{"id":245365,"date":"2021-03-11T12:55:27","date_gmt":"2021-03-11T07:25:27","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=245365"},"modified":"2021-07-30T10:05:46","modified_gmt":"2021-07-30T04:35:46","slug":"virginia-consumer-data-protection-act-signed","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2021\/03\/11\/virginia-consumer-data-protection-act-signed\/","title":{"rendered":"Virginia | Consumer Data Protection Act, signed"},"content":{"rendered":"<p style=\"text-align: justify;\">On March 02, 2021, the Virginia Consumer Data Protection Act signed by the Governor. <span class=\"md\"><span data-preserver-spaces=\"true\">It e<\/span><\/span>stablishes a framework for controlling and processing personal data in the Commonwealth.<\/p>\n<p><strong>Applicability:<\/strong><\/p>\n<p style=\"text-align: justify;\">The Act applies to all persons that conduct business in the Commonwealth and either<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">(i) control or process personal data of at least 100,000 consumers; or<\/p>\n<p style=\"padding-left: 40px; text-align: justify;\">(ii) derive over 50 percent of gross revenue from the sale of personal data and control or process personal data of at least 25,000 consumers.<\/p>\n<p style=\"text-align: justify;\">The Act does not apply to state or local governmental entities and contains exceptions for certain types of data and information governed by federal law.<\/p>\n<p style=\"text-align: justify;\"><strong>Key Features<\/strong>:<\/p>\n<ul style=\"text-align: justify;\">\n<li>outlines responsibilities and privacy protection standards for data controllers and processors.<\/li>\n<li>grants consumer rights to access, correct, delete, obtain a copy of personal data, and to opt out of the processing of personal data for the purposes of targeted advertising.<\/li>\n<li>provides that the Attorney General has exclusive authority to enforce violations of the law, and the Consumer Privacy Fund is created to support this effort.<\/li>\n<li>directs the Joint Commission on Technology and Science to establish a work group to review the provisions of this act and issues related to its implementation, and to report on its findings by November 1, 2021.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Effective date: January 1, 2023.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On March 02, 2021, the Virginia Consumer Data Protection Act signed by the Governor.
