{"id":238549,"date":"2020-11-05T10:09:00","date_gmt":"2020-11-05T04:39:00","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=238549"},"modified":"2020-11-05T10:22:22","modified_gmt":"2020-11-05T04:52:22","slug":"arbitration-and-conciliation-amendment-ordinance-2020-stakeholder-get-opportunity-to-seek-unconditional-stay-of-enforcement-of-arbitral-awards-induced-by-fraud-or-corruption","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2020\/11\/05\/arbitration-and-conciliation-amendment-ordinance-2020-stakeholder-get-opportunity-to-seek-unconditional-stay-of-enforcement-of-arbitral-awards-induced-by-fraud-or-corruption\/","title":{"rendered":"Arbitration and Conciliation (Amendment) Ordinance, 2020: Stakeholder get opportunity to seek unconditional stay of enforcement of arbitral awards induced by fraud or corruption"},"content":{"rendered":"<blockquote>\n<p style=\"text-align: center;\"><span style=\"color: #800000;\">President promulgates Arbitration and Conciliation (Amendment) Ordinance, 2020<\/span><\/p>\n<\/blockquote>\n<h3><span style=\"color: #0000ff;\"><strong>Amendment of Section 36<\/strong><\/span><\/h3>\n<p style=\"text-align: justify;\">In Section 36 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the principal Act), in sub-section (3), after the proviso, the following shall be inserted and shall be deemed to have been inserted with effect from 23rd day of October, 2015, namely:\u2014<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">&#8220;Provided further that where the Court is satisfied that a prima facie case is made out,-\u2014 <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">(a) that the arbitration agreement or contract which is the basis of the award; or <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">(b) the making of the award, <\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\">was induced or effected by fraud or corruption, it shall stay the award unconditionally pending disposal of the challenge under section 34 to the award.&#8221;. <\/span><\/p>\n<p style=\"text-align: justify;\"><em>Explanation.\u2014<\/em> For the removal of doubts, it is hereby clarified that the above proviso shall apply to all court cases arising out of or in relation to arbitral proceedings, irrespective of whether the arbitral or court proceedings were commenced prior to or after the commencement of the Arbitration and Conciliation (Amendment) Act, 2015.<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Substitution of new Section for Section 43J<\/span><\/h3>\n<p style=\"text-align: justify;\">For section 43J of the principal Act, the following section shall be substituted, namely:-\u2014<\/p>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #800000;\">Norms for accreditation of arbitrators<\/span><\/strong><\/p>\n<p style=\"text-align: justify;\">&#8220;43J. The qualifications, experience and norms for accreditation of arbitrators shall be such as may be specified by the regulations.&#8221;<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"color: #0000ff;\">Omission of Eighth Schedule<\/span><\/h3>\n<p style=\"text-align: justify;\">The Eighth Schedule to the principal Act shall be omitted.<\/p>\n<p style=\"text-align: center;\"><span
