There is no legitimacy or rationale for the existence of this branch if some of us are unable to deliver even the minimal quality of justice that is expected of this, sentinel on the <em>qui vive.\u201d<\/em><\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: center;\"><strong>-Justice SA Bobde<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/strong><\/p>\n<hr \/>\n<p style=\"text-align: justify;\">As Hon\u2019ble Justice Sharad Arvind Bobde\u2019s tenure as the\u00a047th Chief Justice of India comes to a close, we take a trip down the memory lane to recapitulate his journey.<\/p>\n<hr \/>\n<h3 style=\"text-align: center;\"><span style=\"color: #008000;\"><strong>Travelling Back in Time<\/strong><\/span><\/h3>\n<hr \/>\n<p style=\"text-align: justify;\">Justice Bobde was born on 24<sup>th<\/sup> April, 1956 in Nagpur in a prominent legal family. His great- grandfather Ramachandra Pant Bobde was a noted lawyer so was his grandfather Shrinivas Ramchandra Bobde. His father, Arvind Shrinivas Bobde was an eminent lawyer and Advocate-General of\u00a0Maharashtra\u00a0in 1980 and 1985<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>. Justice Bobde&#8217;s elder brother <a href=\"https:\/\/www.scconline.com\/blog\/post\/2016\/06\/13\/senior-advocate-vinod-bobde-passes-away\/\">Vinod Arvind Bobde<\/a> was a senior Supreme Court lawyer and a constitutional expert.<\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"color: #ff0000;\"><strong><em><u>\u2666Did You Know?<\/u><\/em><\/strong><\/span><strong><em><span style=\"color: #ff0000;\">\u00a0<\/span> Justice S.A. Bobde, a fourth generation lawyer in his family, is also the only family to become a Judge. In an interview given to the Indian Express, Justice Bobde said- <\/em><\/strong><strong><em>\u201cI made this conscious decision to be a judge because I am a fourth generation lawyer and I have only seen lawyers in my life. I was the only black sheep who moved towards the judiciary in that sense, and I took a conscious decision as I found being at the Bar repetitive in its rewards. I felt I should answer the call.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/em><\/strong><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">Justice Bobde passed High School in 1972 from St. Francis De&#8217;Sales High School. In 1978 He obtained his degree in law from Dr. Ambedkar Law College in Nagpur University.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><strong><em><span style=\"color: #ff0000;\"><u>\u2666Did You Know?<\/u><\/span><span style=\"color: #000000;\"> J<\/span>ustice Bobde was very active in extra- curricular activities during his school and college life. He actively <\/em><\/strong><strong><em>participated in elocution, dramatics and sports; played tennis in the University College of Law team which won the inter-collegiate championship<\/em><\/strong><em>.<a href=\"#_ftn5\" name=\"_ftnref5\"><strong>[5]<\/strong><\/a>\u00a0 <\/em><\/p>\n<\/blockquote>\n<hr \/>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline; color: #008000;\"><strong>The High Court<\/strong><\/span><\/h3>\n<hr \/>\n<p style=\"text-align: justify;\">Subsequently, Justice Bobde enrolled with the Bar Council of Maharashtra in 1978. He practised at the Nagpur Bench of the Bombay High Court with appearances at Bombay before the principal seat and before the Supreme Court of India for over 21 years. He was then designated as Senior Advocate in 1998.<\/p>\n<p style=\"text-align: justify;\">On 29<sup>th<\/sup> March 2000, Justice Bobde was elevated to the bench of Bombay High Court as Additional Judge. Later he was appointed as the Chief Justice of Madhya Pradesh High Court on 16<sup>th<\/sup> October, 2012.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<hr \/>\n<h3 style=\"text-align: center;\"><span style=\"color: #008000;\"><strong>The Supreme Court<\/strong><\/span><\/h3>\n<hr \/>\n<blockquote>\n<p style=\"text-align: justify;\"><strong><em><span style=\"color: #ff0000;\"><u>\u2666Did You Know?<\/u><\/span><span style=\"color: #ff0000;\">\u00a0<\/span> During his tenure as Supreme Court Judge from 12.04.2013 to 17.11.2019, Justice Bobde had never been a part of any minority opinions<\/em><\/strong><em>.