com\/DocumentLink\/A1Tfx10h\"><strong>(2019) 15 SCC 344<\/strong><\/a><\/h3>\n<p style=\"text-align: justify;\">The bench of\u00a0<strong style=\"font-style: inherit;\">MM Shantanagoudar<\/strong>\u00a0and Dinesh Maheshwari, JJ has held that it cannot be laid down as an absolute rule of law that a dying declaration cannot form the sole basis of conviction unless it is corroborated by other evidence. It was held that:<\/p>\n<blockquote>\n<p style=\"font-style: inherit; font-weight: inherit; text-align: justify;\"><strong>\u201cA dying declaration, if found reliable, and if it is not an attempt by the deceased to cover the truth or to falsely implicate the accused, can be safely relied upon by the courts and can form the basis of conviction. More so, where the version given by the deceased as the dying declaration is supported and corroborated by other prosecution evidence, there is no reason for the courts to doubt the truthfulness of such dying declaration.\u201d<\/strong><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><strong><a href=\"https:\/\/www.scconline.com\/blog\/post\/2019\/02\/19\/courts-cant-assume-fabrication-of-dying-declaration-by-io-in-absence-of-proof\/\">Read more<\/a><\/strong><\/p>\n<hr \/>\n<h3 class=\"entry-title\"><strong>Mohammed Salim v.
