{"id":239497,"date":"2020-11-22T18:48:01","date_gmt":"2020-11-22T13:18:01","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=239497"},"modified":"2020-11-22T18:48:01","modified_gmt":"2020-11-22T13:18:01","slug":"know-your-rights-right-to-education","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/11\/22\/know-your-rights-right-to-education\/","title":{"rendered":"Know Your Rights| Right to education"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #008000;\"><strong>Under the Constitution<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: justify;\">This right guarantees free and\u00a0compulsory education for children between the age of 6 to 14 years in India under Article 21A of the Constitution of India.<\/p>\n<ul style=\"text-align: justify;\">\n<li>\u2018<em>Free education<\/em>\u2019 means that no child, other than a child who has been admitted by his or her parents to a school, shall be asked to pay any kind of fee\/charges\/expenses which may prevent him or her from pursuing and completing elementary education.<\/li>\n<li>\u2018<em>Compulsory education\u2019<\/em> casts an obligation on the appropriate Government and local authorities to provide and ensure admission, attendance and completion of elementary education by all children in the 6-14 age groups.<\/li>\n<\/ul>\n<hr \/>\n<p style=\"text-align: justify;\"><span style=\"color: #008000;\"><strong>Under the Right to Education Act, 2009<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>Focus:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li>Providing elementary education to a child (6-14 years) who does not\/could not go to school. Such child to be admitted in age appropriate class and has the right to receive special training.<\/li>\n<li>Seeks to provide children right to seek transfer from a government or govt. aided school to another such school in order to complete elementary education. Such child also has right to immediately seek a transfer certificate (TC).<\/li>\n<li>Mandates non-minority private unaided schools to reserve at least 25% of their entry level seats for children belonging disadvantaged sections to create a more integrated and inclusive schooling system.<\/li>\n<li>Mandates the appropriate government and local authorities to provide for children\u2019s access to elementary schools within the defined area or limits of the neighbourhood.<\/li>\n<li>Lays down the responsibilities of the State and Central government for carrying out provisions of the act.<\/li>\n<li>Constitution of a School Management Committee (SMC). The role of this committee to manage, monitor and support a school in its functions.<\/li>\n<li>Indicates that within 3 years from the date of commencement of the act, the appropriate government and local authority shall insure that the Pupil Teacher Ratio (PTR) is maintained in each school.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>Ensures:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li>Compulsory and free education for all.<\/li>\n<li>Special provision for special classes.<\/li>\n<li>Minimum standards.<\/li>\n<li>Admission for all.<\/li>\n<li>Quality and quantity of teaching.<\/li>\n<li>All-round development.<\/li>\n<li>By the people, for the children.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>Objectives:<\/strong><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li>Ensure that every child below the age of 14 gets free and compulsory education.<\/li>\n<li>Curb the problem of illiteracy.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ensure personal growth and in turn growth of the country.<\/p>\n<hr