<a href=\"#_ftn7\" name=\"_ftnref7\"><strong>[7]<\/strong><\/a> <\/em><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\">On 12<sup>th<\/sup> April, 2013, Justice Bobde was elevated as a judge of the Supreme Court of India. Being the senior most Judge of the Supreme Court, Justice Bobde <a href=\"https:\/\/www.scconline.com\/blog\/post\/2019\/10\/29\/president-signs-a-warrant-appointing-justice-sharad-arvind-bobde-to-be-the-47th-chief-justice-of-india\/\">became the 47<sup>th<\/sup> Chief Justice of India<\/a> on 18<sup>th<\/sup> November, 2019, succeeding Justice Ranjan Gogoi, who served as the Chief Justice of India for over a year i.e. from 3<sup>rd<\/sup> October, 2018 till 17<sup>th<\/sup> November, 2019.<\/p>\n<h3 style=\"text-align: center;\"><strong><span style=\"color: #800000;\">Significant Supreme Court decisions by Justice Bobde<\/span>\u00a0 <\/strong><\/h3>\n<p style=\"text-align: justify;\">Justice Bobde has been a part of some historic and landmark judgments which have furthered the discourse around several burning topics in the legal echelons. Here\u2019s a list of some of the notable judgments during his tenure as a Judge and Chief Justice of India-<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000080;\"><strong><u>As Judge of the Supreme Court<\/u><\/strong><\/span><\/h4>\n<h4 style=\"text-align: justify;\"><strong><em>M. Siddiq v. Mahant Suresh Das (Ram Janmabhumi Temple Verdict)<\/em><\/strong>,\u00a0<a href=\"http:\/\/www.scconline.com\/DocumentLink\/082USFLJ\"><strong>(2020)1 SCC 1<\/strong><\/a><\/h4>\n<p style=\"text-align: justify;\">The 5-judge bench of Ranjan Gogoi, CJ, S.A. Bobde, Dr. D.Y. Chandrachud, Ashok Bhushan and S. Abdul Nazeer, JJ, sat down to finally put an end to the Ayodhya Title dispute and unanimously held that the disputed land is to be given to Trust for construction of Ram Mandir. In an effort to balance the interest of both the parties involved, the Court directed that a suitable plot of 5 acres must be granted to Sunni Waqf Board to set up a Mosque. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2019\/11\/09\/ayodhya-verdict-heres-why-the-5-judge-bench-unanimously-held-that-the-disputed-site-belongs-to-hindus-detailed-report\/\">Read more<\/a><\/p>\n<h4><strong><em>K.S. Puttaswamy v. Union of India (Privacy- 9 Judge)<\/em><\/strong> <a href=\"http:\/\/www.scconline.com\/LoginForDocumentLink\/B9kNR7jV\">(2017) 10 SCC 1<\/a><\/h4>\n<p style=\"text-align: justify;\">Justice Bobde was also a part of the\u00a09-judge bench\u00a0that delivered a landmark judgment which unanimously held that\u00a0the right to privacy is protected as an intrinsic part of the right to life and personal liberty under Article 21\u00a0and as a part of the freedoms guaranteed by Part III of the Constitution. It was observed that Right to Privacy forms an intrinsic part of Art. 21 and freedoms guaranteed in Pt. III. It permeates core of Preambular philosophy underlying \u201cliberty\u201d and \u201cdignity\u201d as also human concepts of \u201clife\u201d and \u201cpersonal liberty\u201d enshrined in Art. 21 and wide ranging freedoms guaranteed under Pt. III, considered essential for a meaningful human existence. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2017\/08\/24\/9-judge-bench-declares-privacy-as-a-fundamental-right-information-family-life-sexual-orientation-are-all-part-of-privacy-judgment\/\">Read more<\/a><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>Jindal Stainless Ltd v. State of Haryana<\/em><\/strong><strong>,<\/strong><strong>\u00a0<\/strong><a href=\"http:\/\/www.scconline.com\/DocumentLink\/IF9UcO42\">(2017) 12 SCC 1<\/a><\/h4>\n<p style=\"text-align: justify;\">The 9-judge bench, by a ratio of 7:2, upheld the validity of the entry tax imposed by the States on goods imported from other States. It was held that taxes simpliciter are not within the contemplation of Part XIII of the Constitution of India and that the word \u2018Free\u2019 used in Article 301 does not mean \u201cfree from taxation\u201d.