National Green Tribunal (NGT), Principal Bench, New Delhi:\u00a0<\/strong>The Bench of Justice Adarsh Kumar Goel (Chairperson) and Justice Sheo Kumar Singh (Judicial Member) and Dr Nagin Nanda (Expert Member)declined any relief to the applicant seeking an injunction against the demolition of Dhobi Ghat.<\/p>\n

The instant application sought an injunction against the demolition of Dhobi Ghat,\u00a0<\/em>Okhla Delhi.<\/p>\n

Applicant on an earlier occasion had approached the Delhi High Court by way of\u00a0WP (C) 8963 of 2020, Muslim Kassar Vikas Sangthan (Reg.) v. Delhi Development Authority,\u00a0<\/span><\/em>the said petition was disposed of on 12-11-2020, wherein the Court had asked the petitioners to approach the NGT.\u00a0<\/span><\/p>\n

Tribunal found the grievance to be out of the ambit of Sections 14 and 15 of the National Green Tribunal Act, 2010.<\/p>\n

Bench added that jurisdiction of NGT under Sections 14 and 15 can be invoked by a victim of pollution for the restoration of environment or for compensation to the victim, and the said issue is not shown in the instant matter.<\/p>\n

Hence, in view of the above application was disposed of. [Muslim Kassar Vikas Sangthan (Regd.) v. Delhi Development Authority, 2020 SCC OnLine NGT 867<\/b><\/a>, decided on 11-12-2020]<\/span><\/p>\n

Section 14 of the NGT Act<\/a>:<\/span><\/h3>\n

Tribunal<\/span>\u00a0to<\/span>\u00a0settle<\/span>\u00a0disputes<\/span><\/b>.\u2014(1) The\u00a0Tribunal<\/span>\u00a0shall have the jurisdiction over all civil cases where a substantial question relating\u00a0to<\/span>\u00a0environment (including enforcement of any legal right relating\u00a0to<\/span>\u00a0environment), is involved and such question arises out of the implementation of the enactments specified in Schedule I.<\/p>\n

(2) The\u00a0Tribunal<\/span>\u00a0shall hear the\u00a0disputes<\/span>\u00a0arising from the questions referred\u00a0to<\/span>\u00a0in sub-section<\/span>\u00a0(1) and\u00a0settle<\/span>\u00a0such\u00a0disputes<\/span>\u00a0and pass order thereon.<\/p>\n

(3) No application for adjudication of dispute under this\u00a0section<\/span>\u00a0shall be entertained by the\u00a0Tribunal<\/span>\u00a0unless it is made within a period of six months from the date on which the cause of action for such dispute first arose:<\/p>\n

Provided that the\u00a0Tribunal<\/span>\u00a0may, if it is satisfied that the applicant was prevented by sufficient cause from filing the application within the said period, allow it\u00a0to<\/span>\u00a0be filed within a further period not exceeding sixty days.<\/p>\n

Section 15 of the NGT Act<\/a>:<\/span><\/h3>\n

Relief<\/span>,\u00a0compensation<\/span>\u00a0and<\/span>\u00a0restitution<\/span><\/b>.\u2014(1) The\u00a0Tribunal<\/span>\u00a0may, by an order, provide,\u2014<\/p>\n

(a<\/i>)\u00a0relief<\/span>\u00a0and<\/span>\u00a0compensation<\/span>\u00a0to the victims of pollution\u00a0and<\/span>\u00a0other environmental damage arising under the enactments specified in the Schedule I (including accident occurring while handling any hazardous substance);<\/p>\n

(b<\/i>) for\u00a0restitution<\/span>\u00a0of property damaged;<\/p>\n

(c<\/i>) for\u00a0restitution<\/span>\u00a0of the environment for such area or areas,<\/p>\n

as the\u00a0Tribunal<\/span>\u00a0may think fit.<\/p>\n

(2) The\u00a0relief<\/span>\u00a0and<\/span>\u00a0compensation<\/span>\u00a0and<\/span>\u00a0restitution<\/span>\u00a0of property\u00a0and<\/span>\u00a0environment referred to in clauses (a<\/i>), (b<\/i>)\u00a0and<\/span>\u00a0(c<\/i>) of sub-section<\/span>\u00a0(1) shall be in addition to the\u00a0relief<\/span>\u00a0paid or payable under the Public Liability Insurance\u00a0Act<\/span>, 1991 (6 of 1991).<\/p>\n

(3) No application for grant of any\u00a0compensation<\/span>\u00a0or\u00a0relief<\/span>\u00a0or\u00a0restitution<\/span>\u00a0of property or environment under this\u00a0section<\/span>\u00a0shall be entertained by the\u00a0Tribunal<\/span>\u00a0unless it is made within a period of five years from the date on which the cause for such\u00a0compensation<\/span>\u00a0or\u00a0relief<\/span>\u00a0first arose:<\/p>\n

Provided that the\u00a0Tribunal<\/span>\u00a0may, if it is satisfied that the applicant was prevented by sufficient cause from filing the application within the said period, allow it to be filed within a further period not exceeding sixty days.<\/p>\n

(4) The\u00a0Tribunal<\/span>\u00a0may, having regard to the damage to public health, property\u00a0and<\/span>\u00a0environment, divide the\u00a0compensation<\/span>\u00a0or\u00a0relief<\/span>\u00a0payable under separate heads specified in Schedule II so as to provide\u00a0compensation<\/span>\u00a0or\u00a0relief<\/span>\u00a0to the claimants\u00a0and<\/span>\u00a0for\u00a0restitution<\/span>\u00a0of the damaged property or environment, as it may think fit.<\/p>\n

(5) Every claimant of the\u00a0compensation<\/span>\u00a0or\u00a0relief<\/span>\u00a0under this\u00a0Act<\/span>\u00a0shall intimate to the\u00a0Tribunal<\/span>\u00a0about the application filed to, or, as the case may be,\u00a0compensation<\/span>\u00a0or\u00a0relief<\/span>\u00a0received from, any other court or authority.<\/p>\n","protected":false},"excerpt":{"rendered":"
