{"id":246888,"date":"2021-04-10T14:36:12","date_gmt":"2021-04-10T09:06:12","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=246888"},"modified":"2021-07-09T12:03:17","modified_gmt":"2021-07-09T06:33:17","slug":"illegal-mechanical-sand-mining","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/04\/10\/illegal-mechanical-sand-mining\/","title":{"rendered":"NGT | Compensation for damage to environment has to be in light of cost of restoration: Issue of compensation to be revisited in case of illegal mechanical sand mining on river bed of Yamuna"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>National Green Tribunal (NGT): <\/strong>The Coram of Justice Adarsh Kumar Goel, Chairperson and Justice Sudhir Agarwal, Justice Brijesh Sethi, Judicial Members and Dr Nagin Nanda, Expert Member, addressed an application with regard to illegal mechanical sand mining.<\/p>\n<p style=\"text-align: justify;\"><strong>Question for consideration<\/strong><\/p>\n<p style=\"text-align: justify;\">Remedial action against illegal mechanical sand mining on the river bed of River Yamuna and construction of a temporary bridge with hume pipes at Shamli, Uttar Pradesh.<\/p>\n<p style=\"text-align: justify;\">Earlier, Tribunal in light of the Joint Committee\u2019s report had considered the above-stated issue and had directed remedial action against which the entity carrying on mining approached the Supreme Court by way of appeal. Though Supreme Court had dismissed the said appeal.<\/p>\n<p style=\"text-align: justify;\">Vide an Order dated 28-11-2019, Tribunal noted the remedial action taken by way of levy of compensation and revocation of Environmental Clearance was inadequate.<\/p>\n<p style=\"text-align: justify;\">Vide an Order dated 29-10-2020, compensation for damage to the environment had to be in the light of the cost of restoration with deterrent element and having regard to the financial capacity of the violator. This aspect does not seem to have been considered.<\/p>\n<p style=\"text-align: justify;\">Further, the Bench stated that State PCB and District Magistrate may take further appropriate action. Compensation was recovered for only 48 days, though illegal mining was found for about 5 years, as per the report.<\/p>\n<p style=\"text-align: justify;\">Tribunal noted the legal position with regard to the payment of compensation on polluter pays principle. <em>Compensation is equal to loss caused or suffered.<\/em><\/p>\n<p style=\"text-align: justify;\">In Supreme Court\u2019s decision of <em>M.C. Mehta v. Union of India<\/em>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/jiI592O5\">(1987) 1 SCC 395<\/a> it was laid down that the person undertaking hazardous activity was liable for damage caused irrespective of negligence. Compensation has to have relation with the financial worth of the violator so as to be a deterrent.<\/p>\n<p style=\"text-align: justify;\">With regard to compensation for illegal mining, Tribunal dealt with the matter in a recent order dated 26-02-2021 in <em>NGT Bar Association v. Virender Singh (State of Gujarat), <\/em>OA No. 360 of 2015.<\/p>\n<p style=\"text-align: justify;\">Moving forward, Bench in view of the facts and circumstances of the case expressed that the issue of compensation may be revisited by the joint committee of State PCB and District Magistrate.<\/p>\n<p style=\"text-align: justify;\">Application was disposed of in view of the above-stated reasons.