\u00a0 Justice Bobde gave the majority opinion that held that States are well within their right to design their fiscal legislations to ensure that the tax burden on goods imported from other States and goods produced within the State fall equally. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2016\/11\/11\/9-judge-bench-upholds-the-validity-of-entry-tax-imposed-on-goods-imported-from-other-states\/\"><strong>Read more<\/strong><\/a><strong>\u00a0<\/strong><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>Abhiram Singh v. C.D. Commachen<\/em><\/strong> <a href=\"https:\/\/www.scconline.com\/LoginForNewsLink\/2017_SCC_OnLine_SC_9\">(2017) 2 SCC 629<\/a><\/h4>\n<p style=\"text-align: justify;\">Justice Bobde gave the majority verdict in a 4:3 verdict of a\u00a07-judge bench\u00a0that held that\u00a0an appeal in the name of religion, race, caste, community or language is impermissible under the Representation of the People Act, 1951 and would constitute a corrupt practice sufficient to annul the election\u00a0in which such an appeal was made regardless whether the appeal was in the name of the candidate\u2019s religion or the religion of the election agent or that of the opponent or that of the voter\u2019s. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2017\/01\/02\/appeal-in-the-name-of-religion-caste-or-community-of-the-candidate-his-agent-opponent-or-voter-is-a-corrupt-practice\/\">Read more<\/a><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>Krishna Kumar Singh v. State of Bihar<\/em><\/strong><strong>,<\/strong> <a href=\"https:\/\/www.scconline.com\/LoginForNewsLink\/2017_SCC_OnLine_SC_10\">(2017) 3 SCC 1<\/a><\/h4>\n<p style=\"text-align: justify;\">A\u00a07-judge bench\u00a0held that\u00a0the failure to comply with the requirement of laying an ordinance before the legislature is a serious constitutional infraction\u00a0and abuse of the constitutional process. Justice SA Bobde was part of the majority opinion. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2017\/01\/03\/re-promulgation-of-ordinances-is-a-fraud-on-the-constitution-and-a-sub-version-of-democratic-legislative-processes\/\">Read more<\/a><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>K.S. Puttaswamy (Retd.) v. Union of India<\/em><\/strong><strong>\u00a0<\/strong><a href=\"http:\/\/scconline.com\/DocumentLink\/Ts52q73g\"><strong>(2015) 8 SCC 735<\/strong><\/a><\/h4>\n<p style=\"text-align: justify;\">Justice Bobde was also a part the 3-judge bench that paved the way for the \u2018Right to Privacy\u2019\u00a0being declared as a fundamental right. The bench referred the question relating to validity of the Aadhaar scheme to a larger bench. It also held that till the matter was finally decided by the larger bench, it will not be mandatory for a citizen to obtain Aadhaar Card and also,\u00a0production of an Aadhaar card will not be condition for obtaining any benefits otherwise due to a citizen. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2015\/08\/12\/matter-relating-to-aadhaar-card-referred-to-larger-bench\/\">Read more<\/a><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>Muthuramalingam v. State <\/em><\/strong><a href=\"http:\/\/www.scconline.com\/DocumentLink\/t64BH544\"><strong>(2016) 8 SCC 313<\/strong><\/a><\/h4>\n<p style=\"text-align: justify;\">Deciding an interesting question of law as to whether consecutive life sentences can be awarded to a convict on being found guilty of a series of murders for which he has been tried in a single trial, the 5 judge bench of T.S. Thakur, CJ, Fakkir Mohamed Ibrahim Kalifulla, A.K. Sikri, S.A. Bobde and R. Union of India<\/em> <\/strong><a href=\"http:\/\/scconline.com\/DocumentLink\/TYTwj3Bg\"><strong>(2018) 14 SCC 289<\/strong><\/a><\/h4>\n<p style=\"text-align: justify;\">Justice Bobde, along with Justice L. Nageswara Rao, has on more than one occasion,\u00a0<a href=\"https:\/\/www.scconline.com\/blog\/post\/2017\/01\/17\/woman-whose-fetus-was-diagnosed-with-anencephaly-allowed-to-terminate-24-weeks-pregnancy\/\">allowed women to undergo medical termination of pregnancy in light of the apprehended danger to their lives<\/a>.<\/p>\n<h4 style=\"text-align: center;\"><span style=\"color: #000080;\"><strong><u>As Chief Justice of India<\/u><\/strong><\/span><\/h4>\n<blockquote>\n<p style=\"text-align: justify;\"><strong><em><span style=\"color: #ff0000;\"><u>\u2666Did You Know?<\/u><\/span><span style=\"color: #ff0000;\">\u00a0<\/span> In his tenure of 8 years in the Supreme Court (as Judge and Chief Justice) Justice S.A. Bobde has authored 68 judgments.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/em><\/strong><\/p>\n<\/blockquote>\n<h4 style=\"text-align: justify;\"><strong><em>In Re: Expeditious Trial of Cases under Section 138 of N.I. Act, 1881, <\/em><\/strong><a href=\"http:\/\/www.scconline.com\/DocumentLink\/lE4bdte8\"><strong>2021 SCC OnLine SC 325<\/strong><\/a><\/h4>\n<p style=\"text-align: justify;\">Noticing that the summary trials of complaints filed under Section 138 of the Negotiable Instruments Act, 1881 are being routinely converted to summons trials in a \u201cmechanical manner\u201d, the Constitution bench of SA Bobde, CJ and L. Nageswara Rao, BR Gavai, AS Bopanna and S. Ravindra Bhat, JJ directed the High Courts to issue practice directions to the Magistrates for recording cogent and sufficient reasons while doing so. The Court explained that in a case tried summarily in which the accused does not plead guilty, it is sufficient for the Magistrate to record the substance of the evidence and deliver a judgment, containing a brief statement of reasons for his findings. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/04\/18\/no-more-mechanical-conversion-of-complaints-under-section-138-ni-act-from-summary-to-summons-trial-magistrates-must-record-reasons-supreme-court\/\">Read more<\/a><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>In re: Assessment of the Criminal Justice System in response to Sexual Offences<\/em><\/strong>,\u00a0<a href=\"http:\/\/www.scconline.com\/DocumentLink\/8PRX4rB9\"><strong>2019 SCC OnLine SC 1654<\/strong><\/a><\/h4>\n<p style=\"text-align: justify;\">In a bid to make criminal justice system responsive in cases relating to sexual assaults, a 3-judge bench of SA Bobde, CJ and BR Gavai and Surya Kant, JJ sought information with regard to status of affairs at ground level from various duty holders like investigation agencies, prosecution, medico-forensic agencies, rehabilitation, legal aid agencies and also Courts to get a holistic view. Taking note of the fact that post Nirbhaya incident, which shocked the conscience of the nation, many amendments were introduced in criminal law redefining the ambit of offences, providing for effective and speedy investigation and trial, the Court noticed that still the desired results were not achieved and that as per the latest report of National Crime Records Bureau of Crime in India. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2019\/12\/18\/sc-seeks-responses-from-centre-state-govts-in-a-bid-to-make-criminal-justice-system-responsive-in-sexual-assaults-cases\/\">Read more<\/a><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>Attorney General for India v. Satish,<\/em><\/strong>\u00a0<a href=\"http:\/\/www.scconline.com\/DocumentLink\/039Q1uBa\"><strong>2021 SCC OnLine SC 42<\/strong><\/a><\/h4>\n<p style=\"text-align: justify;\">The 3-judge bench of SA Bobde, CJ and AS Bopanna and V. Ramasubramanian, JJ stayed\u00a0<a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/01\/25\/bombay-hc-on-sexual-assault-would-pressing-of-breast-and-attempt-to-remove-salwar-of-a-child-fall-under-s-7-and-punishable-under-s-8-of-pocso-act\/\">the controversial Bombay High Court judgment<\/a>\u00a0wherein the High Court had acquitted the accused under Section 8 of the POCSO Act, 2012 on the ground that the accused had no sexual intent in committing the offence under POCSO Act because there was no direct physical contact, i.e., skin to skin. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/01\/27\/no-sexual-assault-if-no-skin-to-skin-contact-supreme-court-stays-bombay-high-courts-dangerous-precedent-on-pocso-act\/\">Read more<\/a><\/p>\n<h4 style=\"text-align: justify;\"><strong><em>Rakesh Vaishanv v.
